Workers' compensation refers to a system of laws outlining specific benefits to which injured employees are entitled. and the procedures for obtaining such benefits. Every state has its own workers' compensation laws, which are contained in statutes, and vary somewhat from state to state. In addition, there are special workers' compensation laws for employees of the federal government, and still others for workers in specific types of industries such as railroad employees.
Under the law in most states, every business must have some form of workers' compensation insurance to cover injured employees. Filing a workers' compensation claim is similar to filing an insurance claim; it isn't a lawsuit against an employer, but rather a request for benefits.
The Purpose and Effect of Workers' Compensation Laws
Workers' compensation laws are designed to ensure that employees who are injured on the job receive fixed monetary awards, without having to litigate the

#California s New Three-Strikes Law: Benefits, Costs, and Alternatives
Benefits, Costs, and Alternatives
Research Brief
Public outrage over crime has found political expression in the proposal and enactment of various laws mandating lengthy sentences for repeat felons. Put forward under the slogan three strikes and you re out, these laws generally prescribe that felons found guilty of a third serious crime be locked up for 25 years to life. The California law, which went into effect in March 1994, may be the most sweeping of these. Although the first two strikes accrue for serious felonies, the crime that triggers the life sentence can be any felony. Furthermore, the law doubles sentences for a second strike, requires that these extended sentences be served in prison (rather than in jail or on probation), and limits good time earned during prison to 20 percent of the sentence given (rather than 50 percent, as under the previous law).
In November, Californi

A growing number of LLM programs can be studied by distance learning and online learning, where instructors and students communicate online rather than face to face. A wide variety of educational media and modes of communication and teaching are used. One of the hallmarks of many distance online learning llm programs is that, via flexible, modular class offerings, students can progress through them at their own pace. Distance online learning programs have a longer duration than their full time equivalents. For LLMs, these typically usually last two to five years instead of one year full time. Some distance learning courses require a combination of online and physical communication, where students attend residential sessions.
Why consider an LLM distance/online learning program?
In this increasingly competitive legal world, maintaining a good skills base has never been more important as a way of getting on. A distance online learning program can help you to

Bishop James Roosevelt Bayley founded Seton Hall University in 1856. He named the University after his aunt, Sister Elizabeth Ann Seton, the first American-born saint. Today, a total of more than 10,000 students attend Seton Hall's eight schools and colleges on the University's South Orange campus and the School of Law in Newark.
As early as 1937, a law school had been planned as part of Seton Hall University. But the demands of both the war years and the post-war influx of returning GIs delayed establishment of the law school until 1950. At that time, the New Jersey Supreme Court had adopted rules requiring candidates for bar admission to hold law degrees from law schools accredited by the American Bar Association (ABA). As a result, John Marshall Law School in Jersey City, New Jersey was forced to close. In June 1950, the administration of John Marshall gave its library and many of its assets to Seton Hall. Freedom Outpost's Constitutional scholar Publius Huldah recently explained why Federal gun laws are unlawful. She noted that the first gun control measures put in place in the United States did not take place until 1927, when Congress banned the mailing of certain weapons. Huldah goes through the history of the Federal government's unlawful actions to regulate firearms in America and she points out that when it started, the Progressives had already begun a takeover. I'll also note the Federal Reserve had been established in 1913 as well.
In 1938 Congress legislated that gun dealers had to obtain a Federal Firearms Licenses and maintain names and addresses of those they sold their firearms to.

The principle that individuals are and can be held criminally accountable for violations of the laws of war dates back to many years. However, it was only after World War II and the Nuremberg and Tokyo trials, set up to judge those German and Japanese military leaders accused of serious crimes during the war, that the idea of individual criminal responsibility for serious breaches of international law gained ground.
The current system of international criminal law works through international ad hoc tribunals, internationalised or mixed tribunals, the International Criminal Court as well as national courts (military tribunals and ordinary courts). One of the legal consequences of framing an act as an international crime is that it may give rise to what is called universal jurisdiction, which allows any state to try alleged perpetrators, even in the absence of any link between the accused and the state exercising jurisdiction.

#What is the Rule of Law?
What is the Rule of Law?
Derived from internationally accepted standards, the World Justice Project s definition of the rule of law is a system in which the following four universal principles are upheld:
The government and its officials and agents as well as individuals and private entities are accountable under the law. The laws are clear, publicized, stable, and just; are applied evenly; and protect fundamental rights, including the security of persons and property. The process by which the laws are enacted, administered, and enforced is accessible, fair, and efficient. Justice is delivered timely by competent, ethical, and independent representatives and neutrals who are of sufficient number, have adequate resources, and reflect the makeup of the communities they serve.
These four universal principles are further developed in the following nine factors of the WJP Rule of Law Index. which measures how the rule of law

#Chattanooga, Terrorism, and the Dangers of Lax Gun Laws - The New Yorker
By John Cassidy
Mohammod Youssuf Abdulazeez opened fire at a Chattanooga military-recruitment office before moving to a Naval Reserve center, where he killed four U.S. Marines.
Another shooting spree ; another debate about American gun laws.
According to news reports. Abdulazeez, a twenty-four-year-old Kuwaiti-born U.S. citizen, was armed with at least three guns, including an AK-47 assault rifle. How he got hold of these weapons wasn’t what concerned Trump, however. “Get rid of gun free zones,” he tweeted on Friday morning. “The four great marines who were just shot never had a chance. They were highly trained but helpless without guns.”
Trump was evidently referring to a Pentagon regulation, dating back to 1993, that prohibits some members of the military from carrying firearms while on base. His comments echoed those of gun enthusiasts, who highlighted, on social media,

Format: Paperback
I just finished my Contracts final, but I will not blame my grade on this book.
This does what it is supposed to. It supplements the material that the Prof. presents in class. If you are not sure what the modern rule is, this is where you go. If you are not sure if there is an exception, this is where you go. If you are not sure what the basic functions of the rule is, this is where you check. If you are not sure what Restatement or UCC section applies, this is where you check.
This book is great for supplementing your notes and filling in the gray areas. For that, it is invaluable, but like all commercial outlines, it cannot replace your notes.
As the previous reviewer says, the flow charts are excellent. This certainly facilitates understanding, I would just recommend not putting all your eggs in this basket.

Between 753 b.c. and a.d. 1453, the legal principles, procedures, and institutions of Roman law dominated Western, and parts of Eastern, civilization. The legal systems of western Europe, with the exception of Great Britain, are based on Roman law and are called civil-law systems. Even the common-law tradition found in the English-speaking world has been influenced by it. In the United States, the Common Law has been paramount, but Roman law has influenced the law of the state of Louisiana, a former French territory that adopted a French civil-law code.
Roman law began as an attempt to codify a set of legal principles for all citizens. In 450 b.c. the Twelve Tables were erected in the Roman Forum. Set forth in tablets of wood or bronze, the law was put on public display, where it could be invoked by persons seeking remedies for their problems. Though the texts of the tablets have not survived, historians believe they dealt with legal procedures, torts. and Family Law issues.

Intellectual property (IP) is an intangible creation of the human mind, usually expressed or translated into a tangible form, that is assigned certain rights of property. Examples of intellectual property include an author's copyright on a book or article, a distinctive logo design representing a soft drink company and its products, unique design elements of a web site, or a patent on a particular process to, for example, manufacture chewing gum. Intellectual property law covers the protection of copyrights, patents, trademarks, and trade secrets, as well as other legal areas, such as unfair competition. In effect, intellectual property laws give the creator of a new and unique product or idea a temporary monopoly on its use. The value of intellectual property to an individual or company is not based on physical properties, such as size and structure. Instead, intellectual property is valuable because it represents ownership and an exclusive right to use, manufacture, reproduce, or

You can barely go a week without hearing ominous news about law schools and the legal profession. Applications are down. job prospects are awful. schools may close. less qualified people are sitting for the LSAT. The latest in the string of bad news is a drop in people taking the LSAT. Law schools slump is the new dog bites man.
Some, like President Obama. suggest that one of the ways out of this slump is to shorten law school to two years. As a former law student who left after one year, I think allowing for more flexibility in the length of law school is a great idea. Too bad it will never happen.
(There are a handful of programs that offer two-year JDs; problem is, they still require the same coursework and generally the same tuition. In other words, it s three years jammed into two without any discount.)
In my experience, law school is too long and too impractical. Many law schools are masquerading as liberal-arts colleges when they should be preparing s

All transactions in Indian real estate sector are governed by various laws enacted by the Central Government of India and respective State governments. One such law is the RENTAL LAWS. These laws govern the rental of commercial and residential property and are necessary to enforce individual civil rights of both landlord and tenant and prevention of any kind of deceit.
The real estate scene in India is flawed by land market distortions. The most glaring ones include inflexible zoning, rent and tenancy laws. Zoning laws, rent controls and protected tenancies have been detrimental to the healthy rental trends in India. They have put a freeze to land in city centers that could be otherwise made available for new retail outlets and flats.
These laws also gloss over operational inefficiencies and scuttle competition. Tenants residing could not be evicted for along time and would not surrender their cheap tenancies on their own volition. The renovation of

#Child support
Child support is the financial support paid by one parent to the other, to help with the costs of a child aged under 18.
The law says that both parents have a duty to support their children financially, whether they are biological (birth) or adoptive parents, same-sex or otherwise.
Most children in Australia are covered by the Child Support Scheme, managed by the Department of Human Services (Child Support), a Commonwealth Government agency. Its role is to support separated parents to transfer payments for the benefit of their children.
Parents can come to their own agreement about how much child support should be paid. If parents don t agree about child support, the Department of Human Services (Child Support) will assess how much child support should be paid.
If your child is 18 or over and they are studying or have a disability they may be able to get adult child maintenance .

#Child marriage - the law - Girls Not Brides
Why is it important for countries to have a minimum legal age of marriage?
Laws that set a minimum age of marriage are an important way to safeguard boys and girls from being married before they are ready.
It is important that children are recognised in the law as being children and that they are accorded the full protection of the law.
Governments need to have clear and consistent legislation that establishes 18 as the minimum age of marriage. Adequate safeguards must be in place to ensure that parental consent or other exceptions are not used to force girls into marriage.
The existence of laws that set a minimum age for marriage is an important tool that helps those working to dissuade families and communities from marrying off their daughters as children.
Do all countries have a minimum age of marriage?
Most countries around the world have laws that set a minimum age of marriage, usu

#Child Support
child support: an overview
Child support refers to the sum that the noncustodial parent must pay to the custodian. This sum serves as a parental contribution for the child's basic living expenses, such as food, clothing, shelter, health care, and education. When a court orders a parent to pay child support, the parent must pay directly to the child's custodian rather than directly to the child. States generally do not impose an obligation to pay support for a child after that child has reached the age of 18.
An individual, however, only has a legal responsibility to support one's own biological children. Thus, a court cannot order an individual to pay child support for a stepchild, subject to the caveat that the individual did not formally adopt the stepchild. While the vast majority of states adhere to this rule, a few state statutes differ with regard to stepchild support. To determine the law in a particular jurisdiction, see state laws .

SCIENTIFIC LAWS and THEORIES
I've had a student ask me to clarify the difference between a scientific law and a theory . This person asked, in part:
. Is a law, in essence, something which has no detractors -- a unifying 'concept' for which scientists (at the present time) are in accordance with? Is a law a single idea by which all scientists, regardless of discipline, conform?
Can a theory be looked at as a 'transitory' law (i.e. a law in waiting)? In contrast to a law, is it correct to say that there can be several scientific theories about a particular phenomena whereas a law represents a single unified agreement among all scientists .
Such questions are very common. The difference between a law and a theory often confuses people. This happens, in part, because even among scientists there can be different usage of these terms. Of course, to the general public, these terms have very different meanings and connotations. I sugg

Maritime Law or Admiralty Law governs navigation and shipping on most bodies of water. Maritime Law specifically protects the rights of seamen, longshoremen, oil rig workers, cruise ship employees and other people who make their living on the seas.

As well as maritime laws and acts such as the Jones Act. the Longshore and Harbor Workers' Compensation Act and the Death on the High Seas Act, maritime workers are also protected by the concept of "Maintenance and Cure". In the United States. court action based on workplace bullying is problematic at best. A plaintiff must prove a) that the bullying actually occurred, b) that the bully's actions fall into at least one of the four categories mentioned above and c) that the plaintiff's subsequent problems stemmed from the bully's actions. As of this writing, only five states have legislation against workplace bullying pending, and no state has ever passed laws against it. However, some states do have laws against creating or maintaining a "hostile work environment". Many states also have general laws against harassment, but charges of harassment are notoriously hard to prove. [How to reference and link to summary or text ]

What is Constitutional Law?
Constitutional law deals with the fundamental principles by which the government exercises its authority. In some instances, these principles grant specific powers to the government, such as the power to tax and spend for the welfare of the population. Other times, constitutional principles act to place limits on what the government can do, such as prohibiting the arrest of an individual without sufficient cause. In most nations, including the United States, constitutional law is based on the text of a document ratified at the time the nation came into being.
The U.S. Constitution itself became the law of the land well over 200 years ago, and the tenets set forth in the document remain in full force today. The way in which the Constitution is applied, though, has always been subject to court interpretation. As circumstances and public opinion evolve through the years, so too do the interpretations offered by the courts. From time to

#China Law - Policy
Ready for National Security!
Within a day of its publication of the second Draft Foreign NGO Law on May 5, the Chinese government also published for comment a Draft National Security Law. Today, that document became law. Although criticized for its vagueness and breadth, the passed law is still just as broad if not more so. The new law also covers protection of seabeds and adds the word extremism to the provision on terrorism (Article 28), a provision that immediately follows the one that protects normal religious activity and calls for the opposition to foreign influences and interference in domestic religious affairs (Article 27).
The law itself comes off more as abstract principles. But make no mistake, the Chinese government and the Public Security Bureau which has oversight of the Law, means business. The fact that they elevated this abstract document to the level of a law is a telling sign and foreign governments should be looki

Looking for the Best Pre-Law Undergraduate Schools? The best choice for a college or university to go to if you are considering law school is easy! Go to any good College or University where you can get good grades. As for a major, do what interests you. Law schools, unlike medical schools, do not have rigid pre-set requirements.
First, a word on what this article is talking about: we are not discussing the best places to do pre-law. Taking pre-law is generally a mistake if you want to go to law school. If your chosen school, has a major that is actually called pre-law, do not take it thinking that will help you get into law school.
It may in fact hurt you: law school admissions board do not highly respect pre-law as major, possibly because it indicates you have no interest in expanding yourself as a person beyond the legal field, and also because these courses really do nothing to prepare you for law school that a simple English, hi

Hundreds of UK broadband users accused of sharing copyrighted content are preparing for the prospect of coordinated legal action against ACS:Law, the controversial solicitors' firm at the centre of a huge row over file sharing and leaked data.
Those contemplating the action claim to have been wrongly identified as breaking the law, insisting that the methodology behind identifying illegal file sharers is deeply flawed and the pursuit of alleged file sharers classifies as harassment. ACS:Law and other lawyers chasing the accused insist the methodology is sound. Not so, rings the cry from just about everyone else.
A recap. Private information about thousands of broadband users held by ACS:Law spilt out onto the web last week. The data, obtained through court orders to internet service providers, was leaked online in the aftermath of a denial of service attack on the website of ACS:Law. An investigation by the Information Commissioner will establish whether or not the d

A state or local law that prohibits commercial activities on Sunday.
Blue laws have been part of U.S. LEGAL HISTORY since the colonial period. These laws, which today are usually referred to as Sunday closing laws, prohibit certain types of commercial activity on Sundays. Originally these laws were directed at personal activities regarded as moral offenses, such as gambling or the consumption of alcohol. In the nineteenth century, however, state and local governments passed laws that forbade businesses from operating on Sunday. Although these laws were clearly based on Christian beliefs, the U.S. Supreme Court has ruled that they do not violate the First Amendment's Establishment Clause. Many blue laws have been repealed since the 1960s, but some laws that ban the sale of alcohol on Sunday remain in force.
In 1781, the Reverend Samuel Peters published A General History of Connecticut. in which he used the term <
