Child neglect is a form of abuse in which the caregiver fails to provide for the child in some way that could result in physical, emotional, psychological, or even educational harm. When most people consider mistreatment of a child, they think of active abuse - the caregiver hurting or perhaps molesting the child - but neglect is basically passive abuse. For example, it would be neglect for a parent to leave her young children at home without food for an extended period of time.

Neglect is by far the most common form of child mistreatment in the United States In fact, 78.3% of child maltreatment victims suffered neglect, as compared to 18.3% who suffered physical abuse and 9.3% who suffered sexual abuse. It can be incredibly dangerous. Over 2,200 children in the United States died of abuse and neglect in , and nearly 70% of those children died because of neglect. Surviving victims of neglect also experience many psychological issues over time, from attention and language def ... Read more »

There are several different types of degrees available that might be considered international law degrees. Typically, these sorts of degrees allow a lawyer to practice across country borders, and with multinational and international clients and entities. In order to help clear up some of the differences between them, below are descriptions of several relevant degrees. Each should be considered by a foreign practitioner looking to expand his or her practice internationally, especially through interaction with U.S.-based clients.

An LLM (Master of Laws) in International Law is a degree generally pursued by those who have already obtained a primary legal degree in their home country, and who want to increase their legal knowledge in the specific area of international law. Different programs may have different focuses, or students may be allowed to select courses of their choosing. For example, a student interested in international business might take classes on topics such as i ... Read more »

European Union law (historically called "European Community law") is a body of treaties and legislation, such as Regulations and Directives, which have direct effect or indirect effect on the laws of European Union member states. The three sources of European Union law are primary law, secondary law and supplementary law. The main sources of primary law are the Treaties establishing the European Union. Secondary sources include regulations and directives which are based on the Treaties. The legislature of the European Union is principally composed of the European Parliament and the Council of the European Union. which under the Treaties may establish secondary law to pursue the objective set out in the Treaties.

Ordinary legislative procedure

As a reporter it s crucial to understand the basics of libel and libel law. Generally speaking, the United States has the freest press in the world. as guaranteed by the First Amendment to the U.S. Constitution. American journalists are generally free to pursue their reporting wherever it may take them, and to cover topics, as The New York Times motto puts it, “without fear or favor.”

Rumor, innuendo and gossip are things hard-news reporters generally avoid (as opposed to reporters on the celebrity beat). Most importantly, reporters do not have the right to libel the people they write about.

In other words, with great freedom comes great responsibility. Libel law is where the press freedoms guaranteed by the First Amendment meet the requirements of responsible journalism.

What Is Libel?

Libel is published defamation of character, as opposed to spoken defamation of charac ... Read more »

Detained China human rights lawyer confesses: state media AFP 10 hrs ago

Tom Hancock

Beijing (AFP) - A prominent Chinese human rights lawyer has confessed guilt a week after being detained in a major crackdown on legal activists, state media said.

Zhou Shifeng is one of more than 130 lawyers detained or called in for questioning by state security bodies this month, according to tallies by rights groups.

The lawyer provided legal aid to families of children poisoned by milk powder from a powerful dairy firm, and this year defended an 81-year-old writer detained for criticising the ruling Communist party.

Zhou has reportedly not been able to meet a family-appointed defence lawyer. The official Xinhua news agency said late Saturday that he admitted guilt and pleaded for a second chance .

While three-year law degrees at brick-and-mortar schools are traditional, they’re not for everyone.

The programs are expensive, time consuming and some restrict fulltime students from working more than 20 hours a week or at all at an outside job.

Luckily, there are other options for obtaining a law degree and it’s online.

Recently, online law degrees have gained more clout and popularity as they’ve become better established and continually appealed to students because of their low price and flexibility.

Consider the following:

  • In the last seven years, the number of people taking online courses has more than doubled to 3.9 million, according to a survey.
  • More than two-thirds of all higher education institutions now have some form of online courses.
  • Among business leaders who are familiar with online degrees, more than four in five (83%) strongly believe online degrees are as credible as traditional degrees.

How Important is a College Degree?

In my opinion, the importance of a college degree is directly related to how far you want to go in aviation.  For example, Northwest will not consider an applicant without a four-year degree while other airlines may.  Just because an airline does not require a degree, doesn't mean that they are going to consider you on equal footing as a degreed pilot.  For example, American Airlines doesn't have a requirement for a four-year degree however, the average new-hire pilot has at least a bachelors degree (according to Air Inc ). At "least" having a bachelor's degree means that some applicants that were hired have advanced degrees like masters, doctorates, etc.

Many regional airlines will hire without degrees also, but that may be as far as you go career-wise and may never afford the chance to fly the "heavies".   Remember, the key is to be as competitive as possible in order to reach your goal in aviation.   While ... Read more »

#Deportation Definition

The removal of a foreign national under immigration laws for reasons such as illegal entry or conduct dangerous to the public welfare.

Deportation is the unilateral measure by a government to expel an undesirable foreign national (alien ) usually for one of two reasons:

  • He or she has since been discovered to have entered the host or deporting state illegally; or
  • He or she, since their admission into the deporting or host state. has done something to disqualify him or her from staying.

Deportation differs from extradition and that it is a civil procedure and not a criminal procedure. In an extradition hearing, the ultimate destination of the individual is essential to the process. In the deportation hearing, the destination is not the focus of the hearing.

In Fong Yue Ting. the United States Supreme Court used these words:

#Dictionary of legal terms

Definition of actus reus :

A person may incur criminal liability for failing to do that which the law requires him to do as much as by doing that which the law prohibits. The actus reus includes the state of affairs or circumstances surrounding the commission of the offence, together with the results or consequences (if any) that flow from that act or omission. It is essential that the defendant acted voluntarily and that he caused the injury, damage or harm.

In other words, actus reus includes all the elements of the offence indicated in the definition except the mens rea (the state of mind), if any.

Generally the accused's conduct must be a voluntary act or omission, and he will not be held liable for acts done in a state of automatism.

Automatism resulting from self-induced intoxication is no excuse.

The crime must be caused by some conduct by the accused.

That conduct n ... Read more »

There are many online workshops out there at different prices with different content. Back in , when I decided to offer an online learning option, I set out to create a structure that is similar to taking a "live" class from me.  My mission is to provide an affordable class with a learning environment that resembles what it would be like in a live class where you are watching lots of demos, learning techniques and projects and then creating on your own.

  • Most of my classes are set up either in 3 lesson (mini class) or a 5 lesson structure. Each lesson is typically a different topic which includes all kinds of projects and techniques.
  • My classes are a combination of video learning (with demos, techniques and me talking) and lots of photo steps outs of inspiration, techniques and process.
  • All classes are all filmed in my studio. Since I have been tweaking my gear and my process with the hope that video/photo content gets bet ... Read more »

#Disability legal definition of disability

Disability

The lack of competent physical and mental faculties; the absence of legal capability to perform an act. The term disability usually signifies an incapacity to exercise all the legal rights ordinarily possessed by an average person. The term is also used in a more restricted sense when it indicates a hindrance to marriage or a deficiency in legal qualifications to hold office.

The impairment of earning capacity; the loss of physical function resulting in diminished efficiency; the inability to work.

Federal civil rights laws provide protection from harassment that is based on a student’s, race, religion, gender, national origin, disability or color (StopBullying.gov ). Those laws do not cover LGBT youth being harassed due to their sexual orientation, but certain cases may overlap. For example, a male student who is being bullied for an effeminate nature, whether or not he is gay, has rights under this law.

The Harassment laws that provide protection to these groups include:

  • Title IV and VI of the Civil Rights Act (1964)
  • Title IX of the Education Amendments (1972)
  • Section 504 of the Rehabilitation Act (1973)
  • Titles II and III of the Americans with Disabilities Act
  • Individuals with Disabilities Education Act

This is (Indian) court. Nothing happens fast here.

Indian movies and novels, being influenced by the American pulp fiction, have always shown the courts as a place of enormous drama (and entertainment) whereas the reality is polar different at least in the Indian courts. For decades and decades, the Indian filmwaalas have shown the artificial, non-existing courts to the Indian audience on the silver screen. However in the year , the Indian courtroom dramas seem to have come of age through Jolly LLB.

Through the activities of a petty lawyer - Jagdish Tyagi, nicknamed as Jolly, the filmmaker has shown the courage of showing the real courtrooms of India. All the courtroom scenes are so realistic with the judge, the lawyers, the plaintiffs, the defendants, the cops, the witnesses, the court-staff; all appearing real and not filmy that it won t be an exaggeration to consider this movie as a landmark movie in the history of Bollywood. Immigration is regulated at the federal level, chiefly under the rules established in 1952 with the passage of the Immigration and Nationality Act (INA). The Immigration Reform and Control Act (IRCA) of 1986 was enacted to curb illegal immigration, denying welfare benefits to undocumented immigrants and strengthening sanctions against employers who hire them.

The U.S. Congress has control over all immigration-related regulations, while the White House is in charge of enforcing immigration laws.

The federal government's jurisdiction over immigration law has consistently been upheld by the U.S. Supreme Court, which has overruled attempts by state legislatures to single out immigrants. Additionally, the Supremacy Clause of the U.S. Constitution is generally interpreted to mean that federal laws trump state laws, except for certain matters constitutionally left to the states.

However, many states have passed legislation that limits undocumented immigrants' access ... Read more »

Many students choose to specialize in a specific area of law enforcement, with popular options including homeland security, terrorism, cyber security or federal law. After completing all of the law enforcement degree requirements, graduates can consider applying for work in the FBI, state or local police, or as a private investigator, security officer, park ranger or corrections officer.

There are many options, whether a student wants to earn a law enforcement degree online or on-campus. Students can learn an associate degree in law enforcement, for instance, or even an associate degree in criminal justice with a specialization in law enforcement. Bachelor's or master's degrees are not always required, but the Bureau of Labor Statistics reports that law enforcement professionals who have a degree have been in higher demand than those who don't. Students can also pursue a bachelor's or master's degree in a related field such as law enforcement intelligence and analysis, or fo ... Read more »

The Quran claims to be a clear document.

After a family tragedy, family members will be deeply saddened and must then allocate the inheritance. Let's assume a case where the deceased left $100,000,000. As the Quran is unclear, there are many potential allocations. The Quran does not mention who determines the allocation, and in many cases no allocation is mentioned. There can be huge disagreements, and greedy people may try to find ways to get all this money. The laws of inheritance are described via 4:11, 4:12 and 4:176. [1]

To summarize my understanding of these verses, an inheritance is allocated among children, parents, siblings, and wives. Below is a small sample of cases that the Quran does not adequately address:

    1. In some translations, 4:11 mentions 2 or more daughters, others mention more than 2 daughters.

    2. In 4:11 the Quran ignored the case of a deceased who only had sons.

    3. The case of daughters only but no parents was not menti ... Read more »

#Dog Bite Laws and Statutes of Limitations in the United States

If you've been attacked and injured by a dangerous dog, it's in your best interest to contact a lawyer as soon as possible. When you get a lawyer quickly, more evidence may be gathered to prove your case and the dangerous dog can be stopped before it has the chance to hurt anyone else.

    Preliminary Note:

Every state has different laws regarding a dog owner's liability for dog bites. Some states follow their common law. Other states have enacted statutory law in the form of Dog Bite Statutes. Most often, a Dog Bite Statute abolishes the common law, because, unlike the common law, these statutes don't require a dog bite victim to prove that a dog owner was at fault for an injury. In some states, however, people who have been injured by a dog are able to recover money damages under both the common law and their state's Dog Bite Statute. The following guide outlines state dog bite laws.

    #Divorce in Thailand

There are 2 types of divorces in Thailand. These are Contested Divorces which tend to be very costly and then there are Uncontested Divorces which are much cheaper and are normally called Administrative Divorces. Speak to a Divorce Lawyer in Thailand before signing any agreements with regards to your divorce in Thailand.

    Uncontested Divorce

    Contested Divorce

Contested divorce is judicial or court divorce. One party to the marriage is given recourse to go to the courts to end his/her marriage if any of the grounds provided under Thai law is attendant. This is usually availed of if there is a definite ground for divorce but only one of the parties is amenable to ending the marriage, or if one party has been absentee, and the absence has been a detriment to the other. Another reason to have this divorce is if there are disagreements on child custody and marital property sharing which the parties cannot settle by themselves, and the cour ... Read more »

    September 4, 5:00 am

The pro-Obama Super PAC Priorities USA has run a coordinated campaign to smear Mitt Romney’s character, even going so far as to suggest he was responsible for the death of a woman by cancer. That campaign has been financed in part by Steve and Amber Mostyn.

The wealthy Texas attorneys have contributed $1 million to Priorities USA, along with $500,000 to the Democratic House Majority Super PAC, according to the Center for Responsive Politics.

The Mostyns were some of the first people the Super PAC turned to earlier this year in an effort to finance its campaign of personal attacks on Romney, according to a New York Times report.

Priorities strategists Bill Burton and Paul Begala went to Key West, Fla. in April to meet the couple on Steve’s Italian-made, 60-foot-plus yacht—one of three he owns—and asked for a $1 million donation. Burton showed the Mostyns raw footage of prospective campaign ads on his iPad that later would ... Read more »

Copyright is a form of intellectual property protection provided by the laws of the United States (Title 17 of the United States Code) to the authors of “original works of authorship ,” including literary. dramatic. musical. artistic, and certain other intellectual works. Copyright protection wholly statutory. [2] There is no copyright protection except as provided by the current Copyright Act .

Much of the structure and basis for American law is derived from its British legal antecedents. After the introduction of the printing press in England [3] in the late 1400s, the Crown's first response was to control what writings were printed or copied. [4] The earliest British copyright laws were enacted in the 1500s to promote censorship by the government in cooperation with a monopolistic group of printers known as the Stationers' Guild. [5]

#Divorce Support - Indiana Property Division Factors

In Indiana, the property and debt issues are typically settled between the parties by a signed Marital Settlement Agreement or the property award is actually order and decreed by the Domestic Relations Court within the Final Dissolution of Marriage Decree.

Indiana is referred to as an "equitable distribution" state. When the parties are unable to reach a settlement, the Domestic Relations Court will take the following approach to dividing the assets; First, it will go through a discovery process to classify which property and debt is to be considered marital. Next, it will assign a monetary value on the marital property and debt. Last, it will distribute the marital assets between the two parties in an equitable fashion. Equitable does not mean equal, but rather what is deemed by the Domestic Relations Court to be fair.

It is presumed by the court that an equal division of the marital property between the parties ... Read more »

    • What if you do not make more money after MBA ?

What if I really do not make more money, is my degree going to be waste?  Let’s try to analyze the question and possibilities by using some math ! Imagine you are spending $60,000 towards your MBA in USA.  What is the Return on your investment for $60,000. When will you be break-even? When will you make more money from the MBA degree?

If everything goes well and you get a job promotion and make $5,000 more every year then it takes 12 years for you to break-even. ( I am taking a very minimum hike scenario, in reality you may get more, but for discussion let’s look at worst case scenario as base case ) . Even ... Read more »

    Alice G. Gosfield, JD

    Fam Pract Manag.  2003 Nov-Dec;10(10):27-33.

The Stark statute has generated confusion and anxiety among physicians. Such reactions are understandable given how easy it is to violate the law and how severe the penalties are. This article is the first in a two-part series intended to defuse the confusion. It explains what the Stark statute is, how it differs from the anti-kickback statute and how you can determine whether it applies to you. It also defines some of the key terms used in the statute, and describes the standards for meeting the group practice definition and how the definition applies to two of the most notabl ... A strong tradition of research at the UW and an environment that encourages interdisciplinary work support the dual degree programs. In addition, the Law School offers certificate programs that provide an opportunity for concentrated study, but do not involve an additional degree. Certificates are available in four subject areas: Health Advocacy, Environmental Law, Russian Area Studies, and International Law and Business.

#Education Requirements for Becoming a Lawyer

    Essential Information

Source: *U.S. Bureau of Labor Statistics

    Educational Requirements for a Lawyer

Aspiring lawyers must complete law school. Applying to law school requires graduating from a bachelor's degree program and, in nearly all cases, taking the Law School Admission Test (LSAT). Applicants wanting to specialize in a particular field of law may consider an undergraduate degree in that field. For example, students who want to become tax attorneys might study accounting, while those interested in environmental law may consider majoring in environmental science.

    Required Skills

While no particular field of study is required for applying to law school, aspiring lawyers should hone their reading, speaking and argumentation skills while in college. Courses in political science and English may help students advance these skills and provide a medium for presenting facts and arguing ... Read more »

    #Dual Degree Programs

    Main menu

To meet the challenges of practice in the 21st century, more lawyers find it imperative to more fully understand the interrelation of law and other disciplines.  To prepare students for these emerging opportunities, the Law School has developed five dual-degree programs that combine a superior legal education with graduate professional training in related fields. These programs allow qualified students to earn the J.D. and another degree more quickly than pursuing both degrees independently.

In all cases, students must gain admission separately to each school. Admission to one program does not guarantee admission to the other. After gaining admission to each school, students may apply to the dual-degree program.

The Law School offers the dual-degree programs in conjunction with certain University of Connecticut graduate schools. Students are encouraged to review the content in this section and to contact their Student Servic ... Read more »

"Harassment" refers to a broad number of behaviors that are subject to both criminal punishment and civil liability. On the criminal side, states have a wide variety of criminal laws forbidding harassment in many forms, including general harassment crimes as well as specific forms of harassment, such as stalking and cyberstalking.

Criminal harassment should not be confused with how "harassment" is often used in contexts such as workplace discrimination lawsuits. Federal and state laws ban discrimination against certain types of people in certain situations, such as at work or in housing decisions. In these non-criminal contexts, the victim can sue the harasser in a private civil lawsuit, alleging that the harassment constitutes discrimination.

On the other hand, criminal harassment is usually confined to state law. States vary in how they define criminal harassment. Generally, criminal harassment entails intentionally targeting someone else with behavior tha ... Read more »

    September, 2004; Last Reviewed Jan.

Due to the high cost of legal assistance, unless people are lucky enough to have insurance, there is a strong incentive to try to find cheap or free legal advice. Many people turn to online sources, such as legal websites, to try to obtain free legal counsel.

Some websites conflate legal advice and legal information , as if they are the same thing. They are not. There is a great deal of legal information available online, from a wide range of sources. Many of those sources are highly reliable, and offer analyses prepared by lawyers or government employees to assist people with a very broad range of legal problems.

But a document or FAQ on a legal subject, meant to provide a broad base of information to the public at large, is not legal advice . Legal advice is legal counsel tailored to an individual's specific situation and legal needs. For example, reading an informational document about your state's divorce procedure m ... Read more »

canon law , Latin jus canonicum. body of laws made within certain Christian churches ( Roman Catholic. Eastern Orthodox, independent churches of Eastern Christianity, and the Anglican Communion) by lawful ecclesiastical authority for the government of both the whole church and parts thereof and of the behaviour and actions of individuals. In a wider sense the term includes precepts of divine law, natural or positive, incorporated in the canonical collections and codes.

Although canon law is historically continuous from the early church to the present, it has, as a result of doctrinal and ecclesiastical schisms, developed differing, though often similar, patterns of codification and norms in the various churches that have incorporated it into their ecclesiastical frameworks. The canon law of the Eastern and Western churches was much the same in form until these two groups of churches separated in the Schism of 1054. In Eastern Christianity, however, because of d ... #Drugs and driving: the law.

It’s illegal to drive if either:

    • you’re unfit to do so because you’re on legal or illegal drugs
    • you have certain levels of illegal drugs in your blood (even if they haven’t affected your driving)

Legal drugs are prescription or over-the-counter medicines. If you’re taking them and not sure if you should drive, talk to your doctor, pharmacist or healthcare professional.

The police can stop you and make you do a ‘field impairment assessment’ if they think you’re on drugs. This is a series of tests, eg asking you to walk in a straight line. They can also use a roadside drug kit to screen for cannabis and cocaine.

If they think you’re unfit to drive because of taking drugs, you’ll be arrested and will have to take a blood or urine test at a police station.

You could be charged with a crime if the test shows you’ve taken drugs.

#Editor’s Preface - Ukranian Law Firms

The current environment in Ukraine is extremely challenging for doing business irrespective of whether these are foreign or national investors. All economic actors inside and outside of the country are waiting for the termination of the conflict in Donbass and speedy, comprehensive reforms. And these two words are hallmarks of every single political speech, business meeting or public discussion. But is the current Parliament capable for designing a responsive regulatory frame and corporate regime notoriously strong in investment protection both quickly and efficiently?

The rapprochement between the business sector and state is far from ideal but public inquiries prove this is the only way to revive the economy. As you can further examine in the Ukrainian Legal Market section, representatives of the legal business became subjects of political and government policies. The role of non-government initiatives and business a ... Read more »

Inheritance law governs the rights of a decedent's survivors to inherit property. Depending on the type of inheritance law your state has, a surviving spouse may be able to claim an inheritance despite what you may have written into your will. Whether a state follows community property laws or common law determines how inheritance law affects the distribution of a married decedent's estate. The following are community property states: Arizona, California, Idaho, Nevada, New Mexico, Texas, Washington, Wisconsin, and Alaska (although in Alaska, there must be a written agreement between the spouses). The remaining states follow common law.
