These foundational or basic laws of states or organizations, guided by constitutional frameworks, are the bases for a cooperative give and take leading to peace and prosperity for all while at the same time ensuring the human rights of all members of that society.
Constitutional law is created through judicial interpretation of the constitution. Judicial review of the constitution by judges who study and construe the constitutional sections encompasses court decisions which create the body of constitutional law. This case law becomes the precedent for future cases.
In the United States. there are cases arising under the constitution, federal law, or a treaty. For example, when the United States is a party, there is usually sovereign immunity whereas the United States cannot be sued without its consent. Yet, there is no immunity where the action is beyond the scope of statutory power or the action is constitutionally void. When the suits are between a state and citize

#Easiest and fastest way to do a divorce in Gwinnett?
Divorce / Separation Lawyer
Litigation Lawyer
If the two of you can agree you would be able to file an uncontested divorce. The Gwinnett Family Law Clinic has the forms for free (you can google them). If there are children it is a much more complex process with many more forms and spreadsheets.
If the two of you are not able to agree to the divorce then you will have to file a contested divorce. You may need an attorney to complete this process. Cobb County has a Pro Se divorce class for people who want to represent themselves in their divorce. It is a pilot project sponsored by the county bar and, I believe the only one in the state. I've taught it a few times and it's a good class. You can enroll even though your divorce may be filed in Gwinnett. The class will give you a feel for the process and what is involved in filing for divorce. The registration information is on the Cobb County Law Library web p

When conducting business, health care providers must navigate many complicated regulations, such as the federal physician self-referral prohibition (commonly known as the Stark law), the federal Anti-Kickback Statute, and myriad state fraud and abuse statutes that may or may not mirror the federal rules. Entrepreneurial health care businesses may be further restricted by corporate practice of medicine prohibitions, fee-splitting prohibitions, notice requirements, Medicare conditions of participation or certification requirements and billing rules (such as the Anti-Markup rule). At Wachler Associates, we have been helping providers navigate these difficult areas of the law for over 25 years. We have completed Stark and other regulatory analyses for many types of providers, such as group practices, hospitals, physician-hospital organizations, physician organizations, physician owned distributorships, equipment leasing companies and diagnostic testing facilities to name a few. Attorneys looking to start up a firm often look for the best furniture, equipment, and supplies available so as to impress their prospective clients once the office is open. However, lawyers just starting out their careers or making a clean, fresh transition from another practice may have to be more practical in their considerations. Whether furniture and other equipment is necessary, or more of a luxury, is a determination each lawyer will have to make in the context of their budget and past experience. In essence, this is one of the first of many business decisions that a lawyer must make. After all, a beautiful and impressive mahogany or cherry wood desk might not look very useful later on should you have to cut costs on other equipment which would have made your work product better and more efficient.
Furniture: A Necessary Expense ?
First of all, there's no question that any office needs furnit

#ELAW Spotlight
A new report published by the Environmental Law Alliance Worldwide concludes that courts in several countries are poised to pursue climate justice.
Some people are profiting enormously from damaging the climate, while others will bear the costs of that climate damage, says Jennifer Gleason, ELAW Staff Attorney.
Jen led a research team of ELAW partners from the United States, India, Ecuador, Brazil, Mexico, and Kenya to identify jurisdictions around the world where strong cases could be filed to hold corporations accountable for damaging the climate.
The report states:
The damage that humans are doing to the global climate may be one of the gravest injustices of all time . Many who will suffer the most are contributing almost nothing to the damage. The fundamental purpose of legal systems and courts is to prevent and remedy injustices, and we appreciate this opportunity to mobilize courts to prevent and remedy this grave injustic

Think your Car is a Lemon? Read your State s lemon law to see how your State defines a Lemon, and whether your car and its repair history qualify.
Nearly all State Lemon Law Statutes are similar to the Federal Magnuson-Moss Warranty Act which makes breach of warranty a violation of federal law. All States have enacted their own Warranty Acts and many States have enacted specific Statutes that pertain to Automobile Warranties. If your car is not considered a lemon in your State, you do have other recourse.
Send copies of your repair records to: help@CarLemon.com

No Cost. No Obligation.
The defect does not have to substantially impair the vehicle s use, value, or safety to be considered a lemon. If the paint is peeling, the light switch came out when you pulled on it, the car makes funny noises but otherwise drives just fine, you may still have a lemon. But if you ve found 10 things you just don t like abou

#EEOC: Civil Rights Laws Bar Sexual Orientation Discrimination
EEOC: Civil Rights Laws Bar Sexual Orientation Discrimination
This is, as Joe Biden would say, a big fucking deal:
WASHINGTON — The Equal Employment Opportunity Commission has ruled that existing civil rights law bars sexual orientation-based employment discrimination — a groundbreaking decision to advance legal protections for gay, lesbian, and bisexual workers.
“[A]llegations of discrimination on the basis of sexual orientation necessarily state a claim of discrimination on the basis of sex,” the commission concluded in a decision dated July 15.
The independent commission addressed the question of whether the ban on sex discrimination in Title VII of the Civil Rights Act of 1964 bars anti-LGB discrimination in a complaint brought by a Florida-based air traffic control specialist against Transportation Sec. Anthony Foxx.
The ruling — approved by a 3-2 vote of the five-

#Eight Hallmarks of a TTT Law School
Urban Dictionary defines a third-tier toilet (TTT) as a “pejorative term for law schools that are not prestigious.” The definition goes on to explain that any school that fails to rank in the Top 14 is not prestigious. Which, by that definition, means that Harvard is not a TTT, but Vanderbilt is. As a result, the TTT label is applied liberally to a range of law programs. (UD)
Since we’re not sure who makes this shit up—and since the label seems rather arbitrary—we made our own list of factors that indicate an institution is a TTT.
1 TTTroll Factory. Is your law school a thread on a law-oriented bulletin board? If your law school produces so many comment trolls that your dean needs an RSS feed for sites like JDUnderground.com and AutoAdmit.com just to keep up with what dissatisfied alums are saying, it’s a safe bet that the school in question is a TTT.
2 BidirecTTTional. If your

Copywrite laws are they to vague?
Hey guys
This is something of a serious note, any feedback to the following will be much appreciated. As a fan of any art, literature, and so forth I found this quite disturbing at the stupidity of some companies.
This letter comes from a fan site dedicated to creating Skins and Meshes involving Marvel characters for the game Freedom Force. What has come to my understanding is that anything a fan does that "distributes" copyrighted material in any form (Like our great Star Trek Mods) is infringing on the rights of the company.
Funny thing I thought Fans are supposed to love and support their favorite Icon, I guess all those Star Trek conventions are breaking the law. I feel a gnawing disgust at the moment.

Doctor of Education (Ed.D.)-Special Education
It is really very difficult to formulate strategies and statistical studies for the special education sector. The researchers have not been able to establish any concrete correlations between the education being provided to a special student and the exact outcome of it. The introduction of special education in the public schools has been criticized as the qualification requirement varies significantly from one education institute to another. Parents of students and critics often complain that other students might have to face certain risks if we include special students into regular class. Critics are of the opinion that placing regular students in the same classes as disabled students may decrease the educational progress of people with disability. Special education programs continue to be criticized by disability activists because they are still often differentiated from regular education programs.

In order for a Landlord to begin the eviction process, California law requires all persons residing in the property to be served with a Notice. If preparation or service of the notice is done incorrectly or not at all and the tenant raises it as a defense, the Court will dismiss the Landlord's complaint due to a procedural defect and the tenant will prevail at Court.

A landlord who wants to terminate (end) a month-to-month tenancy can do so by properly serving a written eviction notice of 30, 60 or 90 days on the tenant. Generally, a 30 or 60 day notice doesn't have to state the landlord's reason for ending the tenancy.
A landlord can use a written 3-day notice (eviction notice) if the tenant has done any of the following:

What is Employment Discrimination Law?
Employment discrimination law refers to federal and state laws that prohibit employers from treating workers differently based on certain attributes unrelated to job performance. Discrimination by government employers violates the constitutional guarantees of equal protection and due process. Discrimination by private employers may conflict with any number of statutory protections, most notably, Title VII of the Civil Rights Act of 1964.
Not all classifications qualify for protection against discrimination in the workplace. Under current law, individuals are protected against discrimination based on race or skin color, national origin, genetic information (such as family medical history), gender or pregnancy, religion, disability, and age. In some cases, it is also illegal for employers to discriminate based on marital status, political affiliation, and sexual orientation.

This page lists all the legal terms surrounding repossession law to help you understand what it all means in plain English .
The date on which the case will first be heard in court.
A calling up notice may be sent to you if you have missed payments to your mortgage or secured loan and your lender is starting repossession proceedings.
The judge can decide to continue your case. This means that they will not make a decision on the day, but will fix another date for your case to call at court again. This could be to allow time for 1) you to get debt advice, 2) a cheque to clear, 3) you to make a payment.
This is the judges decision in favour of the defender or the pursuer. If your lender is asking to be allowed to repossess the property and decree

#Emanuel Law Outlines: Property, Eighth Edition: Steven L. Emanuel: 9781454809159: Books
Most Helpful Customer Reviews
By Jacob Harris on January 5, 2015
Format: Paperback Verified Purchase
I got this because it was keyed to Dukeminier, but found it was also keyed to other textbooks as well. It is arranged purely in an outline format and I found it helpful for review. Most of the cases my class studied were covered by this outline. I will say, however, that I probably would have gone with the Gilbert's if I had to do it again- I had to borrow my classmates version when I came to a few of the stickier areas of the law. The Gilberts was more of a summary of the restatement, which just seemed to work better for my particular course.
I found that the Flashcards, made by the same company, were actually more useful. You can stare at an outline all you want, but you need to learn how to apply these rules in new situations. Your coursework and self-prepare

Fordham University (Fordham Law School)
Known as “the Friendly Law School” of New York City, Fordham University is an amiable oasis within the hustle and bustle of its hometown. While the curriculum is indisputably difficult, Fordham students are guided through the myriad challenges they face with the encouragement and support of the school’s accomplished faculty, who “are available, encouraging, incredibly knowledgeable of their subject matter, interesting, and personable. They take time and view students as people and individuals with whom
they are working.” Inside the classroom, Fordham professors are “genuinely enthusiastic about teaching” and “truly want their students to go beyond basic understanding of the law.” The overall effect is an “extremely challenging intellectual environment” that is
somehow “less mind-boggling” than its reputable name might suggest.

What is an Emanuel Law Outline?
An Emanuel Law Outline (ELO) is a summary of the law in a particular subject. All books in the series have been written or co-authored by Steve Emanuel himself. The outlines include references to major casebooks and cases, statutes, Restatements, and other bodies of law. They are designed to provide the student with the big picture in an area of the law, giving that student insights into how everything ties together.
Many of the titles, including Constitutional Law. Civil Procedure. and Criminal Procedure. are revised every year. Others are revised every couple of years to correspond to major changes in the law, to correspond to new casebook editions, and to add new cases.
The books are between 250 and 700 pages long depending on the subject area. All ELO series outlines except for Secured Transactions include a Capsule Summary, a 88- to 128-page summary of the main text ideal

#Employment contracts
Employment contracts
Contract of employment or independent contractor
An "employee" is a worker who works for another in exchange for wages. There are other arrangements for the performance of work that look like employment contracts . but are treated as independent contracting arrangements, or contracts for the provision of services.
The contract under which an employee performs work is called a "contract of service". The contract under which an independent contractor performs work is called a "contract for services".
Independent contractors generally are not covered by statutory minimum standards, awards or workplace agreements made under the WRA or the FW Act (see "National Employment Standards ", "Awards " and "Workplace Agreements ", below). Independent contracting arrangements are widely used in the transport and building industries.
The courts have developed a series of tests for distinguishi

Scientific laws are repeatedly observed phenomena in nature that appear to be nearly universally true. Often times laws will be developed from and described by mathematical models of the phenomena in question. Laws are different from theories in that they are not designed to provide a causal framework in which to describe why a series of observations reliably occur but are rather merely descriptions of the observed phenomenon. Creationists often like to refer to scientific laws as the unimpeachable authority of science and often try and use such things as the Second Law of Thermodynamics to argue against evolution. This is, of course, a logical fallacy that relies on equivocation .
A posteriori laws are capable of being precisely mathematically analysed and described. They also permit the prediction of future events by extrapolation from past events or present circumstances.

#End of Web Design
Websites must tone down their individual appearance and distinct design in all ways:
- visual design
- terminology and labeling
- interaction design and workflow
- information architecture
These changes are driven by four different trends that all lead to the same conclusion:
1. Jakob's Law of the Internet User Experience
Users spend most of their time on other sites. This means that users prefer your site to work the same way as all the other sites they already know.
This Law is not even a future trend since it has been ruling the Web for several years. It has long been true that websites do more business the more standardized their design is. Think Yahoo and Amazon. Think "shopping cart" and the silly little icon. Think blue text links.
2. Mobile Internet
Mobility drives small screens (because they are the only ones that ca

Online law degrees are becoming more common as law schools struggle to accommodate an exploding number of enrollments. Instead students can study long distance from a wide range of accredited institutions across the nation for a Juris Doctor degree. Successful graduation from an online school allows graduates to take a bar examination in any jurisdiction just as it would for graduates of a conventional law school.
Flexibility
Following an online program allows for much flexibility than attending a traditional classroom. Whereas students may have to change their personal schedule to fit in with the requirements of the classroom, virtual classrooms allow for the student to work at their own pace; although they may still have deadlines for assignments to be completed, they can choose a time of day to study and work which fits in with their schedule.
Financial savings
Online schools are considerably cheaper than attending a bricks and mo

#Employment law: area of practice
Employment law is legislation heavy and solicitors need to keep abreast of frequent changes in legislation and case law.
Employment law is much more than just employment contracts. It is an area of law that requires strong interpersonal and communication skills in order to be able to advise companies on a day to day basis as to the running of their businesses and the interaction with their employees. The work is both contentious and non-contentious and advice given can cover anything from simple queries on disciplinary, sickness and absence issues to discrimination, strikes and industrial action, redundancies and restructuring, employment tribunal claims and High Court proceedings.
Employment tribunals
Depending on the firm, it is common for its employment clients to be either predominantly employers or predominantly employees 90 per cent of our work is for employers, albeit we do act for numerous high-net worth employees.

Obtain a standard form seven day notice to quit. Maine law requires you to prepare a seven-day Notice To Quit before you initiate an eviction lawsuit. On the notice you insert the reason the tenant violated the lease. For example, if the tenant failed to pay rent, include that in the notice. Under Maine law the tenant must be at least seven days behind on rent to start the process with the notice. If the notice is for nonpayment of rent, it must contain this clause pursuant to Maine law:
"If you pay the amount of rent due as of the date of this notice before this notice expires, then this notice as it applies to rent arrearage is void."
If you prepare a notice for another lease violation, the tenant must vacate the premises within seven days or you file an eviction lawsuit.

If you've been accused of a serious crime, your chances of success may depend on your lawyer's ability to effectively navigate through the criminal justice system. The following is an overview of that system, along with answers to some of the most frequently asked questions.
Q: Should I talk to the police?
It's often in your best interests to avoid making a statement or signing anything. If the police are investigating you, you may or may not be aware of it. At some point, they may ask you to come into the station and give a statement. Instead of talking to the police, hire a criminal defense attorney. An attorney can intercede on your behalf, talk to detectives, and get valuable information which may result in charges not being filed. Most importantly, hiring an attorney will keep you from giving a statement that the District Attorney may ultimately use against you at trial.
Only if they have probable cause to believe you've committed the crime. Once

Before we move onto explaining the law, I would like to ask you something. Have you ever wondered why individuals belonging to the same family or plant progeny, have similar characteristics? Why do offspring look similar to their parents? Well, most of you might be knowing the Mendelian inheritance or Mendelian genetics theory. It answers the above questions. Simply put, this is possible because of the transfer of genes or inherited traits, in humans and plants alike. Gregor Johann Mendel. a German monk, needs to be credited with this important discovery that he made in the 19th century.
Mendelian Genetics
To start with, all of us living things, including plants and microorganisms, have chromosomes, which carry factors responsible for various characteristics that we possess. These factors basically control the phenotype and genotype of that individual. For instance, a particular flower is red colored or a person is blue-eyed, because of the factor coding it, w

Employment law governs the relationship between workers and their employers. This law, contained in federal and state statutes, administrative regulations, and judicial decisions, specifies the rights and restrictions applicable to each party in the workplace.

It also encompasses non-compete agreements, retaliation, severance, unemployment compensation, pensions, whistle-blowing, worker classification, wage garnishment, work authorization for non-U.S. citizens, worker's compensation, and employee handbooks.

#Employment Non-Discrimination Act
The Problem
Qualified, hardworking Americans are denied job opportunities, fired or otherwise discriminated against just because they are lesbian, gay, bisexual or transgender (LGBT). There is no federal law that consistently protects LGBT individuals from employment discrimination; there are no state laws in 29 states that explicitly prohibit discrimination based on sexual orientation, and in 32 states that do so based on gender identity. As a result, LGBT people face serious discrimination in employment, including being fired, being denied a promotion and experiencing harassment on the job.
What is the Employment Non-Discrimination Act?
The Employment Non-Discrimination Act (ENDA) would provide basic protections against workplace discrimination on the basis of sexual orientation or gender identity. ENDA simply affords to all Americans basic employment protection from discrimination based on irrational prejudice. The b

When window tint is installed to the glazing of a vehicle it reduces the amount of visible light, how much depends on the darkness of the tint. Car window tint is graded in a % VLT (Visible Light Transmittance - the amount of light the film allows to pass through). Some companies grade the film as how much light the film blocks so 20% VLT could be that it allows 20% of light to pass through, however with another company if could allow 80% of light to pass through as the 20% is the amount of light it blocks, this confuses things and you should always check before installing film. In this article all percentages refer to the visible light transmittance (VLT).
Authorities in many countries and states have laws as to how dark you can tint your windows. This is because if the windows are tinted too dark you may not be able to see hazards clearly, especially at night, and also police may not be able to identify individuals inside a vehicle. We all depend on our cars for traveling and for many other purposes. Life without a car just seems impossible. But what if someone seizes your car and you can't take it back. In this case, understanding some laws regarding repossession would be a huge help.
Car repossession occurs when a person fails to pay the car payments that he/she owes to the creditor, and the creditor takes back the car. If you have bought your car on loan, and you are late with your payments, and you don't even have enough car insurance, your vehicle could be seized. Once you buy a vehicle on loan, your creditor has more rights on the car than you. If you don't make your monthly payments on time, the creditor has the full authority to take back your car without a warning or a court notice in advance. If you have fallen behind your monthly payments, then it is necessary for you to understand the various automobile repossession laws. The good news is that, there are some limitations that the creditor ha

An online Executive MBA is a rigorous graduate program that typically takes two years of study to complete. Actions that may constitute antitrust behavior include creating an illegal monopoly, illegally reducing competition, bid rigging, group boycotts, geographic market allocation and price fixing. Anti

Back in July, a Federal District Court Judge enjoined Arizona from enforcing the key provisions of its controversial immigration law, specially those that authorized local police to require suspected illegal immigrants to provide immigration papers even without a valid arrest. Today, the Ninth Circuit Court of Appeals upheld that injunction in an appeal that the state had filed almost immediately after the decision:
The U.S. Court of Appeals for the 9th Circuit has ruled that lower federal court judge was right in her decision to halt parts of Senate Bill 1070 from going into effect last year.
The ruling comes almost a year after Gov. Jan Brewer signed the nation s toughest immigration law into effect and five months after the appeals court was asked to consider overturning the injunction issued by U.S. District Court Judge Susan Bolton in the lawsuit filed by the U.S. Department of Justice.
The original lawsuit challenges the constitutionality of SB 1070, ar

#Pareto s Principle - The 80-20 Rule
What It Means
Project Managers know that 20 percent of the work (the first 10 percent and the last 10 percent) consume 80 percent of your time and resources. You can apply the 80/20 Rule to almost anything, from the science of management to the physical world.
You know 20 percent of your stock takes up 80 percent of your warehouse space and that 80 percent of your stock comes from 20 percent of your suppliers. Also 80 percent of your sales will come from 20 percent of your sales staff. 20 percent of your staff will cause 80 percent of your problems, but another 20 percent of your staff will provide 80 percent of your production. It works both ways.
How It Can Help You
The value of the Pareto Principle for a manager is that it reminds you to focus on the 20 percent that matters. Of the things you do during your day, only 20 percent really matter. Those 20 percent produce 80 percent of your results. Identify and

Provides information on a law degree including what do lawyers do, educational requirements and specializations.
When we think about people who have law degrees, we envision lawyers arguing cases in courtrooms full of drama and publicity, grilling witnesses and arguing with the judge. In reality, most lawyers, or attorneys, rarely see the inside of a courtroom, and those that do are typically involved in more common court proceedings such as DWI (driving while intoxicated and theft cases. For every hour spent in the courtroom, many more are spent doing research, conducting interviews, or writing documents in preparation for litigation. Being an attorney requires excellent communication skills, but it also involves a great deal of paperwork and red tape. Some people with a law degree don t practice law at all. A law degree opens many doors in the legal field.
In its most basic sense, the law is the rules and regulations included in our constitution and legal codes. Th

With the variety of problems and issues that can arise in a diverse workplace, employment lawyers, also called Employment Benefits Lawyers, play a key role assisting both employees and employers alike. There are federal, state and local employment laws in place to assure fair treatment for employees. Due to the existence of these numerous employment laws, employment lawyers typically specialize in only a few areas.
Employees are fortunate today to have these protective laws in place. Labor rights have been developing since the nineteenth century after the Industrial Revolution. Americans today may take these rights for granted. But employment lawyers are experts in the field who seek to uphold them.

You can't believe it. The new car you bought makes an atrocious knocking noise when you drive it, and the dealer's mechanic can't seem to find the problem. Do you have to just bite the bullet and buy a lifetime supply of earplugs?
Fortunately, you do have recourse. New York has laws to protect you in case a dealer sells you a "lemon"?a car that is unsafe, inefficient, or riddled with defects.
New York's New Car Lemon Law compels the manufacturer of such a car to make the necessary repairs (usually through the dealer that sold it), refund your money, or replace the vehicle. The law is limited to cars used primarily for personal use and does not cover motorcycles, ATVs, or the living quarters of an RV. A car is covered under the New Car Lemon Law if all of the following apply:
It was covered under a manufacturer's warranty when it was originally delivered to its first buyer. It was bought, leased, or transferred in the state of New York within the vehicle's f

Being injured in an auto accident is a traumatic experience. During this period of distress you are wise to seek the aid of a personal injury attorney who represents victims injured in car accidents. With a lawyer that is knowledgeable in this practice area, you will have a much greater chance of receiving a fair settlement. Without a qualified personal injury lawyer you can normally expect to receive a fraction of what would be a maximum or fair amount of compensation. Insurance companies are intent to give you as little compensation for your injury claims as possible. Anyone who seeks money for injuries that arise from an auto collision is advised to seek the help of a dedicated legal advocate. Tate Law Offices has a long record of helping victims collect compensation, and attorney Tim Tate of Tate Law Offices has been named by D Magazine as one of the "Best Personal Injury Lawyers in Dallas" in & . #Parody copyright laws set to come into effect - BBC News
Changes to UK legislation are to come into force later this week allowing the parody of copyright works.
Under current rules, there has been a risk of being sued for breach of copyright if clips of films, TV shows or songs were used without consent.
But the European Copyright Directive will allow the use of the material so long as it is fair and does not compete with the original version.
The law will come into effect on 1 October.
Owners of the copyrighted works will only be able to sue if the parody conveys a discriminatory message.
It would then be down to a judge to decide if the parody is funny.
"The only, and essential, characteristics of parody are, on the one hand, to evoke an existing work while being noticeably different from it and, on the other, to constitute an expression of humour or mockery," the EU rules state.
"If a parody conveys a discriminatory messa

International Law. unlike most other areas of law, has no defined area or governing body, but instead refers to the many and varied laws, rules and customs which govern, impact and deal with the legal interactions between different nations, their governments, businesses and organizations, to include their rights and responsibilities in these dealings.
The immense body that makes up international law encompasses a piecemeal collection of international customs; agreements; treaties; accords, charters (i.e. the United Nations Charter); protocols; tribunals; memorandums; legal precedents of the International Court of Justice (aka World Court) and more. Without a unique governing, enforcing entity, international law is a largely voluntary endeavor, wherein the power of enforcement only exists when the parties consent to adhere to and abide by an agreement.
Due to the diverse legal systems and applicable histories of different countries, laws addressing internationa

#Estate Planning
estate planning: an overview
Estate planning is the process by which an individual or family arranges the transfer of assets in anticipation of death. An estate plan aims to preserve the maximum amount of wealth possible for the intended beneficiaries and flexibility for the individual prior to death. A major concern for drafters of estate plans is federal and state tax law.
An estate is the total property, real and personal, owned by an individual prior to distribution through a trust or will. Real property is real estate and personal property includes everything else, for example cars, household items, and bank accounts. Estate planning distributes the real and personal property to an individual's heirs.
Wills and trusts are common ways in which individuals dispose of their wealth. (See Estates and Trusts ). Trusts, unlike wills, have the benefit of avoiding probate, a lengthy and costly legal process that oversees the transfer of
