‘Commercial Law’ is a broad term used to cover a wide range of legal services designed to support businesses in making money out of their products and services. Intellectual property rights are crucial for creative industries such as publishing and fashion in particular, but also for manufacturers, in order to profit from innovation. Sales of all kinds, on a domestic and international basis, are contracts – meaning lawyers are needed. Specific arrangements – agency or distribution agreements – can be made to sell the goods or services more widely.
Except in smaller firms, there is no such thing as a ‘commercial lawyer’, except in the sense that the term covers all lawyers whose clients are businesses rather than individuals. Every commercial lawyer will have a specialist practice area (e.g. Intellectual Property) or industry focus(e.g. Technology, Media Telecoms).
A lot of the day to day work tends to involve drawing up a wide range of commercial agreements, as well

Among the many legal issues presented by the Internet, privacy is a leading problem. In fact, Internet privacy covers a broad range of concerns: fears about the safety of children in chat rooms and on the World Wide Web, the privacy of e-mail, the vulnerability of web users to having their Internet use habits tracked, the collection and use of personal information, the freedom of people to chat and post messages anonymously. Moreover, the rapid evolution of the Internet has frequently brought such privacy concerns before lawmakers and the courts.
Privacy concerns are frequently newsworthy. During the 1990s, child safety advocates highlighted special online dangers for children following high-profile abuse cases. Internet commerce has also been affected, too. The Federal Trade Commission (FTC) report noted in 2000 in its annual report to Congress that survey data demonstrated 92% of consumers are concerned about the misuse of personal information online. BLACK LAWS. Slavery was not legal in Ohio, but the state legislature tried to discourage settlement of free blacks in the state through "black laws," which imposed constraints on black residents. Ohio enacted laws in 1804 and 1807 compelling registration of all African Americans in the state, requiring that they show proof of freedom, forbidding any free black to remain without giving $500 bond against his becoming a public charge, and denying validity to an African American's testimony in trials where whites were involved. The legislature imposed even more restrictions in the 1830s. However, in the legislative session of 1848–1849, a coalition led by the Free Soil Party repealed most of the restrictions.

#Family law: area of practice
Trainees in family teams tend to gain responsibility more quickly than in other seats, and may be expected to conduct some minor advocacy.
Family law covers a range of issues including divorce, civil partnerships and issues relating to children. Another aspect is contentious probate issues, in which claims by spouses are made against their deceased spouse’s estate. Clients may also be advised on wealth protection tools such as cohabitation agreements and marital property agreements. International law is relevant and has practical application in family law.
Mediation and the media
There is an emphasis on mediation in accordance with the Family Procedure Rules 2010. Solicitors advise their clients through this process.
Much of the work in divorce cases involves obtaining disclosure of a person’s finances, forensically considering the disclosure and negotiating financial settlements for clients. Parties in a dispute have

Initially, the notion of an online doctoral degree sounds odd to many of us who are older than the so-called Millennium Generation. We wonder how an online environment can reproduce the rich traditional graduate education. The truth is that some doctoral programs may never go fully online; factors such as certain
types of research requirements in chemistry and medicine, for instance, prohibit a 100%-online program. However, many traditional doctoral programs can easily be converted to distance learning formats. For more information, read our answers to the frequently asked questions below.
Which doctoral degrees are available?
People usually equate a doctorate with a Ph.D. and it’s true that the Ph.D. – or Doctor of Philosophy – is the most common doctoral degree. Still, some additional degrees include: the Doctor of Arts degree (D.A.), which typically emphasizes teaching a certain college subject; the Doctor of Divinity degree (D.D.), which

#Fact Check: Is Seattle s mayor kowtowing to Sharia law? Jason Rantz
Is Sharia law creeping into Seattle rule of law? Is it taking over the city of Seattle?
I got an email from a listener asking me to take a look and I thought it would be a perfect issue to put through the Jason Rantz Show fact checker.
So I received an email from someone sending me to an article in the Puget Sound Business Journal asking me to check it out and see if there's anything fishy going on.
The article is titled "Seattle mayor offers plan to help followers of Sharia law buy houses."
Is this a case of Sharia law creeping into our lives?
No, it's not. Just because it says Sharia law and just because it accommodates Sharia law, it doesn't automatically mean it's a bad thing we need to be scared of.
So this week we saw the affordable housing committee in Seattle release recommendations on how to bring to the city cheaper housing. Most of the suggestions are pret

Elder abuse laws are those laws aimed a preventing the abuse of elders, either by professional caregivers or private citizens. Such laws also provide penalties for those who engage in abuse of the elderly. Every state has elder abuse laws in addition to those issued by federal authorities.
Some states may have different standards and penalties for elder abuse depending on the caregiver. Standards tend to be stricter for elder care facilities and professional workers as opposed to those applied to informal caregivers (such as a friend or relative). This is to prevent the occurrence of institutional abuses, such as when an elderly care home has deficient health care policies.

If you fail to make your car payments or otherwise default on your loan, you risk having your car repossessed by your lender. Read on to learn more about how car repossessions work, how to avoid them, and what your options are if your car gets repossessed.
When you finance or lease a car you normally give the lender a security interest in the vehicle. Every state has its own rules regarding repossession but having a security interest generally means your lender can repossess the car without notice if you default on the loan. Many things can constitute a default but the most common reasons are not making timely loan payments or not having car insurance.
In most states, car lenders can seize your vehicle without prior notice if you are in default. However, they cannot breach the peace while they do it. Breaching the peace usually means using or threatening to use physical force against you to take the car back. But it can also simply involve repossessing the car fr

Since the Great Recession millions of Americans have found themselves in dire financial straits. While filing bankruptcy is often the last resort, many have been left with no other choice.
Bankruptcy can be a devastating move, both financially and psychologically. You are unable to borrow money or use a credit card. Your credit score may be lower than your age. But there is life after bankruptcy.
When the University of Arkansas School of Law set up a program for law students to work with consumers who have filed for bankruptcy protection, one fact quickly became clear. These consumers waited too long to act.

Terms of employment are often governed by contract law. When an employee has an employment contract, chances are that the contract says something about how the employee can and can't be fired. Most employment contracts only allow an employee to be fired for "good cause", which can seriously limit an employer's ability to deal with a troublesome employee. If the employee has an express written contract, then staying on the right side of the law is fairly simple -- just abide by the terms of the contract. Employment contracts come in many other flavors, however, and knowing whether you're complying with them or not can be difficult.
Contracts don't have to be in writing to be valid under the law. If you promise an employee during the interview that you won't fire them "unless there's a good reason", you've probably established an oral employment contract. Even a casual conversation can be the basis for an oral employment contract, which means that employers have to be very car

#Fake service dogs: Pet owners exploit ADA loophole - Federal Way Mirror
In this file photo from a 2008 report, a pitbull is seen working as a service dog for a local woman who says she suffers from recurrent seizures. Shown wearing a pink service dog coat, the pitbull is a constant companion who alerts the woman if she shows signs of a seizure, she said.

When is a service dog not a service dog?
By definition, service dogs are trained to perform specific tasks for people with disabilities. Service dogs assist people with physical and mental impairments, whether by guiding the blind, pulling a wheelchair or alerting an owner to an impending seizure.
However, some pet owners bring their non-service dogs into public establishments like restaurants and grocery stores — and easily get away with it.

Landlord-tenant law governs the rental of commercial and residential property. It is composed primarily of state statutory and common law. A number of states have based their statutory law on either the Uniform Residential Landlord And Tenant Act (URLTA) or the Model Residential Landlord-Tenant Code. Federal statutory law may be a factor in times of national/regional emergencies and in preventing forms of discrimination.
The basis of the legal relationship between a landlord and tenant is grounded in both contract and property law. The tenant has a property interest in the land (historically, a non-freehold estate) for a given period of time. See State Property Statues. The length of the tenancy may be for a given period of time, for an indefinite period of time, (e.g., renewable/cancelable on a month to month basis), terminable at any time by either party (at will), or at sufferance if the agreement has been terminated and the tenant refuses to leave (hold

Most Common Immigration Law Issues:
- Citizenship
- Permanent Visas or Green Cards
- Removal or Deportation
- Temporary Visas
An immigration marriage is when a non-citizen (immigrant) gains U.S. citizenship by marrying an American citizen. Most immigrant spouses first enter the country through a fianc visa (K-1 visa) or a permanent visa. The fianc visa allows a non-citizen to enter the country to marry his or her fianc , while the permanent visa is intended for non-citizens who have already married an American citizen. The permanent visa, a conditional green card, allows the immigrant to remain in the U.S. while he or she goes through the full green card application process.
A fianc visa can be obtained by getting married to a U.S citizen. If a non-citizen wants to be eligible for a fianc visa, they do not even have to intend to live permanently in the United States after the marriage. The option to stay in the United States and

#Pastor Bill Owens Urges Christians to Stand Against Gay Marriage by Refusing to Obey Unjust Laws
(Photo: Facebook/Bill Owens) Rev. Bill Owens, the president and founder of the Coalition of African American Pastors.
The president of the Coalition of African American Pastors, the Rev. Bill Owens, is calling on Christians to not participate in gay marriage ceremonies by "refusing to obey unjust laws" in the wake of the U.S. Supreme Court ruling legalizing same-sex marriage.
Owens, who held a press conference in Dallas on Tuesday where he was joined by other prominent conservative leaders who support traditional marriage, said Christians in all areas of society should stand up and defend their constitutional rights.
"We are calling on Christians and people of faith in all areas of society, especially those in leadership positions, to refuse to obey unjust laws that have legalized same-sex unions, and to join our movement [called Real Marriage] that will take b

#Youth and Education Law Project
Overview
Education then, beyond all other devices of human origin, is the great equalizer of the conditions of men, the balance-wheel of the social machinery.
-Horace Mann (1796-1859)
Stanford Law School students who have themselves typically had positive and rich educational opportunities have a long history of working with disadvantaged youth and their communities to ensure that they, too, have access to equal and excellent educational opportunities. As early as 1986, interested Stanford Law School students spent their time doing this critical, ground-breaking civil rights work at the former East Palo Alto Community Law Project.
Today, all students at Stanford Law School have the opportunity to engage in a dynamic blend of education law work such as school reform litigation, policy advocacy work, and direct client services through the Youth and Education Law Project, a part of the Mills

Did you know why the accessibility requirements in Section 508 of the Rehabilitation Act might not pertain to an educational institution but regulations from Section 504 of the same Act would?
The following sections cover key US laws pertinent to web accessibility. This information will help you understand the conditions under which you must create web content that is accessible to individuals with disabilities under US law.
The information provided here should not be inferred to be legal advice. Anyone questioning legal obligations for their web site should consult with an attorney. None of the WebAIM staff are attorneys and the information contained here is intended to be broad and gen

What is Tax law? It covers the rules, policies and laws that oversee the tax process, which involves charges on estates, transactions, property, income, licenses and more by the government. Taxation also includes duties on imports from foreign countries and all compulsory levies imposed by the government upon individuals for benefit of the state.
The intricate body of tax law covers payment of taxes to a minimum of four levels of government, either directly or indirectly. Indirect taxes are assessed against products and services that are meant to be consumed, but are paid to an intermediary. For example, when you buy coffee at a local corner store, the retailer charges you tax on your coffee, which he/she subsequently pays to the government. Direct taxes are those you pay directly to the government and are imposed against things like land or real property, personal property, and income.
There is a seemingly endless list of entities that create and enforce tax

#Family Law Lawyers - Compare Top Family Law Attorneys
Dealing with family law issues?
Family law generally concerns domestic relations and family-related matters such as marriage, civil unions, domestic partnerships, adoptions, paternity, guardianships, domestic abuse, surrogacy, child custody, child abduction, the dissolution of marriage and associated issues. Each state has its own set of family laws, and traveling across state borders can sometimes affect your rights and those of your family.
Contrary to popular belief, seeking the advice of a family law attorney does not necessarily mean that something is amiss in your family. A family law attorney can help negotiate prenuptial/premarital agreements for clients in anticipation of marriage or advise same-sex couples on relevant legal issues affecting their relationship. They also can help with adoption proceedings and other procedures involving children.
Family law attorneys often do represent clients se

Schools, colleges, universities and tutoring centers often fill online teaching positions from current or local faculty. Others will post job descriptions specifically seeking a specialized instructor in a dedicated subject or education line. The best places to look for an online teaching position are online. When visiting job search sites, use the search terms: online instructor, online teacher and online adjunct or distance learning instructor. You may replace instructor with tutor if you are seeking a tutoring position to supplement your income.
Teaching online at the university or college level requires applicants to be at least one full degree higher than the level of student they will be teaching. For example, at local community colleges that offer a distance learning option, applicants must have a bachelor's degree or higher as well as teaching credentials in the state they are applying to teach in. For four year universities or colleges, applicants must have a master

Laws at the municipal level regulating the uses of real property in certain areas. For example, land in a certain area may be zoned only for commercial use or residential use. Zoning laws exist to improve the quality of life in a local area; for instance, they guard against an oil refinery being placed in an area where families with children live. Depending on the laws of the municipality, zoning laws may be suspended at certain times for certain developments, especially those likely to result in an economic boon for the community.

"Right-to-work" laws are derived from legislation forbidding unions from forcing strikes on workers, as well as on legal principles such as "liberty of contract," which as applied here sought to prevent passage of laws regulating workplace conditions. [2]
Strictly speaking, right-to-work laws exist only in the United States. The Taft-Hartley Act of 1949, which banned "closed shops" where workers must be members of the union that represents them, also gave states the option to ban "agency shops," where workers do not have to be members but must pay a "fair share" fee to the union to cover the cost of representing them.
Right-to-work laws exist mostly in red states. The exact number of states with right-to-work laws vary depending on who's counting. According to the bipartisan National Conference of State Legislatures, 24 states and the U.S. territory of Guam have adopted right-to-work laws. [3] The first to adopt such laws was Florida in 1943.

L oth to be outdone by accountants in the arena of spoiling fun, the legal profession has responded to KPMG's work-while-you-study initiative by launching an intensive, two-year undergraduate law degree.
The shortened LLB course unveiled this week by the College of Law (CoL) – a private charity originally set up by the Law Society – will shave a third off the time it takes to complete a traditional law degree.
The move follows similar ventures by other private colleges – including the CoL's rival, BPP Law School – which introduced a compressed law degree last year. These courses, which cost in the region of 9,000 per year, have been aimed at mature and overseas students to date. But impending undergraduate fee rises mean they may appeal to school-leavers as a way of saving a year's tuition costs, plus living expenses.
There is a question, however, about how extensive the savings will prove in practice. Conscious of the demands of doing a full degree in two ye

#Federal Labor Laws For Salaried Employees
While labor laws are designed to afford the same sorts of protections and benefits to all American workers, the implementation of these protections differs depending on whether someone is paid on an hourly or salary basis. Hourly workers are protected by federal minimum hourly wage standards with overtime pay equal to "time and a half." The laws around salary workers are similar but take on their own unique flavor.
Categories of Federal Labor Laws
There are four basic protections involved in salaried employee labor laws. These are:
- Hours Worked
- Late Days
- Vacation Sick Days
These make up the backbone of the American system of worker protection
Federal Laws about Hours Worked
If you are paid a salary rather than an hourly wage, you must work the number of hours agreed upon in your employment contract to receive your salary. While 40 hours per week is consi

At Hanne Co, we encourage communication rather than confrontation and we always consider the needs of the whole family, particularly the children. The Supreme Court's decision in the 1972 case of Roe v. Wade was -- and is still -- the most important decision affecting abortion in the United States. Roe made it possible for women to terminate their pregnancies for virtually any reason within certain gestational time limits.
Since Roe, abortion has come under scrutiny by lawmakers and abortion opponents who have pushed for stricter abortion laws over the past several decades. For instance, the 1992 case of Planned Parenthood v. Casey upheld a woman's right to legal abortion, but imposed state regulation of other aspects of abortion such as 24-hour waiting periods, informed consent requirements, parental consent provisions, and a record keeping mandate.
Although legal abortion still carries, the future of abortion leans toward stricter boundaries that seem to chip away at the essential holding of Roe.
Below is a summary of abortion laws that arguably limit a woman's right to have an abortion. For state-spe

Guide to Parental Rights & Obligations
What is Family Law?
Family law consists of a body of statutes and case precedents that govern the legal responsibilities between individuals who share a domestic connection. These cases usually involve parties who are related by blood or marriage, but family law can affect those in more distant or casual relationships as well. Due to the emotionally-charged nature of most family law cases, litigants are strongly advised to retain legal counsel.
The vast majority of family law proceedings come about as a result of the termination of a marriage or romantic relationship. Family law attorneys help their clients file for separation or divorce, alimony, and child custody, visitation, and support. Spouses married a short time may seek an annulment, and special rights may exist between same-sex couples. The division of property at the end of a marriage is also a common issue in family law cases.

#FBI - Overview
Hate Crime Overview
Investigating hate crime is the number one priority of our Civil Rights Program. Why? Not only because hate crime has a devastating impact on families and communities, but also because groups that preach hatred and intolerance plant the seeds of terrorism here in our country.
Defining a Hate Crime
FBI Jurisdiction
A hate crime is not a distinct federal offense. However, the federal government can and does investigate and prosecute crimes of bias as civil rights violations, which do fall under its jurisdiction. These efforts serve as a backstop for state and local authorities, which handle the vast majority of hate crime cases. A 1994 federal law also increased penalties for offenses proven to be hate crimes.
In 2009, the passage of a new law the first significant expansion of federal criminal civil rights law since the mid-1990s gave the federal government the authority to prosecute violent ha

Child labor law, enacted by the Federal Government, restricts when children can work and what jobs they can do. Teens hired for nonagricultural employment (which is just about everything other than farm work) must be at least fourteen. Other child labor law restrictions, regulating the type of positions young workers can hold and the type of work they can do are also in effect.
Once a youth reaches 18 years of age, he or she is no longer subject to the federal youth employment and child labor law provisions.
16 and 17 Years of Age
Sixteen- and 17-year-olds may be employed for unlimited hours in any occupation other than those declared hazardous by the Secretary of Labor. Examples of equipment declared hazardous in food service establishments include power-driven meat processing machines (meat slicers, saws, patty forming machines, grinders, or choppers), commercial mixers and certain power-driven bake

In most instances, a child has to be 14 years old or older before beginning employment. Strict labor laws prohibit children 13 and younger from working in most capacities. This prevents them from being overworked or placed in hazardous situations.
However, children are allowed limited work experiences in newspaper delivery and babysitting. They can work in a business or farm that is owned or operated by their parents. They can also work as actors in motion pictures, television, and theater or radio performances.
Teenagers can only work certain hours without violating labor laws. While individual states can maintain stricter rules than the federal government, there are many federal restrictions regarding teens who are 14 or 15 years old.
The teenagers in this age bracket can only work between the hours of seven in the morning and seven in the evening. The only exception to this occurs between June 1 and Labor Day, when teenagers are allowed to work until nine

Law clerks assist attorneys or judges in researching or preparing legal documents. They may also provide assistance in the courtroom, attend oral arguments, write draft opinions and orders, organize trial exhibits, prepare the judge s bench, and supervise other judicial interns.
Law clerks are almost always recent law school graduates, or sometimes experienced attorneys. The main reason that lawyers desire to complete a clerkship is to gain valuable experience that they will use in their own law practice.
To become a law clerk, an individual must submit applications to judges, who select them from a pool of applicants. Law clerks are needed in state trial courts, state appellate courts, federal trial courts, federal appeals courts, and also in specialty courts. Clerkships typically last one or two years, although clerkships in the U.S. District Courts last for five years. Career clerks may be employed by a particular judge or court for many years.

#Patent Law in the United States (Bitlaw)
Patent Law in the United States
Patents have been in the news recently as Amazon.com and other Internet companies have used patents to obtain monopoly rights in certain inventions. Although many object to anyone having a monopoly on an idea or invention, such monopoly rights have always been a fundamental part of the patent system.
The importance of granting monopolies for new inventions has been recognized in the United States since the adoption of the U.S. Constitution. In Article I, section 8, the U.S. Constitution:
Congress shall have power. To promote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries.
Patents in the United States are governed by the Patent Act (35 U.S. Code), which established the United States Patent and Trademark Office (the USPTO). The most common type of patent is a utilit

Chicago’s Booth School of Business, Michigan’s Ross School, Brigham Young’s Marriott School, and the University of Arizona’s Eller School of Management.
If you’re wondering where Harvard, MIT, Berkeley and Wharton are, they didn’t make the top 25. There’s the Acton School of Business in Texas which is ranked 11 th by Princeton Review and Entrepreneur. And there’s the University of Southern Florida’s Business School which is ranked 25 th. #Federal judge strikes down Arizona immigration law - LA Times
U.S. District Court Judge Susan Bolton said in her Friday ruling that the state law was preempted by the U.S. government s authority to enforce immigration laws, dealing another legal blow to Arizona s controversial efforts to give local and state law enforcement more muscle to combat illegal immigration.
The smuggling law, passed in 2005, was designed to prosecute those trafficking people into the country. The law was modified by the controversial SB 1070, which expanded the ability of local authorities to stop people suspected of being in the country illegally.
In her ruling, Bolton said the state law imposes additional and different state penalties than federal law; it divests federal authorities of the exclusive power to prosecute these specific smuggling crimes; and criminalizes conduct not covered by (federal law) because it does not contain a safe harbor exception for religious activities like the

Yup your big girl still needs a boost, and will til she s 4 9 tall, according to booster car seat laws. The booster seat s job is to ensure that your car s safety belts fit your child correctly. The lap belt needs to fit snugly across her upper thighs, and the shoulder belt should go across the middle of her chest (without cutting into her neck, slipping over her shoulder, or being slipped under her arm). This won t happen without a booster until she reaches that magic 4 9 height. For most kids, that s somewhere around age eight but sometimes it s even later than that. Keep in mind that a lap/shoulder belt alone won t keep her safe in a crash and could put her at risk for serious injuries.
First off, every child should say snug in a car seat and facing the rear as long as possible, until she's at least two years old. When she reaches the upper weight limit (30 to 35 pounds) or her head hits less than an inch from the top of the seat, it's okay to face the car seat f

#Fired attorneys withdraw from representing Tamir Rice estate in lawsuit, court records show
CLEVELAND, Ohio — Three attorneys who were representing the estate of 12-year-old Tamir Rice in a lawsuit against the city of Cleveland stepped down Friday, according to a court filing from the estate's new attorneys.
Attorneys Benjamin Crump sent a letter of resignation Friday on behalf of himself, Daryl Parks and Walter Madison, the filing shows. It also shows that the lawyers still represent Leonard Warner, the boy's father, in the wrongful death lawsuit.
New York law firm Emery Celli Brinckeerhoff Abady and Cleveland attorney Subodh Chandra now represent the estate. Administrator Douglas Winston hired the team after Tamir's mother, Samaria Rice, retained them as counsel.
The court filing asks Chief U.S. District Judge Solomon Oliver Jr. to appoint the firm of Emery Celli Brinckeerhoff Abady and Chandra as the new lawyers representing the estate in the lawsuit.

#Federal Labor Laws
Learn about the federal laws that regulate the relationship between management and unions.
The federal laws broadly regulating unions —and the amendments to those laws—have dramatically changed the look and function of unions over time. The changing laws have also acted as political mirrors, alternately protecting employees from unfair labor practices and protecting employers from unfair union practices as unions’ influence in the workplace has ebbed and flowed.
The National Labor Relations Act
Labor unions secured the legal right to represent employees in their relationships with their employers when the National Labor Relations Act (NLRA), passed in 1935. That federal act also created the National Labor Relations Board (NLRB) to police the relationships among employees, their unions, and their employers.
Under the NLRA, an employer may not:

how to find the right lawyer
How to find and hire a great lawyer
Do I need a lawyer?
What do lawyers do, exactly?
Lawyers (also called attorneys or counsel) serve as advocates for people and organizations. They represent clients both to the court and to opposing parties. Lawyers can represent clients in criminal cases, where a law has been broken, and in civil cases, in which one party is suing another.
Lawyers are also important partners in situations that don’t involve the courtroom, advising clients about their legal rights and obligations for personal or business issues. They are trained to interpret complicated systems of laws and navigate the court system.
What can a lawyer do for me?
First, a lawyer will advise you as to whether or not you actually need legal help. It’s not always obvious whether an issue is a legal matter or somet
