Freedom of the press is a fundamental liberty guaranteed by the First Amendment of the Constitution. As such, courts and legislative bodies have been hesitant to impinge on that freedom. In fact, there are numerous state and federal statutes that seek to ensure the full extent of the guarantee of the First Amendment, such as the Freedom of Information Act and the Privacy Act .

Historically, media law has been divided into two areas: telecommunications and print sources (newspapers, periodicals, etc.). There are some federal regulations regarding both categories and there are state laws governing both areas as well. The scope of these laws is limited by the First Amendment. Graduate law degrees  have come under the spotlight recently, with some questioning their value in terms of boosting employment rates  and salary prospects. There’s certainly been mounting recognition that Master of Law (LLM) won’t immediately guarantee a US$160,000 annual starting salary.

However, while figures relating to return on investment may have been over-exaggerated in the past, it’s still the case that a master’s or PhD-level degree in law is likely to open new doors – in terms of both career options and academic challenges.

“Postgraduate training is a sign that a lawyer has an advanced knowledge of one or more aspects of law and has successfully demonstrated this through an assessment process,” says laureate professor Cheryl Saunders, an associate dean at Melbourne Law School, Australia. “If the university that has conferred the degree is known to be rigorous, the degree will be more highly valued.”

Constitutional Right to Keep and Bear Arms?

Yes. The people shall have the right to keep and bear arms for the defense of themselves and the state, but the military shall be kept in strict subordination to the civil power.

Oregon law restricting gun permits is more restrictive than most other shall-issue states. In addition to the standard list of persons who are refused a permit in Oregon — including anyone who is a convicted felon, who is awaiting trial on felony charges, who has been declared mentally incompetent, who is a fugitive from justice or who has had an order of protection issued against him, the state also refuses permits to anyone who has been convicted of any misdemeanor within the past four years.

New cars and other new motor vehicles are covered by manufacturers' warranties. These warranties must follow the rules set by the federal Magnuson-Moss Warranty Act and the Uniform Commercial Code (UCC) (refer to the section on Warranties for more information). The manufacturer's warranty is provided at no extra cost to the buyer. Sometimes, despite the best efforts of a dealer's service department, a defect cannot be satisfactorily fixed. These unfixable vehicles are popularly referred to as lemons. New Hampshire's Lemon Law provides a method for the lemon owner to satisfactorily resolve the problem.

Eligibility

When can I use the Texas Lemon Law?

If you have purchased or leased a new motor vehicle and it develops a defect or condition that substantially impairs the motor vehicle’s use, market value or safety, you may be eligible for relief under the Texas Lemon Law. You are required to allow the manufacturer a reasonable opportunity to repair the defect(s) before you may file a complaint for lemon law relief. There is a $35 filing fee required with the submission of the Lemon Law complaint form. The number of reasonable attempts may vary based upon the defect’s effect on the normal operation of the motor vehicle.
