#Fired attorneys withdraw from representing Tamir Rice estate in lawsuit, court records show

CLEVELAND, Ohio — Three attorneys who were representing the estate of 12-year-old Tamir Rice in a lawsuit against the city of Cleveland stepped down Friday, according to a court filing from the estate's new attorneys.

Attorneys Benjamin Crump sent a letter of resignation Friday on behalf of himself, Daryl Parks and Walter Madison, the filing shows. It also shows that the lawyers still represent Leonard Warner, the boy's father, in the wrongful death lawsuit.

New York law firm Emery Celli Brinckeerhoff Abady and Cleveland attorney Subodh Chandra now represent the estate. Administrator Douglas Winston hired the team after Tamir's mother, Samaria Rice, retained them as counsel.

The court filing asks Chief U.S. District Judge Solomon Oliver Jr. to appoint the firm of Emery Celli Brinckeerhoff Abady and Chandra as the new lawyers representing the estate in the lawsuit.

Financially a nightmare

LawDepot.com - False advertising

This needs clarification. LawDepot offer three purchasing options which are presented on completion of your document.

The options are: #1; A monthly site subscription; #2; Fixed price per document;; #3; A 7 day free trial which provides access to most of LawDepot's documents. The purpose of the free trial is to encourage visitors into a paid monthly site subscription which becomes active should the visitor fail to cancel their payment details before the 7 day trial expires, which LawDepot makes clear. So it is necessary to provide credit card information prior to selecting the preferred option.

I am an affiliate for LawDepot (write-your-own-will.com (not intended as a back-link)) but do not promote the free option. However, it is important to bear in mind that "free", in most cases, embodies conditions, and this is where most people come unstuck. You ... Read more »

The term Sharia (a.k.a. Shari'a) literally means the path to a watering hole . The Guardian newspaper in the UK describes Sharia as: . a religious code for living, in the same way that the Bible offers a moral system for Christians. 1 It is used to refer both to the Islamic system of law and the totality of the Islamic way of life. Sharia is derived both from:

From Sunna, which is referred to as Islamic Custom or practice; particularly that associated with the exemplary life of the Prophet Muhammad, comprising his deeds and utterances as recorded in the hadith . The hadith literally means report or narrative 2

This essay refers only to Sharia law as found in the Sunni Islamic tradition; this includes about 85% of all Muslims. For coverage of the Shi'a interpretatations of Sharia law, the book An Introduction to Shi'i Islam: The History and Doctrines of Twelver Shi'ism" by Moojan Momen has been recommende ... Read more »

One of the few good television shows still standing.

22 December 2004 | by mentalcritic (Southern Hemisphere) See all my reviews

Television in Western society has become something of a cultural and imaginative wasteland, with the lowest common denominator now firmly in charge. As attempts to create something imaginative or different get cancelled faster than Mike Tyson can embarrass the sport of boxing, the drivel that we call Reality TV just keeps on keeping on. Which makes those of us with an active brain in our heads all the more grateful that a simple two-act series about criminal prosecution can last for fourteen-plus years.

The premise is as refreshing as it is simple. Before Law Order, the majority of television shows about lawyers showed defense lawyers doing the police's job and solving cases for them. Competent police or prosecution lawyers did not exist in this highly fictitious setting, so Law Order turned that on its head. Law Or ... Read more »

In cases of divorce, the court of jurisdiction for the divorce proceedings also determines child custody arrangements. Under the common statutory provision, if the spouses have children together while married, the parents have joint guardianship over that child and the parental rights are equal. Each parent has an equal right to the custody of the child when they separate.

When determining the home in which to place the child, the court strives to reach a decision in "the best interests of the child." A decision in "the best interests of the child" requires considering the wishes of the child's parents, the wishes of the child, and the child's relationship with each of the parents, siblings, other persons who may substantially impact the child's best interests, the child's comfort in his home, school, and community, and the mental and physical health of the involved individuals.

The parent with custody controls decisions pertaining to the child's education, religious ... Read more »

Advice for Getting Into Law School

Admission to law school is very competitive. Consider Arizona State Law School. I offer this hypothetical as an example of what happens at law schools generally. What I'm going to say here about Arizona State could be said about every law school in the country.

Arizona State is a good school, ranked 53rd in the nation (out of 187 law schools). Each year, Arizona State has an entering class of about 500 law students. For those 500 seats in its first-year law class, Arizona State receives over 7,000 applications. About 1,400 (20%) of the 7,000 applicants will be admitted, since some people will be accepted at many law schools and will turn down Arizona State's offer of admission.

Now, imagine that I'm a member of the Admissions Committee at Arizona State Law School. My job on the Admissions Committee is to accept only those applicants about whom I can make a reasonable prediction of satisfactory performance in law school. But ... Read more »

#Understanding The HIPPA Law

HIPAA is an acronym for The Health Insurance Portability and Accountability Act and was first enforced in 1996. This Act was created to provide protection for personal health information. This Act is balanced so that it provides needed information to health care providers for patient care, but also provides patients certain rights to that personal information.

Enforcement for most HIPAA covered entities was enforced beginning on April 14, 2003 while smaller health insurers were given one additional year. Enforcement activities include complaint investigation, compliance reviews, and continued education. The enforcement activities resulted in an improvement of privacy protection for the health care information of individuals.

The Privacy Rule is a federal law which allows you certain rights over your personal health information. You may obtain your health records, correct information on your health record and give permission to those who ... Read more »

Immigration is the act of entering a country with the intent to permanently live and/or work there. United States immigration laws encompass a wide range of situations that involve a person from a foreign country coming to this country, whether for a temporary visit, or to live here permanently.

The American immigration system is set up primarily to grant immigration status based on factors such as family reunification, in-demand work skills, and capital investment. The immigration system also covers refugees and asylum seekers, and provides a "lottery" for immigration status to people who have less pressing immigration needs. The procedure for gaining legal immigrant status will depend upon, among various factors, which path you are eligible to pursue based on your employment, education, and family situation.

#University of Wisconsin-Madison Legal Studies Program

The Legal Studies Program is an undergraduate major in the College of Letters and Sciences. The program's mission is to provide a liberal education across traditional disciplines, focusing on the theory and operation of law and legal institutions. The courses in the Legal Studies major expose students to the many facets of law as a social phenomenon - its evolution, function, motivating ideas and effects. The major is not intended as preparation for law school because the emphasis is on exploring broadly defined questions about law from a variety of perspectives, rather than on training for the profession. The Legal Studies major is, however, suitable for pre-law students.

The curriculum is designed around the following five themes: Legal Institutions, Processes of Legal Order and Disorder, Law and Social Forces, Law and Culture, and Law and Theory.

#US Knife Laws

Choose Your State

How the US Justice System Works

The United States was founded under the principals of federalism. Under federalism, governing powers are divided between the federal government as well as the state governments. For states existed before the founding of the US, the writers of the Constitution respected the state s authority by limiting federal powers to only those expressly stated within the Constitution. All other governing powers are, therefore, state powers.

For knife law, the only federal law is theВ Switchblade Knife Act of 1958 as well as the 2009 amendment to the act (seeВ 15 U.S.C. В§1244). The federal knife law only applies to individuals who are traveling internationally as well as between states. If you reside in a federal district (see Washington D.C. knife laws ), the federal law is the only law that governs knives for you. If you live in one of the 50 states, the federal law would only apply to you if ... Read more »

Diaconis argued for the application of the clergy privilege to Alcoholics Anonymous ( AA ) by constructing a detailed history of AA from its origins to present day, relying on a variety of primary and secondary sources including interviews with current members. For the LBers who have been following the rising cost of law school tuition and debt, University of Massachusetts School of Law has proposed a bold solution: cap tuition for the next three years.

That means the new schools full-time in-state tuition will hold steady at $23,068 and its full time out-of-state tuition at $30,760.

The establishment of UMass Law is about mission, not money, said UMass President Robert Caret on the school website.

The move may also be borne out of necessity. A brutal legal job market has given way to a steep drop in law school applications. UMass, which opened its doors in after acquiring $23 million of assets from the Southern New England School of Law, could have a hard time filling seats if the market doesnt improve.

The American Bar Association gave the school provisional accreditation earlier this month. According to the February Massachusetts bar exam results, not a single first-time test-taker from UMass passed the b ... Read more »

Is an MBA that costs two years of your life and $150,000 really worth it?

For our fifth annual survey of the World's Best Business Schools, we asked thousands of professionals from around the world who have experience hiring MBAs to determine the best business school. They came back with a clear favorite: Harvard University.

Survey participants rated the reputation of the graduates from top business schools around the world on a scale of poor to excellent (1 to 5), with excellent ratings used as a tiebreaker. We included responses only from professionals who said they had experience hiring MBAs at least half the time, as well as other filters to optimize our survey pool.
