#What does Arizona s immigration law do?
  • NEW. Arizona's governor signs controversial immigration bill into law
  • Critics say they fear law would lead to racial profiling
  • Lawmakers in other states reportedly are looking to introduce similar legislation

(CNN) -- Arizona Gov. Jan Brewer on Friday signed the state's immigration bill into law. It is considered to be among the toughest legislation in the nation.

What does the Arizona law do?

Arizona's law orders immigrants to carry their alien registration documents at all times and requires police to question people if there's reason to suspect they're in the United States illegally.

Michael Hethmon, general counsel for the Immigration Reform Law Institute, helped draft the language of the Arizona bill. Hethmon said lawmakers from four other states have approached him asking for advice on how they can do the same thing where they live. He declined to ... Read more »

Hiring employees can help a growing small business meet increasing demand. If you are just beginning to add staff, there are federal employment laws you must adhere to. Congress passed the Fair Labor Standards Act in 1938 that established a federal minimum wage and overtime work rules. The Act requires employers to pay certain workers extra for overtime work. Other aspects of work hours, such as holiday work, flexible schedules and shift work, are not subject to federal regulations.

The Fair Labor Standards Act defines overtime work as hours worked beyond 40 in a single work week. According to the U.S. Department of Labor's Employment Law Guide, any company that engages in interstate commerce and has more than $500,000 in annual revenue is required to pay workers at a rate of one hand a half times their normal pay rate for overtime work. For example, if a worker earns an hourly wage of $10, he would get $15 an hour for any hours in excess of 40 hours during a work week. Empl ... Read more »

The following Special Education laws will be addressed in this section:

In addition to assurances of civil rights of students with disabilities, other legislation exists that addresses their educational rights. The first major law that guaranteed the right to a public education for all children, ages 5 to 21, was the Education for All Handicapped Children Act of 1975.

The Education for all Handicapped Children Acts is more commonly known as the EHA; it had as its purpose:

  • To guarantee a Free and Appropriate Public Education (FAPE ) for all children with disabilities, ages 5-21
  • Special Education and related services must be free, provided by the public agency at no cost to the parents

    #What are Human Rights

    Universal and inalienable

The principle of universality of human rights is the cornerstone of international human rights law. This principle, as first emphasized in the Universal Declaration on Human Rights in 1948, has been reiterated in numerous international human rights conventions, declarations, and resolutions. The 1993 Vienna World Conference on Human Rights, for example, noted that it is the duty of States to promote and protect all human rights and fundamental freedoms, regardless of their political, economic and cultural systems.

All States have ratified at least one, and 80% of States have ratified four or more, of the core human rights treaties, reflecting consent of States which creates legal obligations for them and giving concrete expression to universality. Some fundamental human rights norms enjoy universal protection by customary international law across all boundaries and civilizations.

Aviation Law at FreeAdvice.com contains information on aviation accidents, including accidents and injuries that may occur on board a commercial airline, general airplane and travel safety, and FAA regulations. The Federal Aviation Administration makes rules, regulations, and policies related to air travel and airport safety.

For example, rules about pilot rest times between flights, air traffic controller qualifications, and passenger behavior aboard flights are all under FAA purview.

In addition to regulating safety generally, such as airport safety through screening requirements, the FAA issues Airworthiness Directives, which sometimes remove from circulation certain parts of aircraft by make, appliance, number, and product.

For example, an Airworthiness Directive related to certain Hamilton Standard Series propellers manufactured in the fourth quarter of 1983 may have been susceptible to fracture, therefore the FAA Airworthiness Directive directed that th ... Read more »

#What is a legal apprenticeship? More Law

There s no denying it - apprenticeships in the legal sector are gaining momentum. The traditional route to being a lawyer has been challenged by, among other things, the Legal Education and Training Review which reported in June 2013. the rise of legal executives, increasing paralegal numbers, and alternative business structures (ABS). Combine this with university tuition fee hikes, which further increase the appeal of starting a career in law without the need for an expensive degree, and it s plain to see that the legal landscape is in the grip of a massive shake-up.

Since 2011, an increasing number of firms have been pledging their support to external apprenticeship schemes or launching their own. Skills for Justice (SFJ) conducted a survey in 2012 of 51 firms and found that they are likely to increase the number of paralegals they employ by 18% over the next five years. More significantly, 83% of firms said they would be interest ... Read more »

#What does TTT mean? Top Law Schools

    Re: What does TTT mean?

TTT officially stands for Third Tier Toilet, which is the Third Tier in the US News Rankings. TTT is also applied to the Fourth Tier or any non-ABA schools. In general, these schools are said to have lower prestige and worse career prospects.

Some elitists like to use TTT for any school ranked below theirs. For example, an immature Yale Law grad may call UC Berkeley a TTT or a Georgetown Law grad may call USC a TTT. Some elitists view anything outside of HYS a TTT, while others view anything outside of the T14 a TTT. The list goes on. With all this said, we can all agree that a mature individual would not refer to a fellow lawyer's school as a TTT.

Since we are talking about TTTs, it wouldn't hurt to talk about another popular term: Top Tier. Top Tier is usually referred to as Tier 1 law schools in the US News. Many law schools (on their websites) refer to themselves as Top Tier if they are in ... Read more »

#What Is a Law in Science?

by Alina Bradford, Live Science Contributor

Date: 25 March 2015 Time: 11:56 PM ET

In equations formulated by Sir Isaac Newton, the force of gravity grows with the mass of two objects and gets weaker the more distant the objects are from each other.

In general, a scientific law is the description of an observed phenomenon. It doesn t explain why the phenomenon exists or what causes it. The explanation of the phenomenon is called a scientific theory. It is a misconception that theories turn into laws with enough research.

In science, laws are a starting place, said Peter Coppinger, an associate professor of biology and biomedical engineering at the Rose-Hulman Institute of Technology. From there, scientists can then ask the questions, Why and how?

For example, reading your first case from a law school book, perhaps in the Summer before school starts, is a tedious and quite time consuming process. #Yet more promises and new laws won t solve Britain s problem with immigration

In the era of globalisation, you can't simply legislate migration away, and David Cameron's impossible promises will only give Ukip more ammunition

That law contained a series of reforms which will ensure our immigration system is fairer to British citizens and legitimate migrants and tougher on those with no right to be here . At the time, the Home Office rather breathlessly announced that the act contains 77 clauses and makes fundamental changes to how our immigration system functions.

    • Most people using collaborative law to make their family arrangements do manage to reach agreement.
    • The process involves a series of meetings without correspondence between lawyers, leading to greater predictability of costs.
    • All relevant matters can be discussed and the impact on other areas of family life examined, so the relevant process is holistic, although the financial disclosure aspect is no less rigorous than it would be in court.

#Yale Law School - TLS wiki

Since U.S. News began ranking schools, Yale Law School has always held the No. 1 position, and for good reason: It is unanimously considered one of the preeminent centers of legal studies in the world, and while its closest rivals also offer formidable prestige and their own array of career opportunities, Yale Law has remained a distinctive institution in many ways. It has graduated both Bill and Hillary Clinton, President Ford, and Supreme Court justices Clarence Thomas, Samuel Alito, and Sonia Sotomayor. Famed for its abolition of standard grades in the 1960s and the lowest ratio of students to faculty in the country (currently 7.9:1), Yale Law has also earned equal acclaim for its supposed "scholarly" bent and its legendary admissions process.

Landmark acts that spawned U.S. Federal employment discrimination laws (statutes ) enforced by the EEOC are listed below.

States and municipalities are allowed to enact their own employment discrimination laws that include or expand the provisions in the Federal laws. For example, some states make it unlawful for employers to discriminate based on sexual orientation, smoking or weight, in addition to the discriminations that the Federal laws prohibit. Some states and municipalities refer to their employment discrimination laws as fair employment practices laws, and they are typically enforced by local equal employment opportunity offices or civil rights agencies. To research employment discrimination laws in your state, start with the links in State Labor and Employment Law .

I have a question regarding to the changes to come on immigration law. My file was received by the Buffalo office in January 2nd , but I only received my AOR on March 10th .

Am I going to be under the current law or the new one to come?

I do not understand when they say “Those who applied before February 27, , will not be subject to the new proposed provisions in the legislation.”

Does it means, received AOR before February 27, or those who sent the application before February 27, ?

Here is what the CIC website says:

Q7. What happens to someone who has already applied to immigrate to Canada? How will the new amendments affect them?

Those who applied before February 27, , will not be subject to the new proposed provisions in the legislation. These provisions, once passed, will apply to applications received on or after February 27, .

According to Texas law, under House Bill 2003, it is illegal for a person to commit fraud by using the name, identity or persona of another individual to create a web page or to post one or more messages on a social networking website. Thus, a person cannot pretend to be someone else to post messages that would be embarrassing or otherwise detrimental to the other person. To convict someone under this law, the prosecution must prove that the offender posted the website or messages that defrauded the victim without permission and with the intent of committing fraud.

Many bullies use the Internet to repeatedly and mercilessly harass and antagonize other kids at their school and this abuse can have devastating effects on the victims. To prevent this, the Texas House Bill 2003 has a provision asserting that it is illegal to harass another person on the Internet or other communication devices. Child passenger restraint requirements vary based on age, weight and height. Often, this happens in three stages: infants use rear-facing infant seats; toddlers use forward-facing child safety seats; and older children use booster seats.

Many laws require all children to ride in the rear seat whenever possible, and most states permit children over a particular age, height or weight to use an adult safety belt.

    #MBA Program - Accounting Department

The Accounting major helps students acquire the skills to measure and communicate an organization s economic activities. Accounting is the formal system of collecting, organizing, and reporting the financial data used to make economic decisions. The data shed light on current financial status and liquidity, as well as past profitability and funds-generating capability. Its users include corporate shareholders, lenders, management, employees, research organizations, and taxing and regulatory agencies.

Many different types of economic decisions require accounting data. One major use of accounting data is to inform outsiders (interested people who do not have direct access to corporate records) of the firm s economic status and progress. By contrast, the firm s management requires data that will aid in controlling operations and evaluating performance. #MBA Scholarships At Top Business Schools - Poets and Quants Poets and Quants

Top business schools are handing out increasing amounts of cash to lure applicants

The first in a series on the growth in MBA scholarship money and what it means

One of the more closely guarded secrets among business schools is how much scholarship money is annually given in support of a school’s MBA program.

Schools which routinely dole out a lot of cash typically don’t mind sharing that information. After all, it makes them look good. They’ve been able to marshall the resources to help students who would otherwise have to borrow a lot of money to go to business school.

On the other hand, schools that have meager scholarship budgets tend to hoard the information. Making numbers public that embarrass the school among its peers is a no-win proposition. Candidates with that knowledge may be less eager to apply to a school where aid is less certain, and the fact that a scholar ... Read more »

“What internship (or full-time) offer should I take?” “What’s the right first step now that I’m finishing up my MBA?”

The life of an MBA student is demanding. Managing the classwork and interviewing process today is much harder than when I was an MBA student. Florida Child Restraint Law

Under Florida's child restraint law, you must use a child safety seat when transporting children through the age of 3. The state gives parents and other motorists the option of using a child restraint device or an adult seat belt for children who are 4 or 5 years old. Relative to other states, this portion of Florida's law is weak. A review of the GHSA's listing of state child passenger safety laws reveals that most states require child restraint use for kids of booster seat age, which is generally between 4 and 8 years of age.

    Enforcement

Compared to most other states, as of April , the enforcement section of Florida's child restraint regulations is strong. The Sunshine State applies three points to the drivers license of a violator of the law. The maximum fine for a first offense, according to the Insurance Institute for Highway Safety (IIHS), is $60. The state waives these penalties upon completion of a court-approved child rest ... Read more »

    #MBA Rankings

Media rankings of business schools are an integral part of the business school world. There are only two major full-time MBA rankings the Financial Times and The Economist that directly compare schools from around the world. BusinessWeek and Forbes create separate lists for U.S. and the rest of the world, while US News World only focuses on the U.S. market.

There is no ‘best’ business school in the world but there could be a ‘best’ business school for you.

To help you in your research, MBA50.com has compiled the results of the big five MBA rankings of the last 12 months to produce the MBA50.com Premiership.

Given that only two of the major full-time MBA rankings directly compare business schools from around the world, whether a one-year or two year programme, the authors encourage candidates to use the comparison with caution. Can you really compare apples and oranges?

    What is Medical Law?

Medical law is the body of laws concerning the rights and responsibilities of medical professionals and their patients. The main areas of focus for medical law include confidentiality, negligence and other torts related to medical treatment (especially medical malpractice), and criminal law and ethics.

    Confidentiality

Medical doctors and mental health professionals have long had a tradition of confidentiality with their patients, dating back to the English Common Law. However, this tradition has been codified in recent years, so that anything said by a patient to a doctor or mental health professional in the course of diagnosis or treatment is privileged and confidential unless the individual expresses an imminent intention to harm himself or others.

This confidentiality has been reinforced and expanded with the advent of the Health Insurance Portability and Accountability Act, or HIPAA. This fe ... Read more »

Those looking to get into a career in finance often are encouraged to continue their studies by earning an MBA, or Master's degree in Business Administration (MBA). An MBA education offers a broad curriculum in finance, markets, accounting, entrepreneurship and management. A more focused alternative that is becoming increasingly popular is to earn a Master's degree in Finance, or MF. Choosing which of these programs best suits a prospective student may be challenging, yet both programs offer the potential for high-paying career opportunities. (For more, see: Should You Get A CFA, MBA Or Both? )

What's the difference between these programs? The MBA equips graduates with a broader skill set and knowledge base comprising multiple aspects of business. Nowadays, there are many different types of MBA programs. Before making a decision, you should evaluate each and every one.

Even though they are both full-time programs, one-year MBA programs are quite a bit different than their two-year counterparts. A one-year MBA program has very strict requirements for admission, both in academic training and work history.

#Meet Amber Mostyn, Wendy Davis s Most Powerful Political Patron

Amber Mostyn s deep pockets push for women s rights in Texas—and, increasingly, nationwide

N ow that Texas Senator Wendy Davis’s filibuster has catapulted her to political stardom, Democrats across the state and country are calling on her to run for governor next year. But her most powerful political patron, Amber Anderson Mostyn, isn't quite ready to whip out the checkbook.

“Don’t get me wrong,” said Mostyn. “I have always wanted Wendy to be my governor.” A 42-year-old trial lawyer, Mostyn is the chair of Annie’s List, the Texas variant of EMILY’s List. and was one of the 2012 cycle’s biggest super PAC donors. She said she feels that Davis should take a serious gander at running, “But I don’t want everyone to get carried away with the events of the day without the mathematics having changed.”

Friends and suppliants said this is typical Mostyn—shrewd and slow to be moved by political drama. L ... Read more »

    Last Updated. May 1, 2014

And next up in our 259-part series, “Get to know a Law Firm Case Management Software Company” it’s MerusCase. I’m really excited about MerusCase. You may not have heard of the company before, but hopefully you will remember their name.

A big complaint I’ve had about many case management software companies is that they all have a lot of the same features. Often, it’s hard to differentiate between these players. Now, sure every law firm practice management app should be able to work with your team calendars, keep time, and manage documents and correspondence, but not many of the players in this industry go beyond that. #Media law

    media law: an overview

Freedom of the press is a fundamental liberty guaranteed by the First Amendment of the Constitution. As such, courts and legislative bodies have been hesitant to impinge on that freedom. In fact, there are numerous state and federal statutes that seek to ensure the full extent of the guarantee of the First Amendment, such as the Freedom of Information Act and the Privacy Act .

Historically, media law has been divided into two areas: telecommunications and print sources (newspapers, periodicals, etc.). There are some federal regulations regarding both categories and there are state laws governing both areas as well. The scope of these laws is limited by the First Amendment. (see also: communication law )

The Federal Communications Commission (FCC) regulates interstate and foreign communications by radio, television, wire, satellite, and cable. It was created by the Communications Act of 1934 (47 U.S.C. 151 et seq. ) to regu ... Read more »
