When Arizona took lead with some tough laws against illegal immigrants and accused federal government of "failing in its duty to protect Americans", few eyebrows were raised. Illegal immigration statistics in the United States suggest that there are a whopping 8 million illegal immigrants in the United States who either sneak through the borders or simply overstay the visa issued by the US government. There are proper laws in place, but most policy-makers are of the view that these laws look formidable on paper, but fail to protect the country from illegal aliens. In a country where unemployment rate was peaking at 8.8% as of March, and where federal aids are already overburdened, illegal immigration poses more challenges for the government.

Laws on Illegal Immigration
  • It is illegal to harbor illegal immigrants. Harboring means helping the alien to stay in the United States illegally.

#Eight Hallmarks of a TTT Law School

Urban Dictionary defines a third-tier toilet (TTT) as a “pejorative term for law schools that are not prestigious.” The definition goes on to explain that any school that fails to rank in the Top 14 is not prestigious. Which, by that definition, means that Harvard is not a TTT, but Vanderbilt is. As a result, the TTT label is applied liberally to a range of law programs.  (UD)

Since we’re not sure who makes this shit up—and since the label seems rather arbitrary—we made our own list of factors that indicate an institution is a TTT.

1 TTTroll Factory. Is your law school a thread on a law-oriented bulletin board?  If your law school produces so many comment trolls that your dean needs an RSS feed for sites like JDUnderground.com and AutoAdmit.com just to keep up with what dissatisfied alums are saying, it’s a safe bet that the school in question is a TTT.

#Employment Law - Guide to Labor Law.

Guide to Labor Law

What is Employment Law?

Employment law governs the rights and duties between employers and workers. Also referred to as labor law, these rules are primarily designed to keep workers safe and make sure they are treated fairly, although laws are in place to protect employers interests as well. Employment laws are based on federal and state constitutions, legislation, administrative rules, and court opinions. A particular employment relationship may also be governed by contract.

American labor laws trace back to public outcry against the oppressive practices of the industrial revolution. In the early 20th century, the first laws were passed to compensate injured workers, establish a minimum wage, create a standard work week, and outlaw child labor. In the 1960s and 70s, Congress acted to prohibit discrimination and unsafe work conditions. Current issues involve employee healthcare and equal pay ... Read more »

#Employment contracts

Employment contracts

Contract of employment or independent contractor

An "employee" is a worker who works for another in exchange for wages. There are other arrangements for the performance of work that look like employment contracts . but are treated as independent contracting arrangements, or contracts for the provision of services.

The contract under which an employee performs work is called a "contract of service". The contract under which an independent contractor performs work is called a "contract for services".

Independent contractors generally are not covered by statutory minimum standards, awards or workplace agreements made under the WRA or the FW Act (see "National Employment Standards ", "Awards " and "Workplace Agreements ", below). Independent contracting arrangements are widely used in the transport and building industries.

I cannot tell you how impressed I have been with this book. I love it very bit of what I have learned with it.

#Employment Discrimination

Employment discrimination: an overview

Employment Discrimination laws seek to prevent discrimination based on race, sex, religion, national origin, physical disability, and age by employers. A growing body of law also seeks to prevent employment discrimination based on sexual orientation. Discriminatory practices include bias in hiring, promotion, job assignment, termination, compensation, retaliation, and various types of harassment. The main body of employment discrimination laws consists of federal and state statutes. The United States Constitution and some state constitutions provide additional protection when the employer is a governmental body or the government has taken significant steps to foster the discriminatory practice of the employer.

The Fifth and Fourteenth Amendments of the United States Constitution limit the power of the federal and state governments to discriminate. The Fifth amendment has an explicit requirement that ... Read more »

#Employment Discrimination Law.

What is Employment Discrimination Law?

Employment discrimination law refers to federal and state laws that prohibit employers from treating workers differently based on certain attributes unrelated to job performance. Discrimination by government employers violates the constitutional guarantees of equal protection and due process. Discrimination by private employers may conflict with any number of statutory protections, most notably, Title VII of the Civil Rights Act of 1964.

Not all classifications qualify for protection against discrimination in the workplace. Under current law, individuals are protected against discrimination based on race or skin color, national origin, genetic information (such as family medical history), gender or pregnancy, religion, disability, and age. In some cases, it is also illegal for employers to discriminate based on marital status, political affiliation, and sexual orientation.

Scientific laws are repeatedly observed phenomena in nature that appear to be nearly universally true. Often times laws will be developed from and described by mathematical models of the phenomena in question. Laws are different from theories in that they are not designed to provide a causal framework in which to describe why a series of observations reliably occur but are rather merely descriptions of the observed phenomenon. Creationists often like to refer to scientific laws as the unimpeachable authority of science and often try and use such things as the Second Law of Thermodynamics to argue against evolution. This is, of course, a logical fallacy that relies on equivocation .

A posteriori laws are capable of being precisely mathematically analysed and described. They also permit the prediction of future events by extrapolation from past events or present circumstances.

A legal termination of parental rights differs significantly from simply agreeing to not seek custody and/or visitation with a child. While parents are typically free to choose to live apart from or refrain from visiting with their children, they likely have a legal right to do so if they so choose. On the other hand, a legal termination of parental rights permanently prohibits a parent from having any legal rights to the child, including the right to custody of the child, the right to visit or have any contact with the child, and the right to have any input in decisions made regarding the child. Termination of parental rights also relieves a parent of the responsibility to financially support his or her child. Every state has different laws that govern the termination of parental rights, and there are different situations in which a court may order that a person s parental rights be terminated.

One of the most common proceedings in which parental rights are terminated is th ... Read more »

The Law of Segregation is based on one of the benchmark scientific experiments in genetic studies, the Mendel Pea Plant Experiment.

It was a stroke of genius considering that it was performed in the 19th century.

Of course, Mendel knew nothing about the processes behind inherited behavior, but found out the rules dictating how characteristics are passed down through the generations.

The way in which he meticulously planned his experiment to generate testable. rather than observational data, is a shining example of experimental design .

Gregory Mendel was an Austrian monk studying at the University of Vienna. Like many pioneering scientists, his discoveries were largely ignored until long after his death.

Mendel noticed that certain characteristics appeared to be passed on from parents to offspring, in many species, and wondered why this was so. He also wanted to establish what characteristics were taken ... Read more »

#Pareto s Principle - The 80-20 Rule

What It Means

Project Managers know that 20 percent of the work (the first 10 percent and the last 10 percent) consume 80 percent of your time and resources. You can apply the 80/20 Rule to almost anything, from the science of management to the physical world.

You know 20 percent of your stock takes up 80 percent of your warehouse space and that 80 percent of your stock comes from 20 percent of your suppliers. Also 80 percent of your sales will come from 20 percent of your sales staff. 20 percent of your staff will cause 80 percent of your problems, but another 20 percent of your staff will provide 80 percent of your production. It works both ways.

How It Can Help You

The value of the Pareto Principle for a manager is that it reminds you to focus on the 20 percent that matters. Of the things you do during your day, only 20 percent really matter. Those 20 percent produce 80 percent of your results. Identify and ... Read more »

With the exception of Native Americans, all persons living in the United States are descended from immigrants or slaves who came to the country during the last 400 years. By the late seventeenth century, foreign-born persons constituted seventy-five percent of the American population.

Initially, the U.S. government encouraged open immigration in the interest of settling as much territory as possible. Following the Civil War, however, states began to pass their own immigration statutes. The United States Supreme Court determined that immigration came under federal jurisdiction in 1875, and Congress established the Immigration Service in 1891.

Most early immigration laws were instituted in order to control the composition of the U.S. population. In 1790, Congress passed the Naturalization Act, which effectively limited immigration to persons of European and Caucasian descent. In 1882, Congress passed the Chinese Exclusion Act, which made immigration from China illegal. ... Read more »

Community Property Law concerns the distribution of property acquired by a couple during marriage in the event of the end of the marriage, whether by Divorce or death of one of the parties. The states that utilize a community property method of dividing resources were influenced by the Civil Law system of France, Spain, and Mexico.

#Enforcement of Federal Immigration Laws at the State and Local Levels

Encouraging state and local law enforcement agencies to help enforce federal immigration laws could help identify out-of-status immigrants eligible for deportation, but may also have unintended consequences, according to a study issued today by the RAND Corporation.

"Enforcement of immigration laws has traditionally been a federal responsibility," said Jessica Saunders, lead author of the study and a criminologist with RAND, a nonprofit research organization. "But it's clear that the federal government alone isn't going to be able to clear the backlog of cases without some additional assistance.

"The question is, how do you involve state and local law enforcement in immigration enforcement without disrupting their regular duties or placing additional, undue financial burdens on cities and states? Currently there is no consistent, nationwide approach."

Instead, classes focus on processes, improved management strategies and direct application in the workplace.

An online Executive MBA is a rigorous graduate program that typically takes two years of study to complete. Because the program is geared toward full-time mid-level managers looking to move up the corporate ladder, few students complete the program faster, as many are enrolled part time and don t have room in their busy schedules for accelerated studies. When window tint is installed to the glazing of a vehicle it reduces the amount of visible light, how much depends on the darkness of the tint. Car window tint is graded in a % VLT (Visible Light Transmittance - the amount of light the film allows to pass through). Some companies grade the film as how much light the film blocks so 20% VLT could be that it allows 20% of light to pass through, however with another company if could allow 80% of light to pass through as the 20% is the amount of light it blocks, this confuses things and you should always check before installing film. In this article all percentages refer to the visible light transmittance (VLT).

Authorities in many countries and states have laws as to how dark you can tint your windows. This is because if the windows are tinted too dark you may not be able to see hazards clearly, especially at night, and also police may not be able to identify individuals inside a vehicle. Back in July, a Federal District Court Judge enjoined Arizona from enforcing the key provisions of its controversial immigration law, specially those that authorized local police to require suspected illegal immigrants to provide immigration papers even without a valid arrest. Today, the Ninth Circuit Court of Appeals upheld that injunction in an appeal that the state had filed almost immediately after the decision:

The U.S. Court of Appeals for the 9th Circuit has ruled that lower federal court judge was right in her decision to halt parts of Senate Bill 1070 from going into effect last year.

The ruling comes almost a year after Gov.
