#What is tort law? Law and Government
A ‘tort’ is a legal wrong, for which the law provides a remedy. It is a civil action taken by one citizen against another and tried in court. A person who sustains injury or suffers pecuniary damage as a result of the wrongful act of another person is known as the plaintiff and the person who is responsible for inflicting the injury and incurs liability for the damage is known as the defendant or tortfeasor.
How can tort law be distinguished from other types of law?
The law of torts derives from a combination of common-law principles arising from case law and legislative enactments. It can be distinguished from actions for breach of contract simply on the basis that tort actions are not dependant on any agreement between the parties to the lawsuit. While criminal prosecutions are enforced by the police and brought by the government, tort actions are brought by private citizens. In addition, tortfeasors

#Criminal Lawyers - Criminal Attorney and Law Firm Directory
Find Criminal Lawyers by State
What Do Criminal Lawyers Do?
Criminal Lawyers represent clients in actions initiated against individuals by the federal or state government. Unlike in civil law. those who are prosecuted for a crime are guaranteed the right to assistance of counsel. The Sixth Amendment of the United States Constitution guarantees this right.
This right, generally, must be invoked by the individual and applies only after the initiation of formal adversarial proceedings whether by way of formal charge, preliminary hearing, indictment, information, or arraignment.
Criminal lawyers are there to support an arrested individual; an individual questioned by police but not formally charged; or an individual charged with a crime. Criminal Lawyers are able to provide clients with a valuable knowledge and understanding of the charges and implications of your actions.

#Definitions of Child Abuse and Neglect in Federal Law - Child Welfare Information Gateway
Federal legislation provides guidance to States by identifying a minimum set of acts or behaviors that define child abuse and neglect. The Federal Child Abuse Prevention and Treatment Act (CAPTA) (42 U.S.C.A. 5106g), as amended by the CAPTA Reauthorization Act of 2010, defines child abuse and neglect as, at minimum:
- Any recent act or failure to act on the part of a parent or caretaker which results in death, serious physical or emotional harm, sexual abuse or exploitation ; or
An act or failure to act which presents an imminent risk of serious harm.
This definition of child abuse and neglect refers specifically to parents and other caregivers. A child under this definition generally means a person who is younger than age 18 or who is not an emancipated minor.
While CAPTA provides definitions for sexual abuse and the special cases of

We have all heard of the current 'laws of attraction' wave sweeping across the world and the use of new age philosophical phrases, like 'positive thinking', the 'universal laws of attraction', and the '11 forgotten laws of attraction'. However, how many of us have truly realized the essence of these terms which have been a part of so many books and movies? Deemed as one of the most important laws governing the universe, the laws of attraction are believed to be the key to worldly success and freedom. The world is full of people who are constantly running the rat race to make money, have a great relationship, a nice home, and a great car (Read: A red Ferrari). So why is it that some people find success a walk in the park, while others struggle with a life of mediocrity and unhappiness? To answer this all important question, we need to understand the laws of attraction.

#De facto legal definition of de facto
De Facto
[ Latin, In fact.] In fact, in deed, actually.
This phrase is used to characterize an officer, a government, a past action, or a state of affairs that must be accepted for all practical purposes, but is illegal or illegitimate. Thus, an office, position, or status existing under a claim or color of right, such as a de facto corporation. In this sense it is the contrary of de jure. which means rightful, legitimate, just, or constitutional. Thus, an officer, king, or government de facto is one that is in actual possession of the office or supreme power, but by usurpation, or without lawful title; while an officer, king, or governor de jure is one who has just claim and rightful title to the office or power, but has never had plenary possession of it, or is not in actual possession. Collaborative law (also called collaborative practice. divorce. or family law ) is a legal process enabling couples who have decided to separate or end their marriage to work with their lawyers and, on occasion, other family professionals in order to avoid the uncertain outcome of court and to achieve a settlement that best meets the specific needs of both parties and their children without the underlying threat of contested litigation. The voluntary process is initiated when the couple signs a contract (called the "participation agreement"), binding each other to the process and disqualifying their respective lawyer's right to represent either one in any future family related litigation.
Ever since its inception in the 1980s, the Collaborative Law movement has spread rapidly to most of the United States, Europe, Canada and Australia. [ 2 ] More than 22,000 lawyers have been trained in Collaborative Law worldwide and than 1,250 lawyers have comple

U.S. Copyright law is a subset of Intellectual Property law. It provides protection to the creators of specific work product for that work product, established by the U.S. Constitution in Article 1, Section 8. It also allows the copyright owner to copy his/her work as he desires and to legally prohibit others from doing so, and also from displaying, using, distributing, performing and/or licensing his/her work product for a specific period of time. Copyright law also protects derivatives of a copyrighted work, unless it falls under the ?fair use? doctrine.
Fair use refers to the public?s right to freely use certain copyrighted material without fear of reprisal. The factors used to define ?fair use? are specified in copyright law, although their interpretation is very subjective. Generally speaking, fair use allows individuals to reproduce copyrighted material only for narrow and specific purposes which include criticizing or critiquing; commentary and news reporting;

Thinking about law school? Consider California law schools. California offers a complete menu of law schools ranging from ABA approved schools, Concord Law School, state approved schools, unaccredited law schools, correspondence and online law schools. But the really unique thing about the California law schools is that their graduates, even those graduating form non ABA approved programs, generally speaking, are permitted to take the bar exam and become practicing lawyers.
Must you take the LSAT before attending a California law school?
That depends upon the particular school. As a general rule if wish to be considered for one of California’s ABA approved law schools the answer is yes. As for the other schools the LSAT is not always required and, in quite a number of cases, it is just not a requirement at all. The LSAT has been criticized for many years. Some say one’s score bears little or no relationship to how well one will perform in law school

The new Chinese bankruptcy law went into effect June 1, 2007. It is China s first bankruptcy law since 1986, which law applied only to state-owned enterprises (SOEs). Since that law was enacted before China s 1993 economic reforms, many of its provisions were inadequate for or in conflict with China s new more market-centered economy.
China s new bankruptcy law mirrors the modern bankruptcy laws of other countries, particularly the United States. The new law applies to all legal entities, including foreign invested enterprises (FIEs), such as WFOEs and Joint Ventures, though it does not apply to individuals.
The law utilizes an administrator who will act much like bankruptcy trustees do in U.S. bankruptcy proceedings. The administrator s role is to help the creditors and to assist in assuring the bankruptcy runs smoothly. The law provides who may serve as an administrator and it is expected most administrators will come from the ranks of China lawyers and China acco

A common law spouse may be referred to a de facto wife or de facto husband: although not legally married, they live and carry-on their lives as if married.
A de facto government is one which has seized power by force or in any other unconstitutional method and governs in spite of the existence of a de jure government.

#Defamation Law Made Simple
Learn the basics of slander and libel -- the rules about who can say what without getting into legal hot water.
"Defamation" is a catch-all term for any statement that hurts someone's reputation. Written defamation is called "libel," and spoken defamation is called "slander." Defamation is not a crime, but it is a "tort" (a civil wrong, rather than a criminal wrong). A person who has been defamed can sue the person who did the defaming. (For in-depth information on defamation claims, check out Nolo's Defamation, Libel Slander section.)
Defamation law tries to balance competing interests: On the one hand, people should not ruin others' lives by telling lies about them; but on the other hand, people should be able to speak freely without fear of litigation over every insult, disagreement, or mistake. Political and social disagreement is important in a free society, and we obviously don't all share the same opinions or beliefs. For instan

#Defamation law
defamation
Defamation is a statement that injures a third party's reputation. The tort of defamation includes both libel (written statements) and slander (spoken statements).
To win a defamation case, a plaintiff must show four things: 1) a false statement purporting to be fact; 2) publication or communication of that statement to a third person; 3) fault; and 4) damages. or some harm caused to the person or entity who is the subject of the statement.
Since the U.S. Supreme Court's 1964 decision in New York Times v. Sullivan . defamation claims have been limited by First Amendment concerns. Thus, for instance, public officials and public figures (people who are famous) must show that statements were made with actual malice to recover in an action for defamation. Actual malice means that a statement was made with knowledge that it was false or with reckless disregard of whether or not it was false. In addition, a plaintiff must show

The study of business law is where legal topics such as contracts and intellectual property collide with business subjects like bankruptcy and banking. In today s global economy, this discipline often has an international focus that is especially relevant to foreign-trained lawyers with interest in financial and commercial law in a transnational context, though business law may also pertain to different state business and legal practices.
At the graduate school level, there are many entry-points into business law. A joint JD/MBA program, for instance, will attract students looking to earn both a law degree and a business degree. A Master of Laws (LL.M) with a focus in business law, on the other hand, usually is geared towards students who already have their JD and are practicing attorneys who want to expand their business knowledge. There are also master s degrees that do not require a JD, but may be geared towards students with a business background looking to gain more leg

What is Domestic Violence Law?
Domestic violence law provides the criminal rules for punishing those who cause emotional or physical harm to others with whom they share a family or other close relationship. It also deals with the civil protections available to victims of this type of harm. Federal legislation has been enacted making domestic violence a crime, most notably the Violence Against Women Act (VAWA). However, the vast majority of domestic violence offenses are prosecuted under state law.
Convictions for domestic violence in all states require that the defendant?s conduct and relationship to the victim meet certain standards. The statutory provisions describing these aspects of the crime differ from state to state, but generally, both the conduct and the relationship are defined broadly.
For example, a typical state statute will prohibit any conduct that causes harm to the victim, or poses a threat of harm that puts the victim in immediate, re

A civil right is an enforceable right or privilege, which if interfered with by another gives rise to an action for injury. Examples of civil rights are freedom of speech, press, and assembly; the right to vote; freedom from involuntary servitude; and the right to equality in public places. Discrimination occurs when the civil rights of an individual are denied or interfered with because of their membership in a particular group or class. Various jurisdictions have enacted statutes to prevent discrimination based on a person's race, sex, religion, age, previous condition of servitude, physical limitation, national origin, and in some instances sexual orientation.
The most important expansions of civil rights in the United States occurred as a result of the enactment of the Thirteenth and Fourteenth Amendments of the U.S. Constitution. #Paralegal Certificate, Certification and Certified: What - s the Difference?

The easy way to remember it is that schools do not offer certification they offer certificates; having a certificate or degree can lead to being certified or attaining certification. In other words, the certificate or degree comes first. Certification requires taking qualification exams through state agencies or paralegal associations, along with meeting any other educational or professional guidelines mandated by the certificate-granting association, state or agency. For example, two national professional associations that offer a paralegal (or legal assistant) certification credential are the National Association of Legal Assistants (NALA) and the National Federation of Paralegal Associations (NFPA

#Deportation laws
Deportation (also called "removal") occurs when the federal government formally removes an alien from the United States for violations of a number of immigration or criminal laws, described in more detail below. Once deported, an alien may lose the right to ever return to the United States, even as a visitor.В
Removal is a legal proceeding, and an alien who is subject to this procedure has legal rights prior to being removed from the country, including the right to challenge the removal itself on procedural or constitutional grounds. Following is a discussion of the removal process.
Classes of Deportable Aliens
Any alien that is in the United States may be subject to deportation or removal if he or she:
- Is an inadmissible alien according to immigration laws in effect at the time of entry to the U.S. or adjustment of nonimmigrant status;
- Is present in the U.S. in violation of the Immigra

Some people don t know if they want to be a lawyer, but they want to study law because it interests them as an academic subject. For these people, choosing to study a law degree is easy.
For others, while they may wish to practice as a lawyer, they face a choice between studying a law degree or studying a non-law degree and then completing a conversion course (the Graduate Diploma in Law/Common Professional Examination).

While three-year law degrees at brick-and-mortar schools are traditional, they’re not for everyone.
The programs are expensive, time consuming and some restrict fulltime students from working more than 20 hours a week or at all at an outside job.
Luckily, there are other options for obtaining a law degree and it’s online.
Recently, online law degrees have gained more clout and popularity as they’ve become better established and continually appealed to students because of their low price and flexibility.
Consider the following:
- In the last seven years, the number of people taking online courses has more than doubled to 3.9 million, according to a survey.
- More than two-thirds of all higher education institutions now have some form of online courses.
- Among business leaders who are familiar with online degrees, more than four in five (83%) strongly believe online degrees are as credible as traditional degrees.

#Deportation Definition
The removal of a foreign national under immigration laws for reasons such as illegal entry or conduct dangerous to the public welfare.
Deportation is the unilateral measure by a government to expel an undesirable foreign national (alien ) usually for one of two reasons:
- He or she has since been discovered to have entered the host or deporting state illegally; or
- He or she, since their admission into the deporting or host state. has done something to disqualify him or her from staying.
Deportation differs from extradition and that it is a civil procedure and not a criminal procedure. In an extradition hearing, the ultimate destination of the individual is essential to the process. In the deportation hearing, the destination is not the focus of the hearing.
In Fong Yue Ting. the United States Supreme Court used these words:

There are a number of ways to get free legal advice and the method most suitable for you will of course depend on a number of factors.
A lot of the research can be done online. There are some areas where it is easier to obtain a free or low-priced legal advice than others. These areas include Health law, Human Rights, Prisoners' Rights, Civil Rights, Death Penalty, Consumer Law and Immigration and Asylum Law. If your problem does not involve these areas, don't despair. It doesn't mean that it will be impossible for you to get help, it just mean that it might take a little more research before you find it. There are a large number of lawyers providing free legal advice through different Pro Bono organizations and big portion of them is available online.
There are also legal firms who offer a ‘no win no fee' solution for their clients. The term is used rather freely and can therefore describe a number of different agreements. The basic idea of ‘no win no fee' is that i

#Dictionary of Legal Terms: Steven H. Gifis: 9780764139215: Books
Most Helpful Customer Reviews
47 of 47 people found the following review helpful
Format: Paperback
Barron's "Dictionary of Legal Terms" is a solid text. When I asked a law friend of mine which law dictionary I should purchase he told me that "Black's" was the best law dictionary out there. However, it is rather expensive at eighty or so dollars. Even the pocket version of the text is at least twenty dollars. So I sprang for this law dictionary at about eight dollars.
The only reason that I did not give this 5 stars is that it is not as complete as some of the other books that I looked at. This version has "more than 2500 legal terms" and the other books were all about 3000. However, I have not yet come across a word or jargon that I was unable to find in this book so I am not sure what the other 500+ words or phrases are.
Solid book. Highly recommended.

What is Wrongful Termination Law?
Wrongful termination law provides the rules for determining whether the firing of an employee was proper, and the remedies available if it was not. This area of the law is primarily concerned with violations of express or implied employment contracts. In other words, these cases focus on whether the employer was free to let the employee go, or if the termination was contrary to an agreement between the employer and the employee. While discrimination in the workplace based on sex, race, national origin, and other such characteristics can certainly lead to wrongful termination, those types of claims are usually classified as a separate legal topic known as Title VII law (because they are based on protections found in Title VII of the Civil Rights Act of 1964).
The ?Employment at Will? Doctrine
