What is meant by Tort?

The law of tort is defined as a body of rights, obligations and remedies that is applied by courts in civil proceedings to provide relief for individuals or victims (claimant or plaintiff) who have suffered harm from the wrongful acts of others (defendant).

Tort should immediately be distinguished from two other kinds of law, notably criminal law and contract law.

Criminal Law

Criminal Law is concerned with crimes committed against the state which are punishable by either a fine or imprisonment. Tort is between individuals with the primary remedy being that of damages paid from one individual to another for the damage that they have suffered.

Criminal Law is presided over in the criminal courts whereas tort law is presided over in the civil courts.

The government led by Narendra Modi is trying to pass amendments to a 2013 land-acquisition bill through parliament’s upper house, where it lacks a majority. Under the existing bill, any forced sale of land requires the consent of at least 70% of affected owners and must also pass a social-impact test. Compensation is set at double the market value for urban plots and quadruple for rural land. The demands of the bill are a leading reason why investment projects are at a standstill. In December Mr Modi’s government issued a temporary executive order that did away with the consent clause for certain projects. The amended bill would make that change permanent. #The Differences between a Criminal Case and a Civil Case

The American legal system is comprised of two very different types of cases, civil and criminal. Crimes are generally offenses against the state, and are accordingly prosecuted by the state. Civil cases on the other hand, are typically disputes between individuals regarding the legal duties and responsibilities they owe one another.

Here are some of the key differences between a criminal case and a civil case:

  1. Crimes are considered offenses against the state, or society as a whole. That means that even though one person might murder another person, murder itself is considered an offense to everyone in society. Accordingly, crimes against the state are prosecuted by the state, and the prosecutor (not the victim) files the case in court as a representative of the state. The law of supply is a fundamental principle of economic theory. It states that an increase in price will result in an increase in the quantity supplied, all else held constant.

Supply has a positive correlation with price. As the market price of a good increases, suppliers of the good will typically seek to increase the quantity supplied to the market.

The rationale for the positive correlation between price and quantity supplied is based on the potential increase in profitability that occurs with an increase in price.
