Constitutional law is created through judicial interpretation of the constitution. Judicial review of the constitution by judges who study and construe the constitutional sections encompasses court decisions which create the body of constitutional law. If the two of you can agree you would be able to file an uncontested divorce. The Gwinnett Family Law Clinic has the forms for free (you can google them). If there are children it is a much more complex process with many more forms and spreadsheets.

If the two of you are not able to agree to the divorce then you will have to file a contested divorce. You may need an attorney to complete this process. Cobb County has a Pro Se divorce class for people who want to represent themselves in their divorce. It is a pilot project sponsored by the county bar and, I believe the only one in the state. I've taught it a few times and it's a good class. You can enroll even though your divorce may be filed in Gwinnett. Elder financial abuse spans a broad spectrum of conduct, including:

  • Taking money or property
  • Forging an older person's signature

A new report published by the Environmental Law Alliance Worldwide concludes that courts in several countries are poised to pursue climate justice.

Some people are profiting enormously from damaging the climate, while others will bear the costs of that climate damage, says Jennifer Gleason, ELAW Staff Attorney.

Jen led a research team of ELAW partners from the United States, India, Ecuador, Brazil, Mexico, and Kenya to identify jurisdictions around the world where strong cases could be filed to hold corporations accountable for damaging the climate.

    Urban Dictionary defines a third-tier toilet (TTT) as a “pejorative term for law schools that are not prestigious.” The definition goes on to explain that any school that fails to rank in the Top 14 is not prestigious.     Copywrite laws are they to vague?

    Hey guys

    This is something of a serious note, any feedback to the following will be much appreciated. As a fan of any art, literature, and so forth I found this quite disturbing at the stupidity of some companies.

    This letter comes from a fan site dedicated to creating Skins and Meshes involving Marvel characters for the game Freedom Force. What has come to my understanding is that anything a fan does that "distributes" copyrighted material in any form (Like our great Star Trek Mods) is infringing on the rights of the company.

    Funny thing I thought Fans are supposed to love and support their favorite Icon, I guess all those Star Trek conventions are breaking the law. I feel a gnawing disgust at the moment.

    Doctor of Education (Ed.D.)-Special Education

    It is really very difficult to formulate strategies and statistical studies for the special education sector. The researchers have not been able to establish any concrete correlations between the education being provided to a special student and the exact outcome of it.     In order for a Landlord to begin the eviction process, California law requires all persons residing in the property to be served with a Notice. If preparation or service of the notice is done incorrectly or not at all and the tenant raises it as a defense, the Court will dismiss the Landlord's complaint due to a procedural defect and the tenant will prevail at Court.

Most of the cases my class studied were covered by this outline. I will say, however, that I probably would have gone with the Gilbert's if I had to do it again- I had to borrow my classmates version when I came to a few of the stickier areas of the law. The Gilberts was more of a summary of the restatement, which just seemed to work better for my particular course.

    Back in July, a Federal District Court Judge enjoined Arizona from enforcing the key provisions of its controversial immigration law, specially those that authorized local police to require suspected illegal immigrants to provide immigration papers even without a valid arrest. Today, the Ninth Circuit Court of Appeals upheld that injunction in an appeal that the state had filed almost immediately after the decision:

    As a legally sanctioned official access to private communications, Lawful Interception is a security process in which a service provider or network operator collects and provides law enforcement officials with intercepted communications of private individuals or organizations.

    Lawful Interception (LI) implementation is required by the European Union International User Requirements 19951 which allows for LI to prevent crime, including fraud and terrorism.

    The ETSI specifications are now in use in other countries that require the Lawful Interception of telecommunications.

    #Parody copyright laws set to come into effect - BBC News

    Changes to UK legislation are to come into force later this week allowing the parody of copyright works.

    Under current rules, there has been a risk of being sued for breach of copyright if clips of films, TV shows or songs were used without consent.

    But the European Copyright Directive will allow the use of the material so long as it is fair and does not compete with the original version.

    The law will come into effect on 1 October.

    Owners of the copyrighted works will only be able to sue if the parody conveys a discriminatory message.

    It would then be down to a judge to decide if the parody is funny.

    "The only, and essential, characteristics of parody are, on the one hand, to evoke an existing work while being noticeably different from it and, on the other, to constitute an expression of humour or mockery," the EU rules state.
