Florida has laws governing the relationship between landlords and tenants. Florida landlord-tenant law refers to rental property, used for residential purposes, as a dwelling unit. Chapter 83.43 (2) of the Florida Legal Code defines a dwelling unit as any structure, or part of a structure, rented out to one or more persons, where the structure is then used to maintain a household. Mobile homes are also included as dwelling units, and both unfurnished and furnished properties are included in the definition.

Chapter 83.46 of the Florida Legal Code states that rent must be payable, without notice being given, and without the landlord needing to request payment, on the first day of each rental period. This chapter also determines that where no tenancy period has been formally agreed, the frequency of rental payment determines the period of the tenancy. For example, if rent is paid monthly, then the period of the tenancy is considered to be monthly, and can be terminated by either landlord or tenant with a month's notice.
