#Criminal Law

Arizona Judicial Branch

Criminal cases involve the commission of acts that are prohibited by law and are punishable by probation, fines, imprisonment even death. The attorney representing the state, county or municipal government that formally accuses an individual of committing a crime is the prosecutor. The party charged with the crime is the defendant.

A person is arrested by a law enforcement officer who either observes a crime or has a warrant for arrest when probable cause exists that a person committed a crime. When a person is arrested, that person must be brought before a judge for an initial appearance within 24 hours of being arrested or must be released.

2. Initial Appearance

At the initial appearance, the judge determines the defendant s name and address, informs the defendant of the charges and of the right to remain silent and to have an attorney. The j ... Read more »

Gov. Andrew Cuomo (Photo: Slaven Vlasic/Getty Images).

Gov. Andrew Cuomo, Assembly Speaker Carl Heastie and State Senate Majority Leader John Flanagan today debuted the framework of a deal that will extend the city s rent regulations and the controversial 421a tax abatement for six months—with some tweaks to the former, and potential for the latter to last through 2019 if the real estate industry and labor reach an agreement on construction wages.

A week after the price caps on some 1 million apartments and the tax exemption for developers expired—only to be re-upped for five days—and six days after the State Legislature was scheduled to adjourn for the year, the governor and legislative leaders announced in Albany they had finally reached a tentative agreement on an array of contentious issues. Defamation Law falls under Tort Law. It refers to false statements about a person, communicated as fact to one or more other persons by an individual or entity (such as a person, newspaper, magazine, or political organization), which causes damage and does harm to the targets reputation and/or standing in the community. #Defamation Law: Legal Elements of Libel - Slander Cases.

Find a Personal Injury Lawyer

In essence, a defamation claim can arise when one person says something damaging about another person. However, if a plaintiff could successfully sue every time his or her feelings got hurt, there would be more defamation cases than the legal system could handle. For this and other reasons, defamation is a complex kind of tort (civil injury). This article discusses the key legal concepts of defamation law, different types of defamation - libel vs. slander - and their essential elements.

Why Defamation is Complex: Harm to Reputation and Free Speech

The essential harm alleged in a defamation claim is "damage to the plaintiff's reputation in the community." Because reputation is such an intangible thing, and because of the tendency of some people to react strongly to perceived insults, defamation has evolved -- over centuries of legal decisions -- into a complex concept ... #Determine if a Two-Year Law School Program is a Good Fit - US News

Two-year J.D. programs allow students to graduate faster, but with fewer opportunities for internships.

Sutton Smith received multiple admission offers when he applied to law school. As he weighed his choices, he considered the financial burden school could put on his family because his wife was also pursuing a graduate degree .

Smith chose the two-year program at the University of Dayton School of Law. one of a growing number of schools offering accelerated options for completing a J.D.

The idea was that if we were going to unplug our income, if we could do that for two years as opposed to three, I'd get back in the job market sooner, says Smith, 26. I'd have to borrow less money for living expenses.

Drexel University's Earle Mack School of Law announced earlier this month its accelerated option, Fast Forward, will start in 2014. In May, the Pepperdine University School of Law w ... Read more »

#Definition of a Business Administration Degree

Types of Degrees

There are four different types of business administration degrees. An associate's degree in business administration (ABA) usually takes two years to earn, and prepares you for entry-level managerial and administrative positions. A bachelor's degree in business administration (BBA) is a four-year degree that offers more advanced study compared to an associate's degree. The BBA is usually completed as preparation for further study in a master's program, but many managerial and administrative jobs are open to BBA degree holders. A master of business administration (MBA) is generally a two-year program that prepares you for the most common (and more advanced) careers in business management. Doctorate degrees in business administration prepare you to teach in colleges and universities or work in business research and consulting.

#Denied Employment? You have rights - Adverse Action - Concord Law Seattle

Some of the most important rights that we have in this country are those surrounding the hiring process.  Unfortunately, these are also some of the most routinely ignored rights.  In a world where a job can be the difference between happiness and despair, poverty and prosperity, many employers still ignore their duties under federal law.

Your Right To Adverse Action Dispute Process

One of the most impactful rights that we as Americans have is known as “adverse action.”  The fallout from employers failing to follow the rules can be crushing to a person’s life, as well as their families.  In a nutshell, adverse action means that in many instances where people are denied a job because of their background check, those folks have the right to be able to see their own report and be afforded the opportunity to dispute inaccurate or illegal information contained in the report.
