#Clive Anderson: Garrow - s Law gives credit to a neglected legal hero

The former barrister turned television and radio presenter hails the radical 18th-century lawyer celebrated in new BBC drama series Garrow's Law.

5:20PM GMT 29 Oct 2009

Comments

In general, nobody has a good word to say for the legal profession: The first thing we do, let s kill all the lawyers is perhaps the best known line in all of Shakespeare well, in all of Shakespeare s Henry VI Part 2, at any rate.

But the barrister battling away on behalf of the poor defendant in a criminal case is a well-recognised exception to this rule. From Atticus Finch to Rumpole of the Bailey, from Perry Mason to Kavanagh QC, counsel for the defence is seen as a romantic and attractive figure. We may want our government to be tough on crime and tough on the causes of crime, but in courtroom dramas we don t take to the gimlet-eyed prosecutor. Our hero is the learned friend of the establishment, who ... Read more »

#Overview of MBA Programs

Full-time, Part-time, On-line and Executive MBAs

MBA programs are numerous. With so many options, the search for the MBA that is best suited for your goals is a strenuous and demanding process. The first step is to identify the type of MBA you are looking for. Above all, you need to realize that there is no best or worst MBA. Each prospective MBA student has his or her own vision of his or her career development.

It is generally accepted that all MBA programs can be divided into four groups: full-time MBA, Executive MBA, part-time MBA and distance learning MBA. To understand why a full-time MBA still remains what many prospective students refer to as the authentic MBA, it is important to illustrate the difference between the traditional MBA delivery method and other program types.

Lately, many kinds of joint MBA programs have been introduced to the market. For instance, more and more B-schools recognize the benefits of part-time s ... Read more »

#Outside the Law School Scam: California Western School of Law alum receives a special sales pitch from a school peddling online MBAs to dissatisfied recent law grads.

California Western School of Law alum receives a special sales pitch from a school peddling online MBAs to dissatisfied recent law grads.

Taft's sales pitch is that its online MBA program ("with a concentration in Professional Practice Management") can teach the nuts and bolts of running a solo or small law firm to recent law school graduates. ("The Program teaches the skills necessary to manage a successful solo or small legal practice. It combines a traditional M.B.A. curriculum with webinars and assignments directly related to the practice of law.") Another lure, of course, is that its students get to defer existing student loans, with the slight drawback that they will be adding significantly to the sum. ("For those that qualify, it is also the only University program approved for Title IV Federal Finan ... Read more »

IT SEEMS that everyone, from Barack Obama down, thinks there is something wrong with America’s law schools. The president questions whether their graduate courses need to be as long as three years. Potential students are spurning them: applications are falling, other than at a few elite institutions. Michael Schill, the dean of one of those top schools, at the University of Chicago, laments that lawyers are no longer making it to the top of big companies as they used to. Surveys suggest practising lawyers are miserable, perhaps because they feel their career prospects are limited.

Many lawyers end up working in business, but their legal education leaves them ill-prepared for this. Apart from a bit of accounting, law-school courses typically contain little that is of help in running an enterprise. So Chicago’s law school has just launched a programme in which stude ... #Congressperson asks DoJ to “intensify enforcement” of online harassment laws

Says only 10 cases out of estimated 2.5 million were prosecuted from 2010-13.

by Sam Machkovech - Mar 11, 2015 10:59 pm UTC

Enlarge / House of Representatives member Katherine Clark (D-Mass.)

On Monday, House of Representatives member Katherine Clark (D-Mass.) became the first member of the US Congress to call out GamerGate while lambasting online harassment. In an op-ed at TheHill.com titled "Sexism in cyberspace ," Clark called on the US Department of Justice to "intensify their efforts to investigate and prosecute the federal laws that criminalize the worst" cases of abusive speech perpetuated online.

According to Clark, only ten cases of "cyber-stalking" have been pursued by the US DoJ between 2010 and 2013—years after Congress amended the Violence Against Women Act to add online harassment to its federal purview (see Sec. 113 here. PDF)—in spite of an "estimated 2.5 ... Read more »

#Common Law Separation in Canada

A common law relationship is defined as two people who live together in a committed “marriage-like” relationship. According to recent Canadian census, common law relationships are quickly on the rise in our country. Despite the spike in this type of relationship, the rights of people living together outside of a marriage are still quite misunderstood. In fact, many people incorrectly believe that a common law couple is entitled to the same rights as a married couple, but this is most often not true. The exact laws of a common law marriage, and even the criteria needed to qualify as one, vary by province or territory across Canada.

Does Your Relationship Qualify as Common law?

Common Law Separation: Basic Canadian Law

The basic laws when a common law couples separates are as follows:

#Competition and Patents

Introduction

The objective of competition policy is to ensure a fair functioning of the market and, in particular, that market entry is not unduly prevented or made difficult. Anti-competitive practices include a range of activities, such as abusive exclusionary conduct by a dominant company, refusal to provide certain goods or to grant licenses on market conditions, charging excessive prices, vertical arrangements between suppliers and distributors and other agreements among firms which lead to the distortion of competition on the market.

There is a close link between patent rights and competition, which, in simple terms, can be characterized by two factors: on the one hand, patent laws aim to prevent the copying or imitation of patented goods, and thus complement competition policies in that they contribute to a fair market behavior. On the other hand, competition laws may limit patent rights in that patent holders may be barred from abu ... Read more »

#Computer Science Degrees

20Science%20%20top%20universities-350x233.jpg" /%What is a computer science degree?

In a nutshell, computer science degrees deal with the theoretical foundations of information and computation, taking a scientific and practical approach to computation and its applications. Computation is defined as any type of calculation or use of computing technology that follows well-defined models (such as algorithms and protocols) in the practice of information processing (which in turn is defined as the use of these models to transform data in computers).

Computer science is considered by many of its practitioners to be a foundational science - one which makes other knowledge and achievements possible. The study of computer science involves systematically studying methodical processes (such as algorithms) in order to aid the acquisition, representation, processing, storage, communication of, and access to information. #Consideration Lecture Notes

    Introduction

The mere fact of agreement alone does not make a contract. Both parties to the contract must provide consideration if they wish to sue on the contract. This means that each side must promise to give or do something for the other. (Note: if a contract is made by deed, then consideration is not needed.)

For example, if one party, A (the promisor) promises to mow the lawn of another, B (the promisee), A's promise will only be enforceable by B as a contract if B has provided consideration. The consideration from B might normally take the form of a payment of money but could consist of some other service to which A might agree. Further, the promise of a money payment or service in the future is just as sufficient a consideration as payment itself or the actual rendering of the service. Thus the promisee has to give something in return for the promise of the promisor in order to convert a bare promise made in his favour into a b ... Read more »
