#Juvenile justice
juvenile justice: an overview
Juvenile justice is the area of criminal law applicable to persons not old enough to be held responsible for criminal acts. In most states, the age for criminal culpability is set at 18 years. Juvenile law is mainly governed by state law and most states have enacted a juvenile code. The main goal of the juvenile justice system is rehabilitation rather than punishment.
Juveniles can be transferred into adult court if the juvenile court waives or relinquishes its jurisdiction .
State statutes creating juvenile courts and providing methods for dealing with juvenile delinquencey have generally been upheld by courts as an acceptable extension of state police power to ensure the safety and welfare of children. The doctrine of parens patriae authorizes the state to legislate for the protection, care, custody, and maintenance of children within its jurisdiction.
The federal role in the field has larg

The first step of the eviction process in Kansas is the delivery to the tenant of what is called a three-day notice. The notice advises the tenant that she must correct a lease violation or vacate the premises within the three-day period of time set forth in the notice. For example, if the notice is provided because the tenant failed to pay rent, she must pay the rent due and owing within the three-day period or move out of the property. If the tenant fails to comply with the provisions of the three-day notice, the landlord has the legal right under Kansas law to pursue an eviction lawsuit.
The second phase of the eviction process in Kansas is a forcible detainer case. Forcible detainer is an eviction lawsuit in the state of Kansas. A forcible detainer case is filed in the county or district court in the county where the rental property is located. The case is filed pursuant to the provisions of the Kansas limited actions law, found at Kansas Statutes Annotated, Chapter 61.

Harry s Law

Kathy Bates is not too happy about how NBC treated her legal drama Harry’s Law .
The actress, who will be starring on the next installment of FX’s American Horror Story this fall, went off on the network today during a panel at the Television Critics Association press tour, taking place this week in Los Angeles.
“I think [NBC] treated us like s–t,” said Bates, when responding to a question about whether or not she had reservations about returning to television. “They kicked us to the curb. I think they disrespected us, I think they disrespected our seven to 11 million viewers every week and I think they’re getting what they deserve.”
Later, Bates clarified that the cancellation of Harry’s Law in May 2012 left her stunned and hurt. “You know, it was just a real difficult emotional thing,” she said. “Going to wo

A Law degree is an academic degree conferred for studies in law. Such degrees are generally preparation for legal careers; but while their curricula may be reviewed by legal authority, they do not themselves confer a license. A legal license is granted (typically by examination) and exercised locally; while the Law Degree can have local, international, and world aspects- e.g. in Britain the Legal Practice Course is required to become a British solicitor [ 1 ] [ 2 ] or the Bar Professional Course (BPTC) to become a barrister. The first academic degrees were all law degrees- and the first law degrees were doctorates. The foundations of the first universities in Europe were the glossators of the 11th century, which were schools of law. [ 4 ] The first European university, that of Bologna. was founded as a school of law by four famous legal scholars in the 12th century who were students of the glossator school in that city. Employers have the option to offer benefits for short- and long-term disability income insurance, according to the Michigan Department of Energy, Labor and Economic Growth. These incomes are designed to pay employees enough to cover living expenses. Most short-term policies include a waiver of premium, where a patient's insurance premium costs are covered during short-term disability. Also, policies often contain an elimination period, which is a period of time that a patient must wait before he can claim disability benefits. In order to qualify, patients must remain totally disabled during the elimination period. The time of an elimination period is established by the policy.

#Landlord and Tenant Law - Real Estate Center
What is Landlord Tenant Law?
Landlord Tenant Laws regulate the relationship between one who owns real property (i.e. land, houses, buildings, etc.) and those to whom he or she gives certain rights of use and possession. Landlord tenant laws grew out of the English Common Law, and contains elements of both real property law and contracts, though most jurisdictions have added a number of more modern considerations, as well.
Residential and Commercial Leases
Many jurisdictions vary widely in their application of landlord tenant law based on the type of tenant. A residential tenant is one who seeks to take up personal occupancy in the premises for purposes of using it as a home. A commercial tenant is usually a business that takes up possession of the property for purposes of carrying on some form of commercial, retail, or industrial pursuit. The War on Drugs is terrible for taxpayers and users, because it treats a medical problem as though it were a criminal problem, filling our expensive prisons with millions of non-violent persons, and making violent persons out of non-violent persons. Yet we carry on with this war. This article by Benjamin Powell focuses on an economic analysis of the War, discussing the many other counterproductive aspects of the war. Here is an excerpt:
Prohibition also creates more problems for non-users. Because it increases the cost for addicts to support their habit, many resort to stealing in order to get their needed high. In a study of the U.S. drug war on Latin America, economist David R. Henderson estimated that if the same mark-ups applied to cocaine as to coffee, which would be roughly accurate with cocaine legalization, then cocaine’s price in the United States would fall by about 97%.[12] If cocaine and other narcotics lost the price premium caused by the drug war, few, if any,

TTT officially stands for Third Tier Toilet, which is the Third Tier in the US News Rankings. TTT is also applied to the Fourth Tier or any non-ABA schools. In general, these schools are said to have lower prestige and worse career prospects.
Since we are talking about TTTs, it wouldn't hurt to talk about another popular term: Top Tier. Top Tier is usually referred to as Tier 1 law schools in the US News. Many law schools (on their websites) refer to themselves as Top Tier if they are in Tier 1 (ranked 1-50 in the US News).
Some elitists also like to refer to the Top Tier as Top 10, Top 14, Top etc. It really depends on who you talk to. Most people like to include their own school in the Top Tier. For example, a ND Law grad may refer to the Top Tier as T25 or a Columbia Law grad may view it as the Top 10, while Georgetown Law grad Top 14.

Business productivity and worker quality of life are both shaped by developments in labor and employment law. NYU Law is unusual among the very top law schools in the size and quality of its full-time faculty in this field.
The Big Picture
Labor and employment lawyers work on complex legal matters that profoundly and directly affect the lives of real people. Disputes between employees and employers are pervasive in our society and collectively represent more than 20 percent of the caseload of the federal and state courts. These disputes touch on all elements of the employment relationship, involving workers as individuals, as members of protected groups (e.g. race, gender, age, disability), and as participants in collective action (e.g. unionization and collective bargaining). They arise under local, state, federal, and international laws that utilize the full range of legal rules and regulatory too

The Federal Labor Standards Act administers a standard set of labor law regulations for each state to follow. Under federal law, workers are not entitled to any breaks during the workday, including rest break or lunch breaks. However, several states grant general workday breaks or meal breaks, or even both types of breaks, to its employees. Arizona is not a state that requires employers to provide workday or lunch breaks.
The United States Department of Labor administers labor law rules and regulations that each state must follow. The labor department promotes safe working conditions for U.S. employees and helps employers by providing a standard set of guidelines they must follow through the Fair Labor Standards Act (FLSA).
Additionally, states may supplement these federal regulations with its own set of labor regulations, providing employees with additional work benefits and privileges. At a minimum, each state must require its employers to provide any FLSA benefits

The laws governing abortion are the most controversial in the United States today. The disunity among states regarding these laws, particularly those that define a legal abortion, reflects society s conflicting views toward abortion.
Abortion laws, as treated here, contain three main parts: a definition of an illegal abortion, a definition of a legal abortion, and a section dealing with consent and/or notice. There are also sections dealing with the penalties for violating the laws, residency requirements, waiting periods, and abortionists licensing requirements. These sections are impossible to compare. Because the Supreme Court through inconsistent rulings has caused the laws regulating abortion to be so unsettled, many state legislatures are not enacting any legislation pending the outcome of various lawsuits and federal legislation. Therefore, waiting periods, spousal notification, and other particulars mentioned below are not separately treated because the Cour

#President Ford Signing ERISA of 1974
President Ford Signing ERISA of 1974
Statement by President Gerald R. Ford Upon Signing the Employee Retirement Income Security Act of 1974
September 2, 1974
Dramatic growth in recent years has thrust private pension plans into a central role in determining how older Americans live in their retirement years.
From 1960 to 1970, private pension coverage increased from 21.2 million employees to approximately 30 million workers. During this same period, assets of these private plans increased from $52 billion to $138 billion. And they are now increasing at a rate of $12-15 billion a year. It will not be long before such assets become the largest source of capital in our economy.
Yet, this same growth in pension plans has brought with it a host of new problems. Many workers have ultimately lost their benefits - even after relatively long service - because when they left jobs, they thereby gave up ri

#Land Use and Zoning Law.
Zoning is the term used for designating permitted uses of certain parcels of land by local governments. The word is largely self-explanatory: the local government will designate various zones for different uses of land, such as industrial, agricultural, commercial, and residential. Zoning is also frequently used to designate the types of buildings that can be erected in a particular area, such as high density housing, highrises, maximum height restrictions, etc.
The primary philosophy behind zoning regulations is to separate different, incompatible property uses. For example, keeping large, smoke producing factories away from residential neighborhoods. However, in many instances, variances, or exceptions to the zoning rules, are possible. For example, a small residential variance might be granted to allow for a home in an industrial zone to house the night watchman. Usually, variances are granted because of some perceived hardship caused by

#To ask for money or vouchers for kids B'Day this year?
UpsyDozy Mon 17-Oct-11 12:29:03
We have 2 birthday parties coming up in the next 2 weeks, DCs are 7 and 5. We are inviting their whole class from school to each party which equates to 40+ presents! To be honest we don t really have the room for yet more plastic toys that will be played with for a day or two and then forgotten.
As a parent, would you be annoyed if I politely requested just a voucher for the local toy shop (no more than a fiver I was thinking) rather than a gift?
I was thinking it may save poor parents the drudgery of trawling round the toyshop looking for something and also might save money as I know from experience generally the half decent looking presents average out at around 10-12 which is a lot of money when you re looking at attending 15 or so parties in a year per child!
That way I can then take the kids to the shop and they can choose something they

Sookie’s biggest crisis comes when she realizes that her “people” aren’t actually who she thought they were. How does Sookie’s discovery of her true family affect her identity? How does your own heritage affect your identity?
2.Though Sookie tells us that Lenore’s nickname, “Winged Victory,” came from the way she entered a room—as if she were the statuesque piece on the hood of a car rushing in—how might “Winged Victory” reflect Lenore’s personality in other ways? #questions asked in an interview
#Your interviewer shouldn’t be the only inquisitor in the room.
Faced with one pointed question after the next regarding your career, a job interview can quickly take on the feel of an interrogation.
But employers aren't the only ones who get to poke and pry during the sit-down. At some point, job candidates can make inquiries that flesh out everything from expectations to why their prospective boss enjoys working for the company. By asking thought-provoking questions, you can not only collect valuable information but also distinguish yourself from the pack.
It means that you're thoughtful about the process and that you're very interested in the position because you took the time to think of questions that would be substantive, says Cheryl Palmer, a career coach and founder of the career coaching firm Call to Career.
Here are some questions you can ask and tips for interpreting the responses from your interviewer.
