In addition to these planned trips, students have the option to pursue international exchange programs with Mannheim Business School as well as our other partner schools around the globe, to the extent to which these exchanges fit with the academic calendar.

The Global MBA students spend six weeks of their second term at ESSEC’s campus in Singapore. The economic vibrancy of the city-state and its unique role as the geographical, commercial, financial, and cultural crossroads between East and West make it the ideal location for ESSEC. #Government plans to amend anti-dowry harassment law

Section 498A was introduced in early eighties to protect married women from being subjected to cruelty.

Plans are afoot to amend a criminal law that will allow compromise and settlement between husband and wife at the onset of trial in dowry harassment cases, a move that comes after frequent misuse of the provision to trouble men and their near relatives.

A draft note for the Union Cabinet seeking to amend Section 498A of the IPC, making it compoundable, has been sent to the Law Ministry for drawing up the draft bill, a Home Ministry official said.

Now, the offence is non-compoundable and non-bailable which provides for immediate arrest of the accused. Conciliatory effort by the warring sides is virtually impossible.

A husband or his family members are presumed to be guilty till they prove their innocence in the court. The guilty is punishable with a jail term of up to three years.

#God-Given Rights

As legal researchers, we receive many inquiries in the area of law, especially pertaining to so-called "sovereignty." One of the major inquiries we receive consistently from people interested in learning law and/or becoming so-called "sovereign" is what edition of Black's Law Dictionary ("BLD") should they purchase.

Considering there are many editions, this is a good question. Our answer is: the 5th edition!

Black's Law Dictionary, 5th edition is the best "BLD" to purchase and study. Most of the lawfully successful people learned American law from studying this edition of "BLD."

You see, the 5th edition of "BLD" is reportedly the edition modern day judges use in American courthouses, which are really merchant tribunals based upon how they operate today. Courts are measures and machines for collecting cash for governments these days. You especially see this all the time pertaining to traffic cases. However, this is not the fault of judges, t ... #What qualifications do I need to get into Stanford Law School?

Aside from a few requirements (i.e. a bachelor s degree), there s not a single set of qualifications that will necessarily get you in. Instead, the Dean of Admissions will holistically evaluate several pieces in your application. The best answer I can give is that to qualify to get into Stanford Law School, you have to have the right fit with the school. This holds true at most other law schools in the country.

Law schools will ask for a few things in an application, each presumably providing information that the school weighs in making an admission decision. Stanford, and most other law schools, will request all post-secondary transcripts, an LSAT score, a resume, two or more letters of recommendation, and a personal statement. The transcripts and LSAT scores allow schools to objectively evaluate each student relative to the pool of applicants. The LSAT purports to evaluate an applicants logic, argumentative, ... Call it harassment, intimidation, aggression coercive management or things seen as ‘just a joke’ are all common labels for what is called bullying. If you are one of those who is always harassed by your colleagues at work, here’s a list of things you can do to combat bullying:

Remember bullies just wait for a reaction from people getting bullied. But if you just walk away or ignore their jokes, mails and instant messages, you are clearly telling them that you just do not care. Sooner or later the intimidator will probably get bored with trying to bother you. You just continue minding your own business and learn to completely ignore them. Stop feeling shy and weird to face them. Just show as if you don’t know what is happening. Using this type of body language sends a message that you’re not vulnerable. Trust us and learn to ignore the aggressor.

Who wouldn’t get upset about being-bullied? Well it is pretty much natural. But remember, that’s exactly the kind of respon ... Read more »

Students may work towards three graduate degrees—Master of Science (a terminal degree), Master of Engineering (a terminal degree), or Doctor of Philosophy—in one of five areas: Applied Mathematics, Applied Physics, Computational Science and Engineering, Computer Science, and Engineering Sciences.  Not all areas admit students to every degree (M.S. M.E. Ph.D.); see the Graduate Programs page for a listing of which degrees are offered by each area.

Please note that we strongly encourage any student who is considering ultimately pursuing the Ph.D. at Harvard to apply directly to the Ph.D. program.  Students in our masters programs are not given preferential treatment in admission to the Ph.D. program.

Our graduate programs are administered through Harvard's Graduate School of Arts and Sciences (GSAS).

The remainder of this article collectively refers to all of the laws above as harassment laws just to suit its purpose.

A harassing work bully can be anybody under the so-called harassment laws, including a boss. coworker, and even a non-employee (e.g. independent contractor or client). No one is immune from violating the laws.

Additionally, harassment laws allow anyone adversely affected by unwelcome, discriminatory conduct to file a discrimination charge against a harasser directly with the EEOC (or state equivalent) or through an attorney. even if he or she was not the intended victim.

However, before filing an EEOC charge against your employer under a harassment law, it's a good idea to try to stop the unwelcome conduct by following your employer's anti-harassment policies to the letter; otherwise, your employer might be able to use the so-called Faragher-Ellerth defense against you.

Civil cases usually involve private disputes between persons or organizations. Criminal cases involve an action that is considered to be harmful to society as a whole. Below is a comparison of the key differences between civil and criminal cases.

A civil case begins when a person or entity (such as a corporation or the government), called the plaintiff, claims that another person or entity (the defendant) has failed to carry out a legal duty owed to the plaintiff. Both the plaintiff and the defendant are also referred to as "parties" or "litigants." The plaintiff may ask the court to tell the defendant to fulfill the duty, or make compensation for the harm done, or both. Legal duties include respecting rights established under the Constitution or under federal or state law.

Civil suits are brought in both state and federal courts. An example of a civil case in a state court would be if a citizen (including a corporation) sued another citizen for not living up to a co ... Read more »

Adultery laws differ from state to state and can leave a person confused about their situation and the legal recourse available to them. Below are five of the top adultery and infidelity questions answered by Family Lawyers.

Adultery for the most part is not a crime and is not considered a criminal offense in most states. However each state may differ on statutes and criminal laws. In the few states that adultery is illegal or still considered a crime, the offense is often deemed a petty crime or misdemeanor and usually only inflicts light fines. To know state specific statutes relating to adultery legalities, it's best to ask an Expert.

Case Details: The affair had no effect on the children

The court has the best interest of the child in mind. If the child didn’t suffer mentally or physically from the affair, adultery will, most times, be considered irrelevant to child custody issues. The judge will take into consideration living habits and any ... Read more »

    #Godwin s Law s Law - Uncyclopedia, the content-free encyclopedia

    From Uncyclopedia, the content-free encyclopedia

Mike Godwin, the inventor of Godwin's Law.

Godwin's Law's Law. also known as "Godwin's Rule of Godwin's Law analogies", states that: “As an online discussion grows longer, the probability of a comparison invoking Godwin’s Law approaches 1.” Godwin’s Law's Law is often cited in online discussions as a deterrent against comparing comparisons with Hitler or the Nazi regime with Godwin’s Law to void an argument that might otherwise be valid, to void the voiding of that argument.

Godwin’s Law's Law merely makes an observation that as an online discussion grows, if the probability of invoking Hitler approaches 1, then the probability of invoking Godwin’s Law approaches 1 as well. By citing Godwin’s Law's Law, however, the user is usually implying that Godwin’s Law does not make a Hitler comparison invalid, as Hitler comparisons can sometimes ... Read more »

What we call criminal law broadly refers to federal and state laws that make certain behavior illegal and punishable by imprisonment and/or fines. Our legal system is largely comprised of two different types of cases: civil and criminal. Civil cases are disputes between people regarding the legal duties and responsibilities they owe each other. Criminal cases, meanwhile, are charges pursued by prosecutors for violations of criminal statutes.

    Criminal Law: History

In the United States, British common law ruled during colonial times. Common law is a process that establishes and updates rules that govern some nations. Once America became an independent nation, it adopted the U.S. Constitution as "the supreme law of the land." The U.S. continues to employ a common law system, which works in combination with state and federal statutes. As far as criminal laws are concerned, each state has its own penal code which defines what is or is not a crime, the severity of a ... Read more »

Law school quality is evaluated in different ways that can consider combination of empirical statistics, or on surveys of educators, scholars, students, prospective students, or others; for example, certain schools are grouped together in terms of equivalent quality and prestige. Since there is no official ranking authority, books and magazine articles assign law schools purported numerical quality rankings, which are based on factors such as strength of curriculum, faculty, career services, skill of students and quality of library services that make up the reputation of a law school.

The American Bar Association( ABA ) and its Section of Legal Education and Admissions to the Bar have emitted disclaimers of any law school rating system; for that reason, the ABA and the LSAC publish The Official Guide to ABA-Approved Law Schools. It is an annual law school guide that contains data on ABA accredited law schools in the United States and provides a set of standard data on which ... Read more »

    #Harassment laws

Harassment is a form of employment discrimination that violates Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act of 1967, (ADEA), and the Americans with Disabilities Act of 1990, (ADA).

Harassment is unwelcome conduct that is based on race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information. #Gun control laws

Baltimore, which despite Maryland's restrictive gun control laws, consistently has among the worst violent crime problems of any major U.S. city.  Well, like salt in a wound, the city has now been forced to suspend a local anti-crime program after police seized guns and other contraband from one of the program's offices. The Washington Times reported   on Wednesday that nine people have been arrested.

Among those arrested this week on guns and narcotics charges is one man previously sentenced to 12 years in prison on narcotics charges, another man twice acquitted of murder, and two others arrested on robbery and assault charges in the incident that led police to investigate Safe Streets this time. In response to concerns about the decision to employ ex-felons for the program, a city spokeswoman said, "[w]e do not see it as a risk but rather as a privilege to give returned citizens a second chance at hope and employment."

In Arizona, drivers must carry auto insurance in their vehicle at all times and must show proof of insurance after an accident. Auto insurance is required at the time of vehicle registration, but the driver has 30 days from the time of the registration to prove the vehicle is insured. The state requires minimum injury and property damage liability coverage.

Your auto insurance policy must be written by an Arizona-authorized insurance company. The Arizona Department of Insurance website provides a search engine to check your insurance company's state status, which must be current.

If you are pulled over without auto insurance and it is your first offense, you may have to pay a fine of $250. However, subsequent offenses will lead to more stringent penalties, such as loss of driver's license and registration. To get your vehicle and driver's license returned, you may have to prove financial responsibility with SR-22 insurance, a more costly, at-risk auto insurance that ... Read more »

#Harvard Business School has a Japan Problem

(Poets Quants ) When Harvard Business School released its round two interview schedule for MBA applicants on Wednesday, there was one very big surprise. HBS set aside four separate days of interviews in Tokyo.

That’s a lot of interview slots for a country that produces perhaps 100 applicants to HBS a year. It’s twice as many as those scheduled in Mumbai, India and one more than what s on the docket for Shanghai, China, even though GMAT test takers from both China and India outnumber those from Japan by a factor of nine to one. For every person who took the GMAT in 2012-2013 from Japan, there were 8.8 who did so in India and 9.1 who took the exam in China.

Dee Leopold, managing director of MBA admissions and financial aid at HBS, told applicants that admission board members will be interviewing invited round two applicants in Tokyo on February 19, 20, 21, and 22. It’s part of a major push to attract more MBA stude ... Read more »

    Vice President, General Manager

On November 14, Wolters Kluwer Legal Education hosted the first ever invitation-only Leading Edge summit for Law Students. Inspired by our productive Leading Edge conference for Law Faculty in July, Leading Edge: Law Student was an attendee-driven forum for brainstorming what the future of legal education should look like from a student's perspective. We had much curiosity heading into the conference: how different would the students' perspective on the future of legal education look from that of the faculty?

As it turned out, that was the wrong question. The students, in their rich and probing discussions, differed from faculty not so much in what they agreed as future goals — stronger practical education, smoother paths to employability, greater diversity, all of which both groups spoke about intensively — but in what they considered the how of how to get there.

There was extensive discussion by students, for example, of the ... Read more »

NSW has introduced new laws, in effect from today, which make it illegal to handle your phone at all while driving. What rules apply in the rest of the country? We ve rounded up the current laws for every state and territory.

Details differ slightly surrounding GPS navigation and what learner drivers can do, but the most important thing to note is this: making a call using a hand-held phone while driving is illegal right across the country. That s because it s risky and stupid behaviour. Note that it doesn t matter if your car is temporarily stopped at lights: it s still illegal to make a call with a phone in your hands. All states ban texting and emailing while driving, whether your phone is mounted or not.

If you want to use your phone as a GPS, then it should be mounted in a stand designed for the purpose. The majority of states (everywhere except Queensland and WA) specify that the mount must be commercially manufactured; you can potentially be fined if you make ... Read more »

What is a bank account garnishment?

A bank account levy (also referred to as bank account garnishment,) occurs when a creditor is able to take all, or a portion of, the money in a debtor’s bank account for payment of an overdue debt.  In most cases, a court order is required for this to occur, but the federal government can issue a bank account levy administratively (without going through a court.) There are numerous specific laws on both the federal and state level that apply to bank account garnishments.

    Bank Levy Process

When a bank receives a notice of a levy, they must immediately freeze the debtor’s account. In addition to being unable to make a withdrawal, if your bank account is frozen, any outstanding checks or automatic debit card payments won’t clear (unless there are enough exempt funds in the account) – so be sure to make alternate arrangements.

If this wasn’t done, the garnishee would simply withdraw the ... Read more »

By Nick Holmes on March 3,

Considering whether we were experiencing the beginning of the end of print. I ended my previous post with the prediction that the law text book would be the last print format left standing (after journals, law reports, looseleafs).

I stand by that. The printed (and bound) book is wonderful information package, designed 500 years ago and changed not a lot since then. We love books their look, their feel, their portability, their associations. It will be a long, long time before they become an endangered species.

Even the law book will die slowly. But what would accelerate its decline? What is the future law book? Scott Vine and Jordan Furlong have offered their thoughts.

Scott loves books as above and sees the lawyer of the future carrying an e-book reader. holding all the texts (s)he might need but preserving the look and feel of the print versions.

But we know that law books are different. The law changes constantl ... Read more »

It is said that as soon as you drive a new car off of a dealer s lot that it begins to depreciate in value. Accordingly, many people prefer to purchase used cars. Any car that has had a previous owner is defined as a used car. Some used cars have been driven fewer than 10,000 miles and others already have well over 100,000 miles on the odometer. It can be difficult for consumers to know the condition that a used car is in and there can be hidden defects that are hard for a buyer to see. Many used cars do not come with any manufacturer or dealer warranties. So, what happens if the used car that you buy turns out to be defective?

#Healthcare law helps sickest Americans - depending on their state - LA Times

Every year, thousands of people like Blanca Guerra call the National Cancer Information Center, desperate to find some kind of health insurance.

Guerra rang recently from her home in Arizona, seeking help for her older brother, who had just been diagnosed with advanced stage colorectal cancer.

A few years ago, the call center would have had few solutions.

But between 2012 and 2014, when the major coverage expansion made possible by the Affordable Care Act began, the share of callers connected with coverage more than doubled from 12% to 27%, according to data provided to the Los Angeles Times.

The gains are not being evenly shared around the country, however, highlighting an issue still shadowing the federal healthcare law, even after it survived the latest legal challenge.

Laws protecting both landlords and tenants may vary from country to country, by U.S. state . or by city, town or village.

What hardly ever varies is the emotion the subject raises on both sides of the fence in many communities around the world.

In some cases, eviction may be as simple as the landlord choosing not to renew a lease after its expiration date. More commonly, nonpayment of rent or property damage remain the most typical causes for sudden evictions.

Before any action can be taken, landlords in many jurisdictions are bound by a strict set of rules. Typically, just cause must be evident, followed by a lawsuit in a local court and an official notice of a number of days or weeks given to the tenant before eviction.

As an employee in Indiana, it's important that you understand your rights. Here are a few of the various federal and state laws that protect you at every employment stage from hiring to firing.
