#Harassment laws
"Harassment" refers to a broad number of behaviors that are subject to both criminal punishment and civil liability. On the criminal side, states have a wide variety of criminal laws forbidding harassment in many forms, including general harassment crimes as well as specific forms of harassment, such as stalking and cyberstalking.
Criminal Harassment versus Civil Harassment
Criminal harassment should not be confused with how "harassment" is often used in contexts such as workplace discrimination lawsuits. Federal and state laws ban discrimination against certain types of people in certain situations, such as at work or in housing decisions. In these non-criminal contexts, the victim can sue the harasser in a private civil lawsuit, alleging that the harassment constitutes discrimination.
On the other hand, criminal harassment is usually confined to state law. States vary in how they define criminal harassment. Generally, criminal h

#HIPAA Preemption Charts
The Health Insurance Portability and Accountability Act of 1996 ("HIPAA") gave the federal Department of Health and Human Services ("HHS") the authority to promulgate regulations containing standards with respect to the privacy of individually identifiable health information. HIPAA provided that such standards shall not supersede State law that imposes more stringent standards (P.L. 104-191, 264(c)). HHS promulgated the federal standards, and they are now in Parts 160 and 164 of Title 45 of the Code of Federal Regulations (the "Privacy Rule").
Under the Supremacy Clause of the U.S. Constitution, federal law preempts State law when preemption is the clear and manifest purpose of Congress. In instances where the purpose of Congress is not clear, only the judicial branch of government can determine whether a federal law preempts a State law under the Supremacy Clause.
In enacting HIPAA, Congress clearly did not supersede State laws that impose

#How is your driving? Half of drivers admit breaking traffic laws
A new report has highlighted widespread disregard for traffic laws among UK drivers
Nearly 50 per cent of drivers admit breaking traffic laws, with around half of them doing so deliberately, according to a survey.
As many as 49 per cent said they flouted road regulations, the poll from road safety charity Brake and insurance company Direct Line showed.
Of those breaking the rules, half said they did so through inattention while the other half did so deliberately because they thought they could get away with it or did not agree with the laws.
Driverless cars heading onto British roads in 2015
As many as 60 per cent of women surveyed, but only 42 per cent of men, said they never broke road regulations, with men twice as likely as women to flout the laws because they thought they could get away with it.
The poll, of 1,000 drivers, also revealed:

#GW Law School Accused of - Predatory - Poaching - Law Blog
george washington law school
With law school applicants in shorter supply. it s a tense time for law schools. And in the heart of the nation s capital, the competitive pressures have spilled into the open.
A top dean at American University Washington College of Law is venting frustration over the recent exodus of AU students to George Washington University Law School, accusing his nearby rival of engaging in poaching.
Speaking only for myself and not in my official law school capacity, I view this practice as downright predatory, Anthony E. Varona. AU s associate dean for academic affairs, wrote in a recent Facebook post, which was republished at TaxProf Blog on Thursday.
GW law officials deny they re raiding AU s student body, but what s not in dispute is that an unusually large number of AU students are deciding that they d rather go to GW. In the 2013-14 academic year, 54 students left

#He - s Attorney James Sokolove
And those cheesy ads of his? They ve done more than make him a pariah and a punch line. They ve also created an under-the-radar empire that s about to reinvent the business of ambulance chasing yet again.
Photograph by David Yellen
If the average American were to classify members of the legal profession the way biologists have constructed a taxonomy of the animal kingdom, the proud white-shoe counsel would be an eagle; the slick entertainment lawyer, a shark. The personal-injury attorney—way at the bottom of the chart—would be some sort of primordial ooze. He is the much-derided ambulance chaser whose frivolous lawsuits drive doctors from their calling, the slip-and-fall trial lawyer to blame for out-of-control insurance premiums. He is the reason takeout coffee cups come with warning labels.
And among personal-injury lawyers, nobody ranks higher than Newton s Jim Sokolove. Or maybe it s lower. Either way, his is a

Mitchell Reich, a second year at Harvard Law School, was elected the first openly gay president of the Harvard Law Review. Reich, a Yale College and Dalton School graduate and Manhattan native, is the 125th president of the esteemed publication.
BREAKING GROUND
Reich says that being gay is a non-issue for the Harvard Law Review community, but that he recognizes the significance of the election. He says that while he was in high school, before coming out of the closet, he found it hard to picture achieving his dreams and be gay at the same time.
“If I had seen someone who was the president of the Harvard Law Review and [also] openly gay, that would have been helpful to me,” Reich says.

#High court to rule on MPs claim that data retention act damages privacy
High court judges will give their decision on Friday on an accusation that the government has imposed laws which allow the police and security services to “spy on citizens” without proper safeguards.
Two MPs and other campaigners are seeking a ruling that the Data Retention and Investigatory Powers Act (Dripa) is “incompatible with EU law”.
Conservative former shadow home secretary David Davis and Labour backbencher Tom Watson say they are concerned to protect the confidentiality of their contacts with constituents and other members of the public – including whistleblowers – who might approach them with sensitive information.
Their case is backed by the human rights pressure group Liberty.
At the hearing, Dinah Rose QC, for the MPs, said the legislation was rushed through in July last year “with enormous speed and hardly any scrutiny”.

#History of Scout Law, Original Scout Law Origin Explanations Commentary
12. Be joyful. Seek the joy of being alive-for every reasonable gladness that you can get or give, is treasure that can never be destroyed, and, like the springtime gladness, doubles, every time with others it is shared.
8. A SCOUT SMILES AND WHISTLES under all circumstances. When he gets an order he should obey it cheerily and readily, not in a slow, hang-dog sort of way. Scouts never grouse at hardships, nor whine at each other, nor swear when put out. When you just miss a train, or some one treads on your favorite corn--not that a scout should have such things as corns--or under any annoying circumstances, you should force yourself to smile at once and then whistle a tune, and you will be all right.
A scout goes about with a smile on and whistling. It cheers him and cheers other people, especially in times of danger, for he keeps it up then all the same.

#Hillary Clinton calls for bankruptcy law change so Puerto Rico can tackle debt
Hillary Clinton has joined calls for changes in US bankruptcy laws that would enable Puerto Rico’s public entities to restructure some $72bn in debt.
In Washington, two Democratic senators hope to move forward within weeks with legislation in Congress that would allow the US territory to restructure debts in bankruptcy court, instead of risking chaos.
Governor Alejandro Garc a Padilla of Puerto Rico dropped a bombshell on debt holders a week ago by saying he wanted to restructure debt and postpone bond payments. He urged changes to US bankruptcy laws that currently exclude Puerto Rico .
Like US states, Puerto Rico cannot file for bankruptcy protection. But Puerto Rico’s public entities do not have the ability of US municipalities to enlist Chapter 9 of the US bankruptcy code to restructure their debt.
“As a first step, Congress should provide Puerto Rico the same authorit

#His court performances rewrote law. But it was William Garrow s love life that caused the biggest rumpus in Georgian society
By Amanda Cable for the Daily Mail 18:02 25 Nov 2010, updated 22:30 26 Nov 2010
His barnstorming performances in court rewrote the law books. But it was 18th-century barrister William Garrow's shocking love life that caused the biggest rumpus in Georgian society
It was 1791, and chaos reigned in the Old Bailey courtroom. Men and women spat their abuse from the public gallery, the faces of bewigged legal officials remained impassive and in the dock, wringing his hands in abject misery, stood 23-year-old Rhynwick Williams.
The search for the notorious London Monster - who had slashed and stabbed women in vicious, unprovoked attacks, thus striking fear throughout the capital - was apparently over.
Corrupt and inept police, under intense pressure to find a man, had done just that.
Shocking love life: Andrew Buc

#History of Illegal Immigrants and Current Immigration Laws in the U. S.
With the exception of Native Americans, all persons living in the United States are descended from immigrants or slaves who came to the country during the last 400 years. By the late seventeenth century, foreign-born persons constituted seventy-five percent of the American population.
Initially, the U.S. government encouraged open immigration in the interest of settling as much territory as possible. Following the Civil War, however, states began to pass their own immigration statutes. The United States Supreme Court determined that immigration came under federal jurisdiction in 1875, and Congress established the Immigration Service in 1891.
Most early immigration laws were instituted in order to control the composition of the U.S. population. In 1790, Congress passed the Naturalization Act, which effectively limited immigration to persons of European and Caucasian descent. In 1882, Co

#How Do Lemon Laws Work?
I bought a new car but it keeps having problems. I'm tired of going back and forth to the dealership only to have something else go wrong. Someone suggested that this car might fall under the Lemon Law. How does that work?
I am an attorney specializing in Lemon Law, the colloquial term for automobile warranty law. This has been the focus of my practice for 23 years and I have handled thousands of actions against manufacturers on behalf of consumers who bought bad cars, along with various suits over defective RVs, boats, personal watercraft, and even things which were not transportation, like sewing machines and furniture. If a consumer product comes with a warranty that is not being honored, I'm the guy you call. At least in Michigan. Sometimes I handle other car cases as well.
A recent Jalopnik post let readers gripe about warranty repairs. In my real job, I am… Read more Read more
