The phrase "degrees of murder" refers to the intent or severity of a particular murder charge. Some states define their degrees of murder numerically. Common degrees of murder include first degree murder and second degree murder. Other states place specific labels on their murder offenses, such as capital murder, murder, and justifiable homicide.
Despite the label of the degree of murder, the idea is to gradually increase the punishment with the degree. The more egregious the killing, or the motive behind a killing, then the higher the degree of punishment for that type of murder charge.
First-degree murder, or capital murder as it is often called, is the most serious form of murder. In most states, a first degree murder involves elements like deliberate planning, premeditation, or malice. Deliberate means that the defendant makes a clear-headed decision to kill the victim. Premeditation involves showing the defendant actually thought about the kill

Back in July, a Federal District Court Judge enjoined Arizona from enforcing the key provisions of its controversial immigration law, specially those that authorized local police to require suspected illegal immigrants to provide immigration papers even without a valid arrest. Today, the Ninth Circuit Court of Appeals upheld that injunction in an appeal that the state had filed almost immediately after the decision:
The U.S. Court of Appeals for the 9th Circuit has ruled that lower federal court judge was right in her decision to halt parts of Senate Bill 1070 from going into effect last year.
The ruling comes almost a year after Gov. Jan Brewer signed the nation s toughest immigration law into effect and five months after the appeals court was asked to consider overturning the injunction issued by U.S. District Court Judge Susan Bolton in the lawsuit filed by the U.S. Department of Justice.
The original lawsuit challenges the constitutionality of SB 1070, ar

Q. My pediatrician said that I should keep my five year old in a booster car seat. but the law here in Texas says that kids only have to ride in a car seat up until they are four years old. Who is right?
Still, many state car seat laws are way behind the times in terms of safety. Florida, for example, doesn t require car seats for preschool age children. Simply following your state s car seat laws might not get you a ticket, but it won t be the best protection for your child if you are in a car accident .
Since car seat laws and booster seat laws vary from state to state and most are still inadequate, you are much better off simply following the car seat guidelines of the American Academy of Pediatrics and the National Highway Traffic Safety Administration and keeping your child who has outgrown his forward-facing car seat in

A legal termination of parental rights differs significantly from simply agreeing to not seek custody and/or visitation with a child. While parents are typically free to choose to live apart from or refrain from visiting with their children, they likely have a legal right to do so if they so choose. On the other hand, a legal termination of parental rights permanently prohibits a parent from having any legal rights to the child, including the right to custody of the child, the right to visit or have any contact with the child, and the right to have any input in decisions made regarding the child. Termination of parental rights also relieves a parent of the responsibility to financially support his or her child. Every state has different laws that govern the termination of parental rights, and there are different situations in which a court may order that a person s parental rights be terminated.
One of the most common proceedings in which parental rights are terminated is th

#ERISA Law - Employee Retirement Income Security Act.
Guide to the Employee Retirement Income Security Act
The Employee Retirement Income Security Act (ERISA) is a federal law that regulates and establishes oversight for private industry pension plans, retirement plan, profit-sharing plans and health insurance coverage by establishing rules and minimum standards that are meant to protect plan participants. ERISA only governs private (non-government) employers with 25 or more employees.
ERISA does not mandate the creation of any these plans; it only sets the standards for those that choose to establish them. ERISA was amended by the Consolidated Omnibus Budget Reconciliation Act (COBRA) in 1985 to include provisions for workers whose established health insurance coverage is affected by their employment situation. And a more recent amendment in 1996, the Health Insurance Portability and Accountability Act (HIPAA), protects the transferability and security of

#Parody copyright laws set to come into effect - BBC News
Changes to UK legislation are to come into force later this week allowing the parody of copyright works.
Under current rules, there has been a risk of being sued for breach of copyright if clips of films, TV shows or songs were used without consent.
But the European Copyright Directive will allow the use of the material so long as it is fair and does not compete with the original version.
The law will come into effect on 1 October.
Owners of the copyrighted works will only be able to sue if the parody conveys a discriminatory message.
It would then be down to a judge to decide if the parody is funny.
"The only, and essential, characteristics of parody are, on the one hand, to evoke an existing work while being noticeably different from it and, on the other, to constitute an expression of humour or mockery," the EU rules state.
"If a parody conveys a discriminatory messa

You can't believe it. The new car you bought makes an atrocious knocking noise when you drive it, and the dealer's mechanic can't seem to find the problem. Do you have to just bite the bullet and buy a lifetime supply of earplugs?
Fortunately, you do have recourse. New York has laws to protect you in case a dealer sells you a "lemon"?a car that is unsafe, inefficient, or riddled with defects.
New York's New Car Lemon Law compels the manufacturer of such a car to make the necessary repairs (usually through the dealer that sold it), refund your money, or replace the vehicle. The law is limited to cars used primarily for personal use and does not cover motorcycles, ATVs, or the living quarters of an RV. A car is covered under the New Car Lemon Law if all of the following apply:
It was covered under a manufacturer's warranty when it was originally delivered to its first buyer. It was bought, leased, or transferred in the state of New York within the vehicle's f

#Estate Planning
estate planning: an overview
Estate planning is the process by which an individual or family arranges the transfer of assets in anticipation of death. An estate plan aims to preserve the maximum amount of wealth possible for the intended beneficiaries and flexibility for the individual prior to death. A major concern for drafters of estate plans is federal and state tax law.
An estate is the total property, real and personal, owned by an individual prior to distribution through a trust or will. Real property is real estate and personal property includes everything else, for example cars, household items, and bank accounts. Estate planning distributes the real and personal property to an individual's heirs.
Wills and trusts are common ways in which individuals dispose of their wealth. (See Estates and Trusts ). Trusts, unlike wills, have the benefit of avoiding probate, a lengthy and costly legal process that oversees the transfer of

#European Trade Union Institute (ETUI) - The crisis and national labour law reforms: a mapping exercise
Publication date : 2012
Number of pages : 19
Stefan Clauwaert (ETUI) and Isabelle Schömann (ETUI)
This Working Paper maps the labour law reforms in various European countries either triggered by the crisis or introduced using the crisis – falsely – as an excuse. Such reforms generally render existing labour law provisions more flexible and loosen minimum standards, shifting the emphasis to soft law (deregulation).
In some countries it consists only of piecemeal although significant deregulatory measures, while in others it involves far-reaching overhauls of the whole labour code. Furthermore, in several countries fundamental changes are being made to industrial relations structures and processes which might jeopardise social dialogue and collective bargaining there.
The authors critically address this large

#EUROPA - EU treaties
The European Union is based on the rule of law. This means that every action taken by the EU is founded on treaties that have been approved voluntarily and democratically by all EU member countries. For example, if a policy area is not cited in a treaty, the Commission cannot propose a law in that area.
A treaty is a binding agreement between EU member countries. It sets out EU objectives, rules for EU institutions, how decisions are made and the relationship between the EU and its member countries.
Treaties are amended to make the EU more efficient and transparent, to prepare for new member countries and to introduce new areas of cooperation such as the single currency.
Under the treaties, EU institutions can adopt legislation, which the member countries then implement. The complete texts of treaties, legislation, case law and legislative proposals can be viewed using the EUR-Lex database of EU law .

‘Commercial Law’ is a broad term used to cover a wide range of legal services designed to support businesses in making money out of their products and services. Intellectual property rights are crucial for creative industries such as publishing and fashion in particular, but also for manufacturers, in order to profit from innovation. Sales of all kinds, on a domestic and international basis, are contracts – meaning lawyers are needed. Specific arrangements – agency or distribution agreements – can be made to sell the goods or services more widely.
Except in smaller firms, there is no such thing as a ‘commercial lawyer’, except in the sense that the term covers all lawyers whose clients are businesses rather than individuals. Every commercial lawyer will have a specialist practice area (e.g. Intellectual Property) or industry focus(e.g. Technology, Media Telecoms).
A lot of the day to day work tends to involve drawing up a wide range of commercial agreements, as well

The Online Education has made several changes in the education market.
Background:
It is a known fact that teachers do not get paid a huge amount for imparting education, one of the most important and complicated practices in the world.
In addition, not all teachers can handle the stress of controlling an entire class or school of students. Because of this reason, many teachers are getting on the online teaching bandwagon.
Teachers can make money teaching online courses in the comfort of their home. However, one should learn how to teach online as it requires different skills
There are differences between tradition teaching and online teaching. Online teachers need to interact their students on a “virtual’ way and communicate the instructional material without using the face to face teaching methods. It can be confusing to some teachers.

#European Review of Contract Law
Aims and Scope
This Journal deals with contract law and serves as a pan-European platform for discussion and analysis. The concept of a European Contract Law is still rather recent: the phrase was first coined in the 1990s. Since the early 2000s when this journal was created, European Contract Law has come to encompass an increasingly comprehensive body of law. There were three driving forces behind this development: the EC harmonisation of laws in the area of the internal market, a generally increased interest in comparative law discussions in contract law, and the European Commission s Communication on European Contract Law, the Commission s Action Plan and the Common Frame of Reference process. These developments brought about a changed climate of discussion. The foundations of contract law, examined from many perspectives and in view of various national legal systems and an increasing number of disciplines, are currently being discusse

Ohio enacted laws in 1804 and 1807 compelling registration of all African Americans in the state, requiring that they show proof of freedom, forbidding any free black to remain without giving $500 bond against his becoming a public charge, and denying validity to an African American's testimony in trials where whites were involved. The legislature imposed even more restrictions in the 1830s. However, in the legislative session of 1848–1849, a coalition led by the Free Soil Party repealed most of the restrictions.

#Eviction laws
Contents:
Introduction
In common usage, eviction is the process used by landlords to recover possession of leased real property from tenants who do not want to leave. Evictions are difficult, painful, and expensive for all parties involved.
Sources of law
Eviction is governed by six basic types of rules: state law, local law, leases, federal law, the common law. and court rules. Most states regulate residental renting, including the eviction process. Many base their laws on the Uniform Residential Landlord And Tenant Act (URLTA) or the Model Residential Landlord-Tenant Code. Cities, counties, and other local governments often supplement these regulations. Landlords and tenants may further regulate evictions through lease terms. For example, leases might specify the form and timing of eviction notices. Lease provisions may overrule some common law rules, but may not conflict with official regulations.

Elder abuse laws are those laws aimed a preventing the abuse of elders, either by professional caregivers or private citizens. Such laws also provide penalties for those who engage in abuse of the elderly. Every state has elder abuse laws in addition to those issued by federal authorities.
Some states may have different standards and penalties for elder abuse depending on the caregiver. Standards tend to be stricter for elder care facilities and professional workers as opposed to those applied to informal caregivers (such as a friend or relative). This is to prevent the occurrence of institutional abuses, such as when an elderly care home has deficient health care policies.

Find online degrees at online schools and learn more about the benefits of a distance learning program.
Course requirements and time commitments for online schools and distance learning programs vary depending in part on the type of online degree you're getting, whether you choose to go full-time or part-time, and if you include summer classes in your schedule.
If you want to complete your online degree program as quickly as possible, you may find more flexibility at an online school than at a campus school. Because distance learning programs like online colleges cater to students with busy or inflexible schedules, some online colleges will allow students to accelerate their studies to complete their degree in less time than it would typically take at a campus school.
Students are increasingly turning to online schools and distance learning over campus schools for many reasons; chief among them are flexibility and affordability. Here are some of the main reas

There can be a lot of confusion about the concepts of laws and facts within scientific research, and one result has been erroneous impressions not just about what these categories are, but also about how science itself works. Such confusions not only give religious believers an incorrect understanding of science, but also provide religious apologists with false foundations for ultimately inaccurate arguments. That is why it is necessary to take some time to clear up what should be basic terminology.
The concept law of science or scientific law is an inheritance from the earliest days of science when it was believed that the universe operated in the way it did because God established certain natural laws which dictated how things should and should not behave. Of course, everything but humans followed these laws, and so the movement of objects could be accurately predicted simply by coming to better understand the laws created by God. #Fact Sheet: Establishment of Interagency Working Group for the Consistent Enforcement of Federal Labor, Employment and Immigration Laws - U. S. Department of Labor
Federal agencies responsible for worker protections seek to protect all workers from exploitation and workers rights violations, regardless of immigration status. Many workers, however, are deterred or prevented from asserting workplace rights and protections. In some cases, employers may exploit immigration status to deter employees from asserting their rights. In other cases, the protections available to workers are unclear. To promote effective enforcement of federal labor, employment, and immigration laws, the Administration is announcing the creation of an interagency working group to identify policies and procedures that promote the consistent enforcement of those laws and protect all workers in the U.S.
This working group will be comprised of federal immigration enforcement agencies and federal agencies r

What is Tax law? It covers the rules, policies and laws that oversee the tax process, which involves charges on estates, transactions, property, income, licenses and more by the government. Taxation also includes duties on imports from foreign countries and all compulsory levies imposed by the government upon individuals for benefit of the state.
The intricate body of tax law covers payment of taxes to a minimum of four levels of government, either directly or indirectly. Indirect taxes are assessed against products and services that are meant to be consumed, but are paid to an intermediary. For example, when you buy coffee at a local corner store, the retailer charges you tax on your coffee, which he/she subsequently pays to the government. Direct taxes are those you pay directly to the government and are imposed against things like land or real property, personal property, and income.
There is a seemingly endless list of entities that create and enforce tax
