#Laws For Posting No Trespassing Signs
You probably have seen a No Trespassing or Keep Out sign somewhere. Doesn't it seem obvious that people cannot simply trespass on someone else's property? Under the law, what does the posting of No Trespassing signs accomplish?
"Protection from Property Liability"
Under the Universal Law, all land is originally communal land. The federal government owns many acres of land and some might think that a wilderness area may be public property. They might fish, camp or hunt on private property by accident.
A Keep Out or No Trespassing sign can control access to land by identifying it as private property. It is a good reminder to children also. Under the law, an individual who sees a No Trespassing sign cannot enter, remain or participate in any activity on property with this written notice.
Legally, anyone must ask your permission to be on your land, but you may not be there to discuss this issue with them 24/7/365. A

Legal custody refers to which parent - -if not both -- makes major decisions regarding the child, such as non-emergency medical procedures, school attendance, religious training and permission to marry or drive. If only one parent is going to make these decisions, she has sole, or primary, legal custody. If not specifically mentioned in your divorce decree or custody order, however, then joint legal custody is the default and both parents are responsible for making the big decisions, just as they still lived together.
Placement schedules can be either traditional or shared. With a traditional schedule, one parent has primary placement and the other parent has periods of placement, or visitation. With shared placement, the children spend roughly equal amounts of time with each parent. Whichever parent the child lives with on a given day is solely responsible for decisions that are not major, such as bed times, play times and discipline.
If the parents cannot agree on

Here on the award-winning FreeAdvice site, we provide legal advice and information regarding marriage, divorce, child support, child custody, domestic violence, adoption and more.
Family Law is the body of law that governs domestic issues. For instance, divorce law will address how property is divided and who will pay spousal support when a married couple separates, while child custody law will help determine what is in the best interest of a child when parents separate. Family-related legal issues can also apply to non-married couples, same-sex couples and other domestic partnerships wherein a legal relationship is established. The issue raised is the debtor(Ahmad) defaulted in paying monthly installment to the creditor(Easy Bank Bhd) which causes the creditor to repossessed the car. Ahmad has no right to oppose the term as he bought the car from the person that is not the owner, and the seller has no authority. Thus, the buyer does not acquire any title on the items. This refers to Nemo dat quad non habet in section 27 of the Sale of Goods Act.
To enlighten the fact, a preview to the case study of Lim Chui Lai v. Zeno. LTD is made. Ahmad is not the owner of the property; however, he had sold the materials. Ahmad was not the owner of the property because the respondent was merely placing the material for proceeding construction. Therefore, Ahmad was merely a bailey, but not the owner by the time when he sold it to the appellant. Since Ahmad is not the owner, nor he had the title, he had no authority to sell the property. Since this case is crystal clear, Ahmad, i

Lenz's law, physical law, discovered by the German scientist H. F. E. Lenz in 1834, that states that the electromotive force (emf) induced in a conductor moving perpendicular to a magnetic field tends to oppose that motion. When an electric motor is in operation, the armature is turning in a magnetic field, and an emf is thus induced in it. Lenz's law requires that this emf, called back emf or counter emf, oppose the motion of the armature and also the original emf, causing the motor to operate. As a result, the speed of the motor changes in such a way that the energy supplied by the original voltage source less the energy required to overcome the back emf is always exactly equal to the sum of the energy used to drive the mechanism to which the motor is attached and the energy lost as heat within the motor. Lenz's law may thus be seen as a consequence of the law of conservation of energy (see conservation laws. in physics).

#Lawyers levy? Michael Gove threatens to make rich law firms pay for legal aid
Michael Gove has provoked a row with some of London’s leading lawyers, after he demanded that they contributed “much more” to ensure justice was available to all.
Gove, the new justice secretary, said those who made the most financially from the legal system would be required to provide more free expertise.
But his proposal to improve a “two-nation” justice system prompted complaints about the impact of legal aid cuts imposed by his predecessor, Chris Grayling.
In his first significant speech since taking up the post, Gove told the business thinktank the Legatum Institute that “those who have benefited financially from our legal culture need to invest in its roots” and argued that “more could – and should – be done by the most successful in the legal profession to help protect access to justice for all”.
The minister did not spell out how such contributions would be extrac

Yeah, but how much do those FL law schools cost? I think money is a big reason someone might want to go to an online school. At $7,920.00 per year, it s affordable. Not to mention the fact that one can do it while working or while abroad.
Ok, I did some research on this. I hope it clears up the accreditation question.
Taft Law School is accredited through the Accrediting Commission of the Distance Education and Training Council. This is the national accrediting body that accredits distance learning schools, allowing them to legally bestow degrees to their students. This accreditation body is 100% legitimate and recognized by the U.S. government. If you go to FAFSA.org, and type in Taft you will see Taft University System (of which Taft Law School is a part) show up. This is evidence that it is a legitimate, accredited school. It also means you are eligible for Federal Student Loans to take courses with t

Statutes may originate with national, state legislatures or local municipalities. Statutes of lower jurisdictions are subordinate to the law of higher.
The term codified law refers to statutes that have been organized ("codified") by subject matter; in this narrower sense, some but not all statutes are considered "codified." The entire body of codified statute is referred to as a "code," such as the United States Code, the Ohio Revised Code or the New Hampshire Revised Statutes Annotated. The substantive provisions of the Act could be codified (arranged by subject matter) in one or more titles of the United States Code while the "effective date" provisions—remaining uncodified—would be available by reference to the United States Statutes at Large. Another meaning of "codified law" is a statute that takes the common law in a certain area of the law and puts it in statute or code form.
Another example of statutes that are not typically codified is a "p

What is an Emanuel Law Outline?
An Emanuel Law Outline (ELO) is a summary of the law in a particular subject. All books in the series have been written or co-authored by Steve Emanuel himself. The outlines include references to major casebooks and cases, statutes, Restatements, and other bodies of law. Many of the titles, including Constitutional Law. Civil Procedure. and Criminal Procedure. are revised every year. Others are revised every couple of years to correspond to major changes in the law, to correspond to new casebook editions, and to add new cases.
The books are between 250 and 700 pages long depending on the subject area. All ELO series outlines except for Secured Transactions include a Capsule Summary, a 88- to 128-page summary of the main text ideal for just-before-the-exa

Broadly defined, health law includes the law of public health, health care generally, and medical care specifically. Preserving public health is a primary duty of the state. Health regulations and laws are therefore almost all administered at the state level. Many states delegate authority to subordinate govermental agencies such as boards of health. These boards are created by legislative acts.
Federal health law focuses on the activity of the Department of Health and Human Services (HHS). It administers a wide variety of agencies and programs, like providing financial assistance to needy individuals; conducting medical and scientific research; providing health care and advocacy services; and enforcing laws and regulations related to human services. An important part of the HHS are the Centers for Medicare and Medicaid Services. which oversee the Medicare and Medicaid Programs. Their goal is to ensure that elderly and needy individuals receive proper medical care.

Oregon law restricting gun permits is more restrictive than most other shall-issue states. In addition to the standard list of persons who are refused a permit in Oregon — including anyone who is a convicted felon, who is awaiting trial on felony charges, who has been declared mentally incompetent, who is a fugitive from justice or who has had an order of protection issued against him, the state also refuses permits to anyone who has been convicted of any misdemeanor within the past four years.

The first step is to recognize that not all online programs are the same. The prospective student should look for a respected and accredited school, and one that offers all of the appropriate classes for their specific area of interest. For example, if the student wants to work toward an accounting career, then the online MBA program should offer class selections that pertain to accounting.
Which courses are usually offered in an online MBA degree? A student should probably expect to take some financial and managerial accounting courses, management and leadership courses, operations, business ethics, statistics, and data analysis courses. The programs may vary a bit depending upon the school, so the student may want to preview the course listing before enrolling in a school.
Some students wonder how their experience with an online school will compare with the school experience of b

Common law is the system of deciding cases that originated in England and which was latter adopted in the U.S. Common law is based on precedent (legal principles developed in earlier case law) instead of statutory laws. It is the traditional law of an area or region created by judges when deciding individual disputes or cases. Common law changes over time.
The U.S. is a common law country. In all states except Louisiana, which is based on Napoleonic code, the common law of England was adopted as the general law of the state, or varied by statute. Today almost all common law has been enacted into statutes with modern variations by all the states. Broad areas of the law, such as property, contracts and torts are traditionally part of the common law. Because these areas of the law are mostly within the jurisdiction of the states, state courts are the main source of common law. The area of federal common law is primarily limited to federal issues that have not been addressed by

Laws regarding wiretapping which can include filming differ in critical details from state to state. Florida s rules aren t particularly prohibitive if you understand the finer nuances. Technically, you can film law enforcement officers, but how you do it can make all the difference between risking civil or criminal prosecution and standing by your rights.
Location isn t just a consideration when touting a prime piece of real estate. It s also pivotal to wiretapping and filming laws, including those in Florida. When police are performing their duties in a public location, you can film them. They or anyone else within camera range have no expectation of privacy if they re on the street or otherwise out in public. The Eleventh Circuit of the U.S. Court of Appeals, which covers Florida, has ruled that the First Amendment applies in these situations. You have a right to record public officials on public property and to disseminate or share what you film.

Whether you have been perusing the self-help or personal development section of the book store, been around people who are looking for personal success or whether you are part of or know of people in spiritual circles, The Secret or Law of Attraction is a big topic and has been for years. Some of us know a lot about it, some a little, for some of us it works and for some it doesn t, either way, this article will explore a bit about The Secret or Law of Attraction and will touch on some key factors we are often not told about it.
What Is It?
For simplicity sake, I m going to use the abbreviation LOA throughout the article when I m speaking about the Secret or The Law of Attraction. Oregon hunting regulations prohibit shooting from or across a public or private road or a railroad right-of-way. The only exceptions to this rule are for roads that authorities have closed to motor vehicle traffic, according to the Oregon Department of Fish and Wildlife.
Oregon hunting regulations prohibit casting "an artificial light" from your car or truck while you are in possession of a weapon. It is unlikely that this provision will be enforced if you are driving your car with an unloaded, cased rifle in the trunk, but you may have some explaining to do if you are stopped with a loaded rifle on the passenger seat. The regulations also prohibits shining an artificial light within 500 feet of a motor vehicle (this includes ATVs and snowmobiles) while in possession of a weapon.
Qualified disabled hunters (who must obtain a special permit) may hunt from a vehicle, except "when the vehicle is in motion or on any public road or highway." Landowners may also use artifi

Graduate law degrees have come under the spotlight recently, with some questioning their value in terms of boosting employment rates and salary prospects. There’s certainly been mounting recognition that Master of Law (LLM) won’t immediately guarantee a US$160,000 annual starting salary.
However, while figures relating to return on investment may have been over-exaggerated in the past, it’s still the case that a master’s or PhD-level degree in law is likely to open new doors – in terms of both career options and academic challenges.
“Postgraduate training is a sign that a lawyer has an advanced knowledge of one or more aspects of law and has successfully demonstrated this through an assessment process,” says laureate professor Cheryl Saunders, an associate dean at Melbourne Law School, Australia. “If the university that has conferred the degree is known to be rigorous, the degree will be more highly valued.”

Freedom of the press is a fundamental liberty guaranteed by the First Amendment of the Constitution. As such, courts and legislative bodies have been hesitant to impinge on that freedom. In fact, there are numerous state and federal statutes that seek to ensure the full extent of the guarantee of the First Amendment, such as the Freedom of Information Act and the Privacy Act .
Historically, media law has been divided into two areas: telecommunications and print sources (newspapers, periodicals, etc.). There are some federal regulations regarding both categories and there are state laws governing both areas as well. The scope of these laws is limited by the First Amendment. (see also: communication law )

The LLB degree comes from the Latin Legum Baccalaureus. It is generally considered the Bachelor of Laws, even though most colleges that offer the LLB require previous university education for admission.
What is an LLB? Law students study common law on their way to becoming an attorney in their country of record. The LLB is no longer offered in the United States, but it is offered internationally. The US equivalent is the Juris Doctor (JD), and many countries are transitioning from the LLB to the JD. However, it is important to check the structure of the LLB from the country where you are receiving your degree to make sure that it allows you to take the bar exam.
The LLB is a graduate program that prepares you for a career in law. You have many opportunities to network with students and professors in your program, as well as decide which area of the law interests you.
The LLB generally takes around three years to complete. The tuition is determined by the scho

#Lessons Learned the Hard Way: Cohabitation and the Law
There are many reasons cohabitating couples may cite for not getting married. Some may say that they do not need a "piece of paper" to prove their love and commitment to each other. Other couples choose to live together without getting married in order to avoid the legal entanglements that can arise should the relationship end. Couples basing their decision on the latter reason should bear in mind that although cohabitating relationships often dissolve fairly simply, that is not always the case.
Perhaps the most notorious example of the legal quagmire that can surround the end of a cohabitating partnership is the case of Lee and Michelle Triola Marvin. Lee Marvin, the famous actor, and his partner, Michelle, lived together for several years before deciding to call it quits. When they did, Michelle claimed that she was entitled to support and an equal division of the property acquired during the relationship, but the ac

Florida has laws governing the relationship between landlords and tenants. The laws are designed to be fair to both landlords and tenants and to designate what each is and is not allowed to do with regard to the rental property. Written leases are not mandatory in Florida, but where leases are drawn up between landlords and tenants, the terms of the lease must conform with Florida rental law. Most Florida rental law is encompassed in Chapter 83, Part II, of the Florida Legal Code.
Florida landlord-tenant law refers to rental property, used for residential purposes, as a dwelling unit. Chapter 83.43 (2) of the Florida Legal Code defines a dwelling unit as any structure, or part of a structure, rented out to one or more persons, where the structure is then used to maintain a household. Mobile homes are also included as dwelling units, and both unfurnished and furnished properties are included in the definition.
Chapter 83.46 of the Florida Legal Code states that rent m

While alcoholism is a recognized illness across the nation, it is no longer recognized by the Social Security Administration as a disability. Currently, if you file for Social Security Disability, and the office discovers your alcoholism, it might block your attempt to receive disability benefits, even for a qualifying disability.
The decision is based on whether you would still be disabled if all alcohol-related issues were removed from your life. For example, alcoholism has caused you to have constant hand shaking to a point you cannot function without getting some alcohol into your body. In addition, you have schizophrenia. The SSA office will look at what happens when you remove the alcoholism from your life. Yes, the shaking will go away, allowing you to function in a work setting, however, the schizophrenia will remain, which may be a qualifying disability depending on the scope and range that the problem has an impact on your ability to work. The European Parliament may approve or reject a legislative proposal, or propose amendments to it. The Council is not legally obliged to take account of Parliament's opinion but in line with the case-law of the Court of Justice, it must not take a decision without having received it.
In the beginning, the 1957 Treaty of Rome gave Parliament an advisory role in the legislative process; the Commission proposed and the Council adopted legislation.
The Single European Act (1986) and the Maastricht, Amsterdam, Nice and Lisbon Treaties successively extended Parliament's prerogatives. Car accidents, a slip and fall, defective products, premise liability injuries or medical malpractice can all cause personal injuries. If you have been injured from the negligence of another person you may be able to file a personal injury claim and receive compensation for your personal injuries.
Personal injury claims, such as personal injuries caused by car accidents, are often negotiated with the offender's insurance company, but if the settlement offer does not cover the cost of your personal injuries or your claim has been denied, a personal injury lawyer can help. Personal injury lawyers can also help negotiate a fair settlement offer, or if needed, take your personal injury claim to court.
Do you have a personal injury claim? Obviously, not all injuries are torts or personal injury claims. To win a personal injury claim you, the plaintiff, must prove the defendant owed you a duty of care, their actions breached their duty of care, this breach was the proximat

#Probing Probate - Dummies What You Should Know
Probate is a term that is used in several different ways. Probate can refer to the act of presenting a will to a court officer for filing such as, to "probate" a will. But in a more general sense, probate refers to the method by which your estate is administered and processed through the legal system after you die.
The probate process helps you transfer your estate in an orderly and supervised manner. Your estate must be dispersed in a certain manner (your debts and taxes paid before your beneficiaries receive their inheritance, for example). Think of the probate process as the "script" that guides the orderly transfer of your estate according to the rules. (For more info, see What’s a Probate Estate All About? )
Many people think that probate applies to you only if you have a will. Wrong! Your estate will be probated whether or not you have a will.

The ATL School and Firm Insiders Survey asks self-identified current students, alumni, and practicing lawyers to rate major aspects of life at their law school (academics, social life, clinical training, career services, financial aid advising) and/or law firm (compensation, hours, morale, culture, training). We then translate these ratings into letter grades, where the mean score for each particular ratings category is the equivalent of a “B.”

#Lemon Law Remedies
(Page 2 of 2 of Lemon Law for New Cars)
Although most state lemon laws apply to new car sales only, a few states have lemon laws that also cover used cars. You should check the definition of a "new car" in your state lemon law. (To find your state's lemon law, visit www.autopedia.com or www.lemonlawamerica.com .) Some laws, for example, will cover a car that was bought with a certain amount of mileage on the odometer. In others, the lemon law applies to used cars that were still covered by the original warranty at the time of purchase.
Getting a Refund or Replacement Car
If your car meets the lemon law requirements for your state, you have the right to obtain a refund or replacement car from the manufacturer. Although the process for getting this relief is different in each state, in all states you must first notify the manufacturer of the defect. If you're not offered a satisfactory settlement, most states require you to go to arbitr

The Benjamin N. Cardozo School of Law is located in New York City, the largest legal and financial center in the world. As a result of Cardozo's location, students are afforded many benefits by sheer proximity. Aside from improved employment prospects, Cardozo students can also take advantage of the vibrant city/night life offered by Manhattan. And while Cardozo is a fairly young law school, there has been a general upward trend in its ranking; in 2006, it was ranked 58 th by US News and currently, it is 52 nd (down three spots from the school's highest ranking of 49 th in ).
Cardozo Law does not have a 'campus' in the traditional sense; the law school is really just one building and a nearby dorm. Of course Cardozo students have the entire city at their disposal, though this can be a challenge, especially when it comes to finding a suitable and quiet place to study. The law school is conscious of this concern, however, and recently poured millions of dollars into renovation

No, and even today you don t have to graduate from law school to sit for the bar exam in New York, California, or many other states. A year or so of law school, plus 3 years working under the supervision of an attorney who is training you to sit for the bar is sufficient in many states.
However, today, very few people try to take the bar exam without completing law school, with good reason.
Most lawyers don t want to waste their valuable time training someone straight out of undergrad, even if the trainee will work for minimum wage.
That s why law schools exist. Training bachelor degree holders to prepare them for the practice of law is incredibly burdensome. Would-be trainees can t compensate lawyers for this burden, even if they are willing / able to work for free. Once the young lawyers have the training and become useful, they can leave for higher wages at another employer, so the lawyer who provides the training can t recover his investment.

It’s common practice among many physician groups to refer everything from blood tests to MRIs to entities from which they benefit financially. It wasn’t supposed to be that way: Congress in the 1990s passed the Stark Law, which prohibited doctors from “self-referring Medicare patients. But loopholes have kept the practice alive and well. Urologists at cancer-care giant 21 st Century Oncology Holdings Inc. for example, refer tests to the company s in-house lab, as a page-one article in The Wall Street Journal reports , taking advantage of the law s exceptions. The company says that its urologists refer tests to the in-house lab for valid medical reasons, not financial ones, and that such referrals are permitted by exceptions to the Stark law.
The Stark Law has exceptions. Under the “in-office ancillary services” exception, a doctor can refer a Medicare patient for a treatment or test to another doctor “who is a member of the same group practice” if the treatment or test is fu

Lemon Law
New cars and other new motor vehicles are covered by manufacturers' warranties. These warranties must follow the rules set by the federal Magnuson-Moss Warranty Act and the Uniform Commercial Code (UCC) (refer to the section on Warranties for more information). The manufacturer's warranty is provided at no extra cost to the buyer. Sometimes, despite the best efforts of a dealer's service department, a defect cannot be satisfactorily fixed. These unfixable vehicles are popularly referred to as lemons. New Hampshire's Lemon Law provides a method for the lemon owner to satisfactorily resolve the problem.
The Law
New Hampshire's Lemon Law (RSA 357-D) applies only to new vehicles purchased from New Hampshire dealerships. New Hampshire consumers who find themselves with a defective new vehicle that the dealer has been unable to repair may turn to the Motor Vehicle Arbitration Board (MVAB). The MVAB will decide whether the motor vehicle is so

#Lemon laws protect you: Car News
You used to have Buckley's chance of returning a dreaded lemon to the car dealer for a replacement or a refund.
As for being compensated for the inconvenience, aggravation, lost income and costs racked up while taking the car from hell to the dealer for a further non-fix under warranty, well, make that virtually no chance either.
Many Australian consumers have tried but only a few very determined people have succeeded, usually after long, expensive battles against squads of car company lawyers in various courts.
The new Australian Consumer Law (ACL), developed by the states and the Australian Competition and Consumer Commission, came into force on January 1 this year. It's not as tough as US lemon laws, but it gives you much more protection than the maze of state and federal consumer regulations you previously had to navigate to make a case that your car resembled a particularly bitter variety of citrus fruit.
