#Estates and Trusts
estates and trusts: an overview
During the early 1500's in England landowners found it advantageous to convey the legal title of their land to third parties while retaining the benefits of ownership. Because they were not the real "owners" of the land, and wealth was primarily measured by the amount of land owned, they were immune from creditors and may have absolved themselves of some feudal obligations. While feudal concerns no longer exist and wealth is held in many forms other than land (i.e. stocks, bonds, bank accounts), the idea of placing property in third party hands for the benefit of another has survived and prospered. This is the idea of a trust.
Generally, a trust is a right in property (real or personal) which is held in a fiduciary relationship by one party for the benefit of another. The trustee is the one who holds title to the trust property, and the beneficiary is the person who receives the benefits of the trust. To understand

#Family Law Reimagined - Jill Elaine Hasday
Jill Elaine Hasday
One of the law s most important and far-reaching roles is to govern family life and family members. Family law decides who counts as kin, how family relationships are created and dissolved, and what legal rights and responsibilities come with marriage, parenthood, sibling ties, and other family bonds. Yet despite its significance, the field remains remarkably understudied and poorly understood both within and outside the legal community.
Family Law Reimagined is the first book to evaluate the canonical narratives, examples, and ideas that legal decisionmakers repeatedly invoke to explain family law and its governing principles. These stories contend that family law is exclusively local, that it repudiates market principles, that it has eradicated the imprint of common law doctrines which subordinated married women, that it is dominated by contract rules permitting individuals to structure their

#Part 5: Create an Outline for Each Class
Why Outline When You Can Buy One?
Given the time pressures of law school, many students are left wondering why they should outline at all. Commercial outlines that are written by experts are readily available at cheap prices. Moreover, creating your own outline is time-consuming and difficult.
Statistics show that students who create their own outlines invariably do better on exams than those who rely on commercial outlines. 1 It's the process of creating the outline and bringing the material into a cohesive and understandable format that makes the difference. Merely possessing an outline written by the professor or an outstanding student does not guarantee success.
Outlines are simply condensed summaries of the rules of law. The outline serves three primary functions.
First, it helps tremendously in getting you to think like a lawyer . You synthesize your class notes, briefs, reading and seco

#Fact Sheet: Establishment of Interagency Working Group for the Consistent Enforcement of Federal Labor, Employment and Immigration Laws - U. S. Department of Labor
Federal agencies responsible for worker protections seek to protect all workers from exploitation and workers rights violations, regardless of immigration status. Many workers, however, are deterred or prevented from asserting workplace rights and protections. In some cases, employers may exploit immigration status to deter employees from asserting their rights. In other cases, the protections available to workers are unclear. To promote effective enforcement of federal labor, employment, and immigration laws, the Administration is announcing the creation of an interagency working group to identify policies and procedures that promote the consistent enforcement of those laws and protect all workers in the U.S.
This working group will be comprised of federal immigration enforcement agencies and federal agencies r

#Extras - Buying Used and New Law Books at a Discounted Rate
Extras - Buying Used and New Law Books at a Discounted Rate
By Cynthia C. Berry. Published on December 3, 2001
Cynthia C. Berry is a research librarian in the New York office for Greenberg Traurig LLP.
The used book market isn't what it used to be. The book may not be dead but it's at least feeling a little puckish. Offers of free used books abound on law library mailing lists such as law-lib. Regional reporters that once sold for thousands of dollars are difficult to GIVE away.
But let's face it there are times that you want a book not a CD not an Internet subscription a real book. Law students many of whom are on a shoe string budget need books for their classes. Legal professionals may want to self-educate on a new topic quickly. And law librarians may have a patron with a need for a book that isn't even in print anymore!
If you also want a bargain you're in luck. There are a n

#Fashion Law Degree Fordham University
Photo: Slaven Vlasic/Getty Images.
When Susan Scafidi was a junior professor of intellectual property, she was told that fashion was too “girly” and “frivolous” to be taken seriously. When she questioned why fashion designers had little protection when it came to their work and designs, it seemed she was the only one asking. But as of this morning, Scafidi, along with Diane von Furstenberg, the CFDA, and Fordham University, has taken a major step to support the work of people in the fashion industry. They've introduced the world's first fashion law degree program.
As a part of Fordham Law School and the Fashion Law Institute. the program is intended for law students as well as professionals within the industry. Not only will the master's program teach lawyers how to understand and practice within the fashion industry — "the second-largest industry in the city," noted von Furstenberg during the introductory event this m
