If the Supreme Court's opinion in U.S. v. Miller limits the Second Amendment's scope and authority to laws affecting the states' ability to raise and equip militias, what good does the 2nd Amendment do for the individual firearms owner?

Curriculum Overview

The JD/MBA is a four-year program that offers the core curricula of the HBS MBA and HLS JD with a wide range of elective options at both schools. The Department of Philosophy has a faculty with expertise in the philosophy of law, political philosophy, science policy studies, bioethics, normative ethics and metaethics, and moral psychology. Students may specialize in the philosophy of mind, psychology, biology, or science; the history of philosophy; epistemology, logic, metaphysics, ethics, political philosophy, and philosophy of law.

Law students pay too much money. Law school is way too expensive. Maybe this is why Frugal Law Student is so popular. (It also could be because he is cool and writes great articles, but I digress.)

To help law students save money, I ve been researching for the cheapest price on law school casebooks, study aids, and law outlines at various sites online. Unless you steel or borrow your law school books, you can almost certainly save money buying your law school books at these online stores.

Amazon is old reliable. It has a huge assortment of books, new and used. Since you probably already know all about Amazon, I won t explain more, except to say that Amazon has saved me hundreds of dollars when buying casebooks for law school courses.

How do people use, misuse or abuse Hipaa, the federal regulations protecting patients’ confidential health information? Let us count the ways:

What is Patent Law? It encompasses the branch of law that governs patents. U.S. patent laws were enacted by Congress under its Constitutional grant of authority to protect the discoveries of inventors. A patent is the grant of an exclusive property right to the inventor for the benefits of an invention or improvement, granted by the U.S. Patent & Trademark Office (USPTO), for a specific period of time. The invention or idea, by its nature, must be patentable; one skilled in the applicable field must be able to make and use the claimed invention; it must be new (novel) and has not been iterated; its originality must be obvious, meaning the idea cannot be something that anyone in the applicable field of expertise could have easily identified; and it must be useful. Broadly defined, health law includes the law of public health, health care generally, and medical care specifically. Preserving public health is a primary duty of the state. Health regulations and laws are therefore almost all administered at the state level. Many states delegate authority to subordinate governmental agencies such as boards of health. Federal health law focuses on the activity of the Department of Health and Human Services (HHS). The merger of Concord into Kaplan University in late 2007 made Concord the first online law school to be part of a regionally accredited university. [ 3 ] [ 1 ] However, the school is not accredited by the American Bar Association. [ 4 ] or by the California Committee of Bar Examiners. [ 5 ]

Because of the school's status as an unaccredited distance learning law school by the California Bar Association, Concord students must take and pass California's First Year Law Student Examination, colloquially called the "Baby Bar," after their first year of law study. #High court rules data retention and surveillance legislation unlawful

Emergency surveillance legislation introduced by the coalition government last year is unlawful, the high court has ruled. A judicial challenge by the Labour MP Tom Watson and the Conservative MP David Davis has been upheld by judges, who found that the Data Retention and Investigatory Powers Act (Dripa) 2014 is “inconsistent with European Union law”. The act requires internet and phone companies to keep their communications data for a year and regulates how police and intelligence agencies gain access to it.

The government will now have to pass fresh legislation that must come into effect before the end of March. The two MPs said the judgment underlined the need for prior authorisation by a judge before officers are permitted to examine the retained information from the internet, social media or phone calls. HIPAA BACKGROUND

HIPAA was enacted as a broad Congressional attempt at healthcare reform - it was initially introduced in Congress as the Kennedy-Kassebaum Bill. The landmark Act was passed in 1996 with two objectives.

  1. One was to ensure that individuals would be able to maintain their health insurance between jobs. This is the Health Insurance Portability part of the Act. It is relatively straightforward, and has been successfully implemented.
  2. The second part of the Act is the "Accountability" portion. This section is designed to ensure the security and confidentiality of patient information/data. In addition, it mandates uniform standards for electronic data transmission of administrative and financial data relating to patient health information.

#HIPAA Rules

A Brief Background on the HIPAA Rules and the HITECH Act

The Health Insurance Portability and Accountability Act (HIPAA) was enacted by the U.S. Congress in 1996. The Act is massive in scope with five separate Titles. Title II of HIPAA, known as the Administrative Simplification provisions, requires the establishment of national standards for electronic health care transactions and national identifiers for providers, health insurance plans, and employers. The Administrative Simplification provisions also address the security and privacy of health data. The standards are meant to improve the efficiency and effectiveness of the nation's health care system by encouraging the widespread use of electronic data interchange.

The Health Insurance Portability and Accountability Act of 1996 ("HIPAA") gave the federal Department of Health and Human Services ("HHS") the authority to promulgate regulations containing standards with respect to the privacy of individually identifiable health information. HIPAA provided that such standards shall not supersede State law that imposes more stringent standards (P.L. 104-191, 264(c)). HHS promulgated the federal standards, and they are now in Parts 160 and 164 of Title 45 of the Code of Federal Regulations (the "Privacy Rule").

Under the Supremacy Clause of the U.S. Constitution, federal law preempts State law when preemption is the clear and manifest purpose of Congress. A wage garnishment is one tool that creditors use to collect debts. With a garnishment (also called wage attachment or wage withholding), the creditor sends a garnishment order (or in some instances a wage garnishment notice) to your employer. Your employer withholds a portion of your wages each pay period and sends that money directly to your creditor. Not every creditor can garnish your wages, and there are limits on how much can be taken from your paycheck.

Landlords can't just lock you out, even if you are behind on rent. They must get a court judgment first.

Your landlord can't evict you without terminating the tenancy first. This usually means giving you adequate written notice, in a specified way and form. If you don't move after proper notice (or reform your ways -- for example, by paying the rent or finding a new home for the dog), the landlord can file a lawsuit to evict you. (This type of lawsuit is sometimes called an unlawful detainer, or UD lawsuit.) In order to win, the landlord must prove that you did something wrong that justifies ending the tenancy.

The law defines a felony as a crime punishable by imprisonment for a term exceeding one year. As far as federal gun laws are concerned, the length of a person s actual prison sentence is irrelevant.     A new report has highlighted widespread disregard for traffic laws among UK drivers

    Nearly 50 per cent of drivers admit breaking traffic laws, with around half of them doing so deliberately, according to a survey.

    If you know the name/citation of the case

    Every reported case has a title which is usually the name of the parties involved in the action. The title is then supplemented by a citation, which helps to find the case and shows where you can find the law report.

    Citations

    Citations normally consist of a year plus abbreviations, which lead to a page within a volume of a series of law reports.

    The four parts to most citations are:

    • date or year
    • volume number
    • abbreviation for the title of the law report series
    • page number

    Some cases will have multiple citations which means they have been reported in a number of different law report series. The name of the series is usually abbreviated. Decode the abbreviations by using the Cardiff Index to Legal Abbreviations .
