#Urban Dictionary: Martial law

The day Martial Law is declared, is the day you wake up and realize that your Constution/bill of Rights/Charter of Rites and Freedoms/etc. is really just about as valuable as that Kleenex you just spunked in. because rites are just privileges, and privileges can be revoked. Your government will do whatever it takes to stay in power, and they got the gunz.

Martial Law can be recognized by the increased presence of men with plexiglass shields and/or sub-machine-guns, a pale green fog that tastes, smells and feels like burning, random acts of hippy clubbing and indiscriminate shooting into crowds.

If your going to get your loot on its best to do it during the Preceding state of emergency, because once Martial Law is declared, the party s over. Usually once Martial Law is declared, its best to just stay home, tune into your local state-owned media outlet and do what they say. The punishment for most criminal offenses becomes summary execut ... Read more »

#Using Benford s Law to avoid corporate chicanery: Business

2C265" /%

Investors wanting to dodge the next Enron, or just outperform the market, might want to pay particular attention to the first digits, and only the first digits, in numbers in company accounts.

Called Benford’s Law, after physicist Frank Benford who discovered it in 1938, it describes a well-observed fact: In naturally occurring sets of numbers of sufficient size the first digits are not evenly distributed. Lower numbers predominate: 1 is the first digit in a number almost 30 percent of the time while 9 begins less than 5 percent of numbers.

No one knows exactly why this happens, but in data sets from rainfall amounts to town population, the numbers follow a Benford’s Law distribution.

As the U.S. Internal Revenue Service uses Benford’s Law to sniff out tax cheats, or at least to narrow the field to better channel resources, why not do something similar with the data produced by com ... Read more »

#Fordham Law Review

Twice in the past two years, the U.S. Supreme Court has approved educational diversity as a compelling state interest that justifies the use of race in higher education admissions decisions. Nevertheless, it remains on somewhat shaky ground. Over the past decade, the Court has emphasized that its acceptance of diversity stems from the expectation that a diverse student body will enhance the classroom environment, with students drawing on their diverse backgrounds during classroom conversations that ultimately bring the law to life. Yet, the Court provides no support for its assumption that admitting and enrolling diverse students actually result in these educational benefits. In fact, empirical research on law students indicates that structural diversity (i.e. diversity in numbers) does not lead automatically to interactional diversity (i.e. meaningful interaction among diverse students) or classroom diversity (i.e. meaningful diverse interaction in the classroo ... #Using the road (159 to 203).

The following list can be found abbreviated throughout the Code. It is not intended to be a comprehensive guide, but a guide to some of the important points of law. For the precise wording of the law, please refer to the various Acts and Regulations (as amended) indicated in the Code. Abbreviations are listed below.

Most of the provisions apply on all roads throughout Great Britain, although there are some exceptions. The definition of a road in England and Wales is ‘any highway and any other road to which the public has access and includes bridges over which a road passes’ (RTA 1988 sect 192(1)). In Scotland, there is a similar definition which is extended to include any way over which the public have a right of passage (R(S)A 1984 sect 151(1)).

It is important to note that references to ‘road’ therefore generally include footpaths, bridleways and cycle tracks, and many roadways and driveways on private land (including many car parks). ... Read more »

#FL Dept Rev - Child Support Amounts

Dept. of Revenue Links

Child Support Amounts

A child support order tells the parents what they must do to support their children. Enforcing child support orders means getting the parent to do what the order says.

The amount of child support is based on guidelines defined in Florida law. Child support guidelines are standards used to figure out the support needed for a child and the amount a parent has to pay. Guidelines help make sure support amounts are fair. Every state has guidelines, but they may be different in each state.

These guidelines are used the first time child support is ordered and every time the child support amount changes. They are also used to review the order to see if the support amount should be changed.

Child support guidelines consider:

  • The income of both parents
  • The child's health care and child care costs
  • The standard needs for the child. A l ... Read more »

#For-Profit Law Schools: Impacting the Future of Legal Education

2C210" /% The InfiLaw System. a for-profit company that owns several law schools and professional development firms, is challenging the status quo in legal education in a way similar to for-profit education companies such as University of Phoenix, Strayer, and DeVry. #Frequently Asked Questions about the Healthy Workplace Bill

The HWB is advanced only by State Coordinators authorized by the Healthy Workplace Campaign. It is a matter of quality control. We speak nationally with a single voice, tailored to local lawmakers. Coordinators are educated and prepared to mobilize Citizen Lobbyists and to approach lawmakers with the best arguments for adopting the legislation.

We don't want individuals with different (often very personal) motives attempting to represent thousands or millions of their fellow state residents without the expertise Coordinators bring to the task. Coordinators give lawmakers the same text written by Suffolk University Law Professor, David Yamada, but lawmakers do make changes as they wish. Further, bills are revised (amended) in committees. Once bills are introduced, they can be found at the public legislatures' websites for review.

#Franchising Law.

What is Franchise Law?

Franchise Law relates to the business model of franchising. Franchising is a business practice that allows the franchising company to license its business model, intellectual properties (such as logos, trademarks, and patents), and corporate goodwill to another company or individual. The franchise model allows a company to expand quickly and is an alternative to the building of multiple locations all owned by a single person or entity. The single owner, or 'chain store' model, requires significant investment by the owner at both startup and throughout the operation of the satellite locations. Meanwhile, franchising allows the parent company to pass much of the expense of expansion on to the persons or entities who license the business franchise rights.

In franchising, the franchisor (the licensing parent company) licenses the use of its business model to other companies that are al ... Read more »

#Foreclosure Law.

What is Foreclosure Law?

Foreclosure law provides the means for a mortgage lender to take possession and sell a home when the borrower has defaulted on the loan. The money from the sale is used to pay off the balance of the loan, and the new buyer takes the home free of the mortgage. If the proceeds are not enough to pay off the loan, the borrower may be held personally liable for the difference, in addition to being forced out of the house. From the lenders perspective, foreclosure is slow and expensive. Thus, the lender will usually be just as motivated as the borrower to see that the loan is paid on time and foreclosure does not become necessary.

To understand foreclosure law, it helps to consider the nature of a mortgage. Mortgages are used when potential homebuyers seek to borrow purchase money, or when homeowners with equity in their property want to borrow cash to make home improvements or for other purposes. In either case, a bank l ... Read more »

#Garrow s Law.

Show Summary

A British period legal drama set in 18th century London and inspired by the court cases and life of pioneering 18th century barrister William Garrow.

Garrow is a talented, young barrister determined to install justice into a corrupt legal system of Georgian England. His confrontational and sometimes arrogant stance in the courtroom does not earn him any favours with the political elite and creates enemies within the criminal underground. His associate John Southouse, a solicitor, is often disapproving of Garrow's rebellious attitude, but nevertheless offers him advice and help.

Each episode features a case inspired by true legal proceedings as recorded at Old Bailey Archives: from rape and murder to high treason and corruption. The real William Garrow coined the phrase: innocent until proven guilty. in an age when defence counsel was for the minority. He was known for his forceful cross-examinations and more than once h ... #Frequently Asked Questions About Custody - Access

1. What do the words ‘custody’ and ‘access’ mean?

Custody is the term used to describe where the children live, and who makes decision for or about the children.

2. What does ‘best interests of the child’ mean?

This is the test that the court uses to make decisions about custody of and access with children, or parenting arrangements of any kind, where the children s needs and well-being are always the most important factors. The judge must decide what is best for the children, not what is best for the parents.

In February 2013, Nova Scotia s Maintenance and Custody Act was changed. The Act now includes a list of factors that judges must consider when making decisions about the best interests of a child. Judges will consider all relevant circumstances they are not limited to considering only the factors on the list.

#FT Global MBA Ranking 2015: London Business School claims second place

LBS’ success comes just a year after it took third spot and it remains the UK’s only representative in the top 10 of the Global MBA Ranking .

The ranking was topped by Harvard Business School for the sixth time while Stanford Graduate School of Business, which was second last year, dropped to joint fourth. The University of Pennsylvania: Wharton business school climbed one place to third.

The table is based on a number of factors including gender diversity and the international spread of students, but the heaviest weighting is placed on alumni salaries.

The FT said that LBS’ MBA students earned an average of $154,147 (£102,563) three years after graduation – an uplift of 97 per cent on their previous earnings.

Sir Andrew Likierman, the dean of LBS, said the school had “much to be proud of”, including a strong performance in the research element of the ranking.

#From John Law to John Maynard Keynes

This article appeared in Globe Asia in the February 2009 issue

The economic-financial crisis of 2008 has produced, if nothing else, grist for the financial press. Bernard Madoff s alleged $50 billion scam and the assertion that we need a mega-Keynesian stimulus package the bigger, the better represent two of today s favorite topics. In an attempt to make their reportage and opinions more interesting, the authors often attempt to link historical episodes to their Madoff and stimulus stories.

John Law and his Mississippi Company, which was established in 1717 and collapsed in 1720, are standard references that accompany Madoff s alleged Ponzi scheme. In fact, the only obvious connection between Law s Mississippi Company and Madoff s operations is that their values went up and then down. This fact fails to merit mention, however.

What merits attention is that Law was an economist of note and a precursor to John May ... Read more »

#Godwin’s Law

Mike Godwin is an American attorney and author who formulated “Godwin’s Law” in 1990 when he made the following assertion:

As an online discussion grows longer, the probability of a comparison involving Nazis or Hitler approaches 1.

Note. In probability theory, an event is said to never happen when its probability is 0, and to always happen when its probability is 1.

Godwin’s Law, also known as “Godwin’s Law of Nazi Analogies,” is applicable to threaded online discussions in forums, chat rooms, and on blogs. The term has earned a place in the OED:

Godwin’s Law. noun. A facetious aphorism maintaining that as an online debate increases in length, it becomes inevitable that someone will eventually compare someone or something to Adolf Hitler or the Nazis.

Although coined to describe an Internet phenomenon, the term is being applied to the use of “the Nazi card” in other contexts, as in thi ... Read more »
