The phrase "degrees of murder" refers to the intent or severity of a particular murder charge. Some states define their degrees of murder numerically. Common degrees of murder include first degree murder and second degree murder. Other states place specific labels on their murder offenses, such as capital murder, murder, and justifiable homicide.

Despite the label of the degree of murder, the idea is to gradually increase the punishment with the degree. The more egregious the killing, or the motive behind a killing, then the higher the degree of punishment for that type of murder charge.

First-degree murder, or capital murder as it is often called, is the most serious form of murder. Back in July, a Federal District Court Judge enjoined Arizona from enforcing the key provisions of its controversial immigration law, specially those that authorized local police to require suspected illegal immigrants to provide immigration papers even without a valid arrest. Today, the Ninth Circuit Court of Appeals upheld that injunction in an appeal that the state had filed almost immediately after the decision:

The U.S. Court of Appeals for the 9th Circuit has ruled that lower federal court judge was right in her decision to halt parts of Senate Bill 1070 from going into effect last year.

The ruling comes almost a year after Gov. A legal termination of parental rights differs significantly from simply agreeing to not seek custody and/or visitation with a child. While parents are typically free to choose to live apart from or refrain from visiting with their children, they likely have a legal right to do so if they so choose. On the other hand, a legal termination of parental rights permanently prohibits a parent from having any legal rights to the child, including the right to custody of the child, the right to visit or have any contact with the child, and the right to have any input in decisions made regarding the child. The Employee Retirement Income Security Act (ERISA) is a federal law that regulates and establishes oversight for private industry pension plans, retirement plan, profit-sharing plans and health insurance coverage by establishing rules and minimum standards that are meant to protect plan participants. ERISA only governs private (non-government) employers with 25 or more employees.

ERISA does not mandate the creation of any these plans; it only sets the standards for those that choose to establish them. #Parody copyright laws set to come into effect - BBC News

Changes to UK legislation are to come into force later this week allowing the parody of copyright works.

Under current rules, there has been a risk of being sued for breach of copyright if clips of films, TV shows or songs were used without consent.

But the European Copyright Directive will allow the use of the material so long as it is fair and does not compete with the original version.

The law will come into effect on 1 October.

Owners of the copyrighted works will only be able to sue if the parody conveys a discriminatory message.

It would then be down to a judge to decide if the parody is funny.

"The only, and essential, characteristics of parody are, on the one hand, to evoke an existing work while being noticeably different from it and, on the other, to constitute an expression of humour or mockery," the EU rules state.

    Marijuana is a schedule I(C) hallucinogenic substance under Louisiana law.

    Possession for Personal Use

    For first offenders, possession of less than 60 pounds of marijuana is punishable by a fine of up to $500 and/or up to 6 months of imprisonment. Second offenses are punishable by a fine of $250-$2500 and/or up to 5 years of imprisonment. Both first and second offenders may be eligible for probation, which will include 32 hours of community service and a substance abuse program, the cost of probation will be paid by the defendant. Third and subsequent offenses are punishable by a fine of up to $5,000 and/or up to 20 years of imprisonment.

    BLACK LAWS. Slavery was not legal in Ohio, but the state legislature tried to discourage settlement of free blacks in the state through "black laws," which imposed constraints on black residents. Ohio enacted laws in 1804 and 1807 compelling registration of all African Americans in the state, requiring that they show proof of freedom, forbidding any free black to remain without giving $500 bond against his becoming a public charge, and denying validity to an African American's testimony in trials where whites were involved. The legislature imposed even more restrictions in the 1830s. However, in the legislative session of 1848–1849, a coalition led by the Free Soil Party repealed most of the restrictions.

    In common usage, eviction is the process used by landlords to recover possession of leased real property from tenants who do not want to leave. Evictions are difficult, painful, and expensive for all parties involved.

    Sources of law

    Eviction is governed by six basic types of rules: state law, local law, leases, federal law, the common law. and court rules. Most states regulate residental renting, including the eviction process. Many base their laws on the Uniform Residential Landlord And Tenant Act (URLTA) or the Model Residential Landlord-Tenant Code. Cities, counties, and other local governments often supplement these regulations. Landlords and tenants may further regulate evictions through lease terms. For example, leases might specify the form and timing of eviction notices. Lease provisions may overrule some common law rules, but may not conflict with official regulations.
