#China Law AnswersChina Law Blog

Notice

If you want to preserve your trade secrets and IP, use a China-focused NNN Agreement.

This is the second in our weekly series, posted every Friday.

Because of this blog, our China lawyers get a fairly steady stream of China law questions from readers, mostly via emails but occasionally via blog comments as well. If we were to conduct research on all these questions and then comprehensively answer them, that would soon become all that we do and we would soon be out of business. And that would be a bad thing for us and for this blog. So what we usually do is provide a super fast general answer and, when it is easy to do so, a link or two to a blog post that may provide some additional guidance.

Because we do so much work representing companies that are having their products manufactured in China, one of the most common questions we get is something like the following:

I am going to be meeting with a num ... Read more »

China Law for Business

China Motion Picture Copyrights

China joined WIPO (the World Intellectual Property Organization) in 1980 and it introduced its first copyright law in 1990. China adopted modern intellectual property laws as a condition of joining the WTO (the World Trade Organization) in 2001.

The amendments of 2001 were the first round of modernization of China s copyright law. A second round came into force in 2010. A bill representing a third round of amendments is now at an advanced stage. Incidentally, one of the biggest issues currently being debated is whether China should introduce a terrestrial public performance right for sound recordings. China is often criticized by the US for its copyright laws but China and the US have more in common than you might have thought when it comes to copyright they are both among a small number of nations that do not regard sound recording copyright as including a terrestrial public per ... #UK government rewrites surveillance law to get away with hacking and allow cyber attacks, campaigners claim - News - Gadgets and Tech - The Independent

The British government quietly changed anti-hacking laws to exempt GCHQ and other law enforcement agencies from criminal prosecution, it has been claimed.

Details of the change were revealed at the Investigatory Powers Tribunal which is hearing a challenge to the legality of computer hacking by UK law enforcement and intelligence agencies.

The Government amended the Computer Misuse Act (CMA) two months ago. It used a little-noticed addition to the Serious Crime Bill going through parliament to provide protection for the intelligence services. The change was introduced just weeks after the Government faced a legal challenge that GCHQ’s computer hacking to gather intelligence was unlawful under the CMA.

The challenge, by the charity Privacy International and seven internet service providers, claims GCHQ’s acti ... Read more »

#Workplace safety

Workplace safety: an overview

Workplace safety and health laws establish regulations designed to eliminate personal injuries and illnesses from occurring in the workplace. The laws consist primarily of federal and state statutes. Federal laws and regulations preempt state ones where they overlap or contradict one another.

The main statute protecting the health and safety of workers in the workplace is the Occupational and Safety Health Act (OSHA). Congress enacted this legislation under its constitutional grant of authority to regulate interstate commerce. OSHA requires the Secretary of Labor to promulgate regulations and safety and health standards to protect employees and their families. Every private employer who engages in interstate commerce is subject to the regulations promulgated under OSHA.

In order to aid the Secretary of Labor in promulgating and enforcing regulations, the act establishes the National Advisory Committee on Occu ... Read more »

#Civil Rights Act of 1964

Public Domain, www.commons.wikimedia.org

In an 11 June 1963 speech broadcast live on national television and radio, President John F. Kennedy unveiled plans to pursue a comprehensive civil rights bill in Congress, stating, this nation, for all its hopes and all its boasts, will not be fully free until all its citizens are free ( President Kennedy s Radio-TV Address, 970). King congratulated Kennedy on his speech, calling it one of the most eloquent, profound and unequivocal pleas for justice and the freedom of all men ever made by any president (King, 12 June 1963).

The earlier Civil Rights Act of 1957, the first law addressing the legal rights of African Americans passed by Congress since Reconstruction, had established the Civil Rights division of the Justice Department and the U.S. Civil Rights Commission to investigate claims of racial discrimination. Before the 1957 bill was passed Congress had, however, removed a prov ... Read more »

#Choosing a Program

What does it mean when a program is not accredited?

Accreditation is a voluntary process, as programs choose whether and when to apply for initial accreditation. The Commission on Accreditation (CoA) has no basis for evaluating programs that have not applied. View the current list of applicant programs for initial accreditation .

When accreditation is denied or revoked, that means that the program has been deemed inconsistent with the Guidelines and Principles for Accreditation of Programs in Professional Psychology (G P). When the CoA denies or revokes accreditation, those programs are publicly listed as such on the CoA Web site .

What if I want to study psychology at the undergraduate or master’s level?

The APA Commission on Accreditation only accredits programs at the doctoral level. There are no APA-accredited bachelor’s or master’s programs.

If you have an interest in studying psychology at the undergraduate level, yo ... Read more »

#Commercial law: area of practice

Keeping up to date with the latest commercial and legal developments requires dedication, but ensures that the work is never dull.

Commercial lawyers work on a broad spectrum of transactions, from substantial outsourcing, joint ventures and project development agreements to day-to-day manufacture, logistics/warehousing and advertising arrangements. The common element with all of these transactions for a commercial lawyer is the drafting and negotiating of contracts, whether in their own right or as part of complex mergers and acquisitions (M&Amp;A) and financing transactions.

Negotiating contracts

A typical transaction relating to a one-off contract usually involves discussing/reviewing the key commercial drivers with the client, preparing the first draft of the contract (or reviewing a draft provided by the other side), negotiating the key issues and preparing re-drafts reflecting these negotiations and finalising the mut ...
