#Dog Bite Laws and Statutes of Limitations in the United States

If you've been attacked and injured by a dangerous dog, it's in your best interest to contact a lawyer as soon as possible. When you get a lawyer quickly, more evidence may be gathered to prove your case and the dangerous dog can be stopped before it has the chance to hurt anyone else.

Preliminary Note:

Every state has different laws regarding a dog owner's liability for dog bites. Some states follow their common law. Other states have enacted statutory law in the form of Dog Bite Statutes. Most often, a Dog Bite Statute abolishes the common law, because, unlike the common law, these statutes don't require a dog bite victim to prove that a dog owner was at fault for an injury. In some states, however, people who have been injured by a dog are able to recover money damages under both the common law and their state's Dog Bite Statute. The following guide outlines state dog bite laws.

Few of my friends question me indirectly questions like:

  • What are you trying to achieve by doing MBA ?
  • Will you really make more money after MBA in USA ?
  • What if you do not make more money after MBA ?
  • Why dont you do it online. You get the MBA degree

If you think logically, what my friends are asking is correct. What if I really do not make more money, is my degree going to be waste?  Let’s try to analyze the question and possibilities by using some math ! Imagine you are spending $60,000 towards your MBA in USA.  What is the Return on your investment for $60,000. When will you be break-even? When will you make more money from the MBA degree?

If everything goes well and you get a job promotion and make $5,000 more every year then it takes 12 years for you to break-even. ( I am taking a very minimum hike scenario, in reality you may get more, but for discussion let’s look at worst case scenario as base case ) . Even ... Read more »

Libertarians, like other Americans, want to be able to walk city streets safely and be secure in their homes. We also want our Constitutional rights protected, to guard against the erosion of our civil liberties. In particular, Libertarians want to see all people treated equally under the law, as our Constitution requires. America's millions of gun owners are people too.

Law-abiding, responsible citizens do not and should not need to ask anyone's permission or approval to engage in a peaceful activity. Gun ownership, by itself, harms no other person and cannot morally justify criminal penalties.

America's founders fought the Revolutionary War to throw off British tyranny. Most of the revolutionaries owned and used their own guns in that war. After the war, in 1789, the 13 American States adopted the Constitution, creating the federal government. Before ratifying the Constitution, the people demanded a Bill of Rights to prevent our government ... Read more »

Today s topic: Bullying Laws

And now, your daily dose of legalese: This article does not create an attorney-client relationship with any reader. In other words, although I am a lawyer, I m not your lawyer. In fact, we barely know each other. If you need personalized legal advice, contact an attorney in your community.

On May 21, , Rutgers undergrad Dharun Ravi was sentenced to 30 days in prison for a incident in which he used a webcam to spy on his gay roommate, Tyler Clementi, who later committed suicide. The Rutgers case has re-ignited interest in laws aimed at preventing school bullying. In this article, I ll explain how these laws work.

As the name implies, bullying laws are meant to prevent threats or actual violence among students. A movement for such laws took off in 1999, after 13 people were gunned down at Columbine High School in Littleton, Colorado. The two students who carried out the rampage and who also took their own lives -- were thought to be ... Read more »

The Amos Tuck School of Business Administration is the graduate business school of Dartmouth College in Hanover, New Hampshire, United States of America. Founded in 1900, Tuck is the oldest graduate school of business in the US, and was the first institution to offer master's degrees in the field of business administration. It is one of six Ivy League business schools, and it consistently ranks in the top ten of national business school rankings.

The program allows students to largely structure their own course of study subject to the constraint of a broad set of requirements. This is in contrast to other top-tier business schools, which impose a cohort or learning team system that includes coursework to be completed in a pre-determined order. The program differentiates itself by allowing students the flexibility to construct a program of study that is tailored to their needs, and can be as broad or deep as they choose. There is only one required course for full-time program ... Read more »

#Domestic violence laws

http://www.womenslaw.org//simple.php?sitemap_id=39 Power and Control Wheel.

Domestic violence happens to people of all ages, races, ethnicities, and religions. It occurs in both opposite-sex and same-sex relationships. A person's gender, gender identity, or sexual orientation does not determine whether s/he can be a victim of domestic violence or an abuser. Economic or professional status does not affect whether someone can commit domestic violence or be the victim of domestic violence - abusers and victims can be laborers or college professors, judges or janitors, doctors or orderlies, teachers, truck drivers, homemakers or store clerks. Domestic violence occurs in the poorest neighborhoods, the fanciest mansions and white-picket-fence neighborhoods.

Here are some examples of the different forms of abuse, as explained by The Network La Red :

And with good reason. Where you went to school matters in this profession. In our series of open threads about the rankings, Elie commented in the posts on the third tier and fourth tier schools that only a lucky few of their graduates would be able to score jobs that pay the big bucks.

So how good exactly do you have to be to appeal to employers?

A dog bite lawyer is the most qualified person to handle your basic needs after a dog bite, without creating unnecessary hard feelings. All parties will recognize that handling these claims is best left to a qualified dog bite lawyer who knows the legal issues at stake.

It is important for victims who will have long-term injuries to be well-represented in court. A dog bite victim who has been disfigured, possibly permanently, is especially in need of a dog bite attorney to handle his or her substantial claim of loss of earning potential and medical costs.

A dog bite attorney can obtain and analyze reliable medical evidence, including reports, patient forms and billings. Negotiating the true cost of a dog bite to the victim will also often involve health insurance companies as well.

An experienced dog bite attorney is the best person to handle these claims in Pennsylvania instead of an injured dog bite victim who is in recovery. An expert dog bite lawyer knows ... Read more »

Lemon laws are American state law s that provide a remedy for purchasers of cars and other consumer goods in order to compensate for products that repeatedly fail to meet standards of quality and performance. Although there may be defective products of all sorts ranging from small electrical appliance s to huge pieces of machinery, and there is even a "puppy lemon law", the term "lemon" is generally thought of as applying to defective vehicles such as automobiles, trucks. SUV s, and motorcycles .

These vehicles and other goods are called "lemons ". The federal lemon law (the Magnuson–Moss Warranty Act ) was enacted in 1975 and protects citizens of all states. State lemon laws vary by state and may not necessarily cover used or leased cars, and other goods. The rights afforded to consumers by lemon laws may exceed the warranties expressed in purchase contracts. Lemon law is the common nickname for these laws, but each state has different names for the laws and a ... Read more »

What is Maritime and Admiralty Law?

Maritime law, also referred to as admiralty law, consists of the statutes and case precedents that govern legal disputes originating on navigable waters. Navigable waters include all bodies of water that are capable of being used for interstate or foreign commerce. Thus, a large river that flows into the ocean or crosses state lines would fall within maritime jurisdiction. A lake entirely within a single state would not.

This area of the law deals with a variety of factual scenarios. Examples include commercial accidents resulting in damage to vessels and cargo, seamen injuries, and hazardous material spills. Maritime law can also apply to piracy and criminal activity, liens against a ship, wake damage, and towage contracts. Furthermore, in an increasing number of cases, jurisdiction has been upheld in recreational boating accidents that occur on navigable waters.

Cases in which maritime law applies are heard in fede ... Read more »

These foundational or basic laws of states or organizations, guided by constitutional frameworks, are the bases for a cooperative give and take leading to peace and prosperity for all while at the same time ensuring the human rights of all members of that society.

Constitutional law is created through judicial interpretation of the constitution. Judicial review of the constitution by judges who study and construe the constitutional sections encompasses court decisions which create the body of constitutional law. This case law becomes the precedent for future cases.

In the United States. there are cases arising under the constitution, federal law, or a treaty. 29 Code of Federal Regulations (C.F.R.) Part 1614

The regulations governing the processing of Federal sector discrimination complaints are contained in Title 29 C.F.R. Part 1614. These regulations also define the role of the counselors, managers, supervisors, and witnesses.

Age Discrimination in Employment Act (ADEA) of 1967, as amended

The ADEA prohibits discrimination in employment on the basis of age (40 years or older). Unlike Title VII and the Rehabilitation Act, the ADEA allows persons claiming age discrimination to go directly to court without going through an agency's administrative complaint procedures. If, however, a complainant chooses to file an administrative complaint, (s)he must exhaust administrative remedies before proceeding to court. As with Title VII complaints, a complainant exhausts administrative remedies 180 days after filing a formal complaint or 180 days after filing an appeal with the Equ ... Read more »

Yes, it s true and it s pretty fucking stupid.

Basically they re talking about banning all alcohol advertising to protect the impressionable children which means that all alcohol related advertising in public areas would be illegal. Because apparently adverts encourage people to start drinking younger to which I ll point out that if stuff s illegal just because then someone will sure as hell rebel. And this includes underage drinking so I doubt the advertising blackout will do shit.

The new laws also mean that a restaurant can t for example use a following kind of positive Facebook review in their advertising, social media or otherwise: Great restaurant, absolutely mouthwatering food, make sure to check out their shrimps, nice atmosphere, a large selection of beers for all tastes. They re also forbidden from creating content that can be shared, which has also apparently lead to Finnish government to asking Facebook to ban the Share button in Finland.

#Editor’s Preface - Ukranian Law Firms

The current environment in Ukraine is extremely challenging for doing business irrespective of whether these are foreign or national investors. All economic actors inside and outside of the country are waiting for the termination of the conflict in Donbass and speedy, comprehensive reforms. And these two words are hallmarks of every single political speech, business meeting or public discussion. But is the current Parliament capable for designing a responsive regulatory frame and corporate regime notoriously strong in investment protection both quickly and efficiently?

The rapprochement between the business sector and state is far from ideal but public inquiries prove this is the only way to revive the economy. As you can further examine in the Ukrainian Legal Market section, representatives of the legal business became subjects of political and government policies. The role of non-government initiatives and business a ... Read more »

Whether you are just finishing high school, in the midst of taking your undergraduate degree or have been out of university for years, the path to law school may seem daunting. But do not disqualify yourself just because you are not the same age or do not have the same specific interests as others that are applying or are currently in law school.

Lawyer Nathaniel Burney says law school is not for everybody, but for those who are meant to take a law degree and become a lawyer, it is extremely fulfilling. “…for those who belong here, the law is a wonderful place to be,” writes Burney on “The Criminal Lawyer” blog. “It challenges the intellect, inspires ideas, and gives you a chance to really make a difference”.

“Students who are successful in law school, and who become accomplished professionals, come from many walks of life and educational backgrounds. Some law students enter law school directly from their undergraduate studies without having had any post baccalaureat ... Read more »

A new report published by the Environmental Law Alliance Worldwide concludes that courts in several countries are poised to pursue climate justice.

Some people are profiting enormously from damaging the climate, while others will bear the costs of that climate damage, says Jennifer Gleason, ELAW Staff Attorney.

Jen led a research team of ELAW partners from the United States, India, Ecuador, Brazil, Mexico, and Kenya to identify jurisdictions around the world where strong cases could be filed to hold corporations accountable for damaging the climate.

    The report states:

The damage that humans are doing to the global climate may be one of the gravest injustices of all time . Many who will suffer the most are contributing almost nothing to the damage. The fundamental purpose of legal systems and courts is to prevent and remedy injustices, and we appreciate this opportunity to mobilize courts to prevent and remedy this grave injustic ... Copywrite laws are they to vague?

    Hey guys

This is something of a serious note, any feedback to the following will be much appreciated. As a fan of any art, literature, and so forth I found this quite disturbing at the stupidity of some companies.

This letter comes from a fan site dedicated to creating Skins and Meshes involving Marvel characters for the game Freedom Force. What has come to my understanding is that anything a fan does that "distributes" copyrighted material in any form (Like our great Star Trek Mods) is infringing on the rights of the company.

Funny thing I thought Fans are supposed to love and support their favorite Icon, I guess all those Star Trek conventions are breaking the law. I feel a gnawing disgust at the moment.

If you have been assigned the appropriate Text material that this book is keyed to, then I would HIGHLY recommend this book. I used this book for Property I. I agree with the other reviewers who said you don't have to open the textbook if you have this bad-boy (except maybe to maybe the textbook's table of contents), although you may want to get the case brief book from Aspen Publishers to backhand-slap recitation out of the way.

CON: Not too many practice problems. You may want to invest in practice exam/questions book, ESPECIALLY for the chapters on 'Freehold Estates' and 'Future Interests', which seriously apply to one another.

"Harassment" refers to a broad number of behaviors that are subject to both criminal punishment and civil liability. On the criminal side, states have a wide variety of criminal laws forbidding harassment in many forms, including general harassment crimes as well as specific forms of harassment, such as stalking and cyberstalking.

Criminal harassment should not be confused with how "harassment" is often used in contexts such as workplace discrimination lawsuits. Federal and state laws ban discrimination against certain types of people in certain situations, such as at work or in housing decisions. In these non-criminal contexts, the victim can sue the harasser in a private civil lawsuit, alleging that the harassment constitutes discrimination.

On the other hand, criminal harassment is usually confined to state law. States vary in how they define criminal harassment. Generally, criminal harassment entails intentionally targeting someone else with behavior tha ... Read more »

    What is Education Law?

Education Law is the area of law that relates to schools, teachers, and the rights of Americans to a public education, as well as standards for those students who attend private schools.

    American Right to Education

American laws mandate that every child be given the opportunity to an education. Each state has its own school system, and as a result, there are very different laws among the various states with regard to management of schools, teachers, and funding for public education. However, they are all overseen by the federal government through the Department of Education.

    Equal Education Opportunities

There is a strong emphasis on providing equal opportunities for education. This includes both to minorities and historically disadvantaged groups, as well as to those with disabilities. The Equal Education Opportunities Act of 1974 provides that no state can deny an equal oppo ... Read more »

I got this because it was keyed to Dukeminier, but found it was also keyed to other textbooks as well. It is arranged purely in an outline format and I found it helpful for review. Most of the cases my class studied were covered by this outline. I will say, however, that I probably would have gone with the Gilbert's if I had to do it again- I had to borrow my classmates version when I came to a few of the stickier areas of the law. The Gilberts was more of a summary of the restatement, which just seemed to work better for my particular course.

EEOC: Civil Rights Laws Bar Sexual Orientation Discrimination

This is, as Joe Biden would say, a big fucking deal:

WASHINGTON — The Equal Employment Opportunity Commission has ruled that existing civil rights law bars sexual orientation-based employment discrimination — a groundbreaking decision to advance legal protections for gay, lesbian, and bisexual workers.

“[A]llegations of discrimination on the basis of sexual orientation necessarily state a claim of discrimination on the basis of sex,” the commission concluded in a decision dated July 15.

The independent commission addressed the question of whether the ban on sex discrimination in Title VII of the Civil Rights Act of 1964 bars anti-LGB discrimination in a complaint brought by a Florida-based air traffic control specialist against Transportation Sec. Anthony Foxx.

The ruling — approved by a 3-2 vote of the five- ... Read more »

EEOC: federal law already bans sexual-orientation bias

After a period of foreshadowing and rumor, the Equal Employment Opportunity Commission has now gone ahead and ruled  that employment discrimination on the basis of sexual orientation is forbidden under existing federal civil rights law, specifically the current ban on sex discrimination. Congress may have declined to pass the long-pending Employment Non-Discrimination Act (ENDA), but no matter; the commission can reach the same result on its own just by reinterpreting current law.

It’s not the commission that gets to have the final say on that, however; it’s the federal courts. And there is a fair trail of precedent, including circuit court authority. rejecting the proposition that sex discrimination in this setting can be stretched to cover sexual orientation discrimination. Against that, it will be argued that some recent case law has nonetheless drifte ... Read more »
