#Child support
Child support is the financial support paid by one parent to the other, to help with the costs of a child aged under 18.
The law says that both parents have a duty to support their children financially, whether they are biological (birth) or adoptive parents, same-sex or otherwise.
Most children in Australia are covered by the Child Support Scheme, managed by the Department of Human Services (Child Support), a Commonwealth Government agency. Its role is to support separated parents to transfer payments for the benefit of their children.
Parents can come to their own agreement about how much child support should be paid. If parents don t agree about child support, the Department of Human Services (Child Support) will assess how much child support should be paid.
If your child is 18 or over and they are studying or have a disability they may be able to get adult child maintenance .
If you are a grandparent or other relative who i

#UK government rewrites surveillance law to get away with hacking and allow cyber attacks, campaigners claim - News - Gadgets and Tech - The Independent
The British government quietly changed anti-hacking laws to exempt GCHQ and other law enforcement agencies from criminal prosecution, it has been claimed.
Details of the change were revealed at the Investigatory Powers Tribunal which is hearing a challenge to the legality of computer hacking by UK law enforcement and intelligence agencies.
The Government amended the Computer Misuse Act (CMA) two months ago. It used a little-noticed addition to the Serious Crime Bill going through parliament to provide protection for the intelligence services. The change was introduced just weeks after the Government faced a legal challenge that GCHQ’s computer hacking to gather intelligence was unlawful under the CMA.
The challenge, by the charity Privacy International and seven internet service providers, claims GCHQ’s acti

What is Constitutional Law?
Constitutional law deals with the fundamental principles by which the government exercises its authority. In some instances, these principles grant specific powers to the government, such as the power to tax and spend for the welfare of the population. Other times, constitutional principles act to place limits on what the government can do, such as prohibiting the arrest of an individual without sufficient cause. In most nations, including the United States, constitutional law is based on the text of a document ratified at the time the nation came into being.
The U.S. Constitution itself became the law of the land well over 200 years ago, and the tenets set forth in the document remain in full force today. The way in which the Constitution is applied, though, has always been subject to court interpretation. As circumstances and public opinion evolve through the years, so too do the interpretations offered by the courts. From time to

A state or local law that prohibits commercial activities on Sunday.
Blue laws have been part of U.S. LEGAL HISTORY since the colonial period. These laws, which today are usually referred to as Sunday closing laws, prohibit certain types of commercial activity on Sundays. Originally these laws were directed at personal activities regarded as moral offenses, such as gambling or the consumption of alcohol. In the nineteenth century, however, state and local governments passed laws that forbade businesses from operating on Sunday. Although these laws were clearly based on Christian beliefs, the U.S. Supreme Court has ruled that they do not violate the First Amendment's Establishment Clause. Many blue laws have been repealed since the 1960s, but some laws that ban the sale of alcohol on Sunday remain in force.
In 1781, the Reverend Samuel Peters published A General History of Connecticut. in which he used the term <

#Children Rights Law.
Children's Rights law exists to safeguard children, their wellbeing and their individual rights. These federal and state policies and laws were spearheaded by the childrens rights movement which promotes legal defenses and protections for children by addressing their social welfare; health, education and special needs; child trafficking; child labor and exploitation and how the juvenile justice system deals with minors.
With regard to child labor, the Fair Labor Standards Act (FLSA) protects child laborers, along with other groups. However, because it was enacted when family farms were much more prevalent, the restrictions on agricultural work for children were fairly lax, and continue to remain so. Under general child labor FLSA rules, children under 13 cannot work and children of 14 and 15 years can only work during certain hours for a limited time period. But children who work in an agricultural setting may do so at the age of 9 years if the

What is Mendel’s Law of Segregation,
How Was it Derived?
The Mendelian Principle or Law of Segregation, also called Mendel’s first law, has been stated in the following manner: a hybrid between two parents differing in a set of characters possesses both parental factors which subsequently segregate or separate in the gametes. This genetic principle, along with complete dominance, modified the early belief that heredity is purely a “blending” process in which the offspring exhibits a character that is intermediate of the two parents.
Originating from Gregor Mendel’s historic research work with garden pea, the law established that the transmission of traits from parents to progeny is carried by elementary units, which he called factor. in uniform, predictable fashion. This “factor” is now called gene or, with reference to those in the same gene pair, alleles. This Law of Segregation is one of two laws

#Workplace Retaliation: What Are Your Rights?
Learn about workplace retaliation -- and what to do if it happens to you.
Most people know that laws exist to protect employees from discrimination and harassment. However, many don't know these laws also protect employees from retaliation. That means employers cannot punish employees for making discrimination or harassment complaints or participating in workplace investigations. And punishment doesn't just mean firing or demotion: It can include other negative employment actions, from being denied a raise or transfer to a more desirable position to missing out on training or mentoring opportunities.
What Is Retaliation?
Retaliation occurs when an employer punishes an employee for engaging in legally protected activity. Retaliation can include any negative job action, such as demotion, discipline, firing, salary reduction, or job or shift reassignment. But retaliation can also be more subtle.

#OSHA: Complying With Workplace Health and Safety Laws
Learn about OSHA, the federal law that requires employers to provide safe working conditions.
The federal Occupational Safety and Health Act, also called OSHA, requires employers to provide a safe working environment for employees. Many states also have their own workplace safety law. In order to comply with OSHA, employers must learn their obligations -- and find out whether they must follow federal or state law.
Which Law Do I Follow -- Federal or State?
When OSHA was passed, it preempted all state occupational safety and health laws. Each state then had the option of submitting a plan to the Secretary of Labor for approval. If the secretary found the plan acceptable, then the state's law was allowed to stand. In these states, called "state plan states," employers must follow the state's laws, regulations, and standards on workplace health and safety, not the federal OSHA.

A paralegal is someone who is specially educated and trained to perform work requiring knowledge of legal concepts, but who is not fully qualified as a lawyer.
Responsibilities of a Paralegal
The paralegal is generally retained as part of the support staff in most law firms or as a direct assistant to a single attorney. Having a paralegal allows the attorneys to deal with the execution of legal matters while still being able to take care of secondary responsibilities behind the scenes. Both “paralegal” and “legal assistant” are synonymous terms in course descriptions and job listings.
Paralegals spend their time helping lawyers carry out a wide variety of tasks. Some paralegals simply keep up with the paperwork that attorneys carry around, while others perform actual research. The exact duties that are carried out depends on the lawyer a person works for. To enter into the occupation of a paralegal, a person will need to go through paralegal

Antitrust laws, or competition laws. are laws which prohibit anti-competitive behavior and unfair business practices. The laws make illegal certain practices deemed to hurt businesses or consumers or both, or generally to violate standards of ethical behavior. Government agencies known as competition regulators regulate antitrust laws, and may also be responsible for regulating related laws dealing with consumer protection. Antitrust laws become a legislative inducement towards fairness and are used as a key for principled business relationships.
Antitrust laws prohibit agreements in restraint of trade, monopolization and attempted monopolization, anticompetitive mergers and tie-in schemes, and, in some circumstances, price discrimination in the sale of commodities.
Efficiency-oriented economists reject the goal of competition and instead argue that antitrust legislation should be changed to primarily benefit consumers. No congress or administration has

Criminal convictions have long-term consequences. For someone who has been charged with a crime, whether a DUI, assault, or a property crime like embezzlement or petty theft, worries about jail time and possible punishments and penalties may be just the beginning. Criminal charges are serious, and even with a first offense, a person charged with a crime may be facing consequences that can affect their life permanently.
While the most pressing concern associated with criminal charges is often fear of being separated from family or loved ones, the ways a defendant can be permanently affected vary greatly. For example, a criminal defendant may lose their job or even their professional license, both common consequences of a criminal conviction. As extreme as it may sound, some states automatically revoke a plumber s license for certain offenses. In addition, conviction for some crimes, such as drunk driving, can result in driver's license suspension. Some criminal defendants may

TULTITLN, Mexico Arizona's new law forcing local police to take a greater role in enforcing immigration law has caused a lot of criticism from Mexico, the largest single source of illegal immigrants in the United States .
But in Mexico, illegal immigrants receive terrible treatment from corrupt Mexican authorities, say people involved in the system.
And Mexico has a law that is no different from Arizona's that empowers local police to check the immigration documents of people suspected of not being in the country legally.
"There (in the United States), they'll deport you," Hector V zquez, an illegal immigrant from Honduras. said as he rested in a makeshift camp with other migrants under a highway bridge in Tultitl n. "In Mexico they'll probably let you go, but they'll beat you up and steal everything you've got first."
Mexican authorities have harshly criticized Arizona's SB1070, a law that requires local police to c

The law of attraction is the name given to the belief that "like attracts like " and that by focusing on positive or negative thoughts, one can bring about positive or negative results. [ 1 ] [ 2 ] [ 3 ] [ 4 ] For example, if a person opened an envelope expecting to see a bill, then according to the law of attraction, the envelope would "confirm" those thoughts and contain a bill when opened. Law, broadly conceived, is a social institution that both shapes and is shaped by social, political, historical, cultural, and economic change. Law and society scholars thus agree that law "is too important to be left to the lawyers," and seek to understand the law through historical, cultural, and empirical approaches. The Legal Studies program is not a pre-law program; instead, students receive interdisciplinary training that emphasizes the reciprocal relationships between law and society key to understanding the social environment. #Choosing a Law School
From fields of study to future career paths, here's what you need to keep in mind when choosing a law school.
Location, Location, Location
If you're not considering a Top 10 school, you may want to start your search by thinking about where you'd like to practice law one day. As a law student, you'll get to be involved in the community through clinics and build connections with professors and students which will, in turn, open doors for job opportunities. So, with that in mind, you can cross out any schools located in states where you do not want to practice as a lawyer.
Don't Play the Field
As you start to narrow down your list of schools based on where they are, you should also be thinking about what kind of law you'd like to practice after you graduate. Law schools do have specialties, just as practicing lawyers do. By applying to schools that are focused on your preferred field of study, you'll be able to better prepare

#Civil law legal definition of civil law
Civil Law
A body of rules that delineate private rights and remedies, and govern disputes between individuals in such areas as contracts, property, and Family Law ; distinct from criminal or public law. Civil law systems, which trace their roots to ancient Rome, are governed by doctrines developed and compiled by legal scholars. Legislators and administrators in civil law countries use these doctrines to fashion a code by which all legal controversies are decided.
The civil law system is derived from the Roman Corpus Juris Civilus of Emperor Justinian I ; it differs from a common-law system, which relies on prior decisions to determine the outcome of a lawsuit. Most European and South American countries have a civil law system. England and most of the countries it dominated or colonized, including Canada and the United States, have a common-law system. However, within these countries, Louisiana, Quebec,

#Cities Need Traffic Laws Recognizing Cyclists As.
Wes Brinkman
Every day in this country, cyclists are treated like second-class citizens, barely tolerated by careless motorists and lazy pedestrians who refuse to share the streets. It’s time to confront reality and enact new traffic laws that reflect the inarguable truth: Cyclists are better than you in every way possible.
From cutting down on pollution, to lowering your commute time, the very existence of cyclists in your city is a blessing. Building protected bike lanes and bike boxes for turning is the least you can do. Anyone with a basic modicum of courtesy knows that cyclists should be allowed to do whatever we want, whenever we want—from riding on the sidewalks if the streets are crowded, to blocking the exits of subway cars during rush hour. Today’s laws need to address that.
Anyone with a basic modicum of courtesy knows that cyclists should be allowed to do whatever we want, whenever we

ACS employ third parties to monitor P2P networks, who log the IP addresses and time of users who are seen to be downloading copyrighted material such as music, software, and video (most importantly pornography. discussed later) [1]. Once the target filename, IP address, and time of download have been ascertained, ACS use a Norwich Pharmacal Order (NPO) through the courts to demand the user's details from the associated IP's Internet Service Provider (ISP). Most ISPs in the UK are quick to roll over to such requests, fearing costly court battles if they do not comply. Once ACS receive the user's personal details (usually in bulk, unencrypted format via email) they send threatening letters demanding high sums (between ?500 and ?800 per user) warning of court cases should the demand not be settled immediately.
The majority of the letters name obscene video names, such as "18 LEGAL LATIN", "50 GUY CREAM PIE", and "6 NURSES TAKE IT UP THE ASS" to name a few [2]. Even if the targe

Send your Wrongful Termination claim to a Lawyer who will review your claim at NO COST or obligation.
To answer the question, "What is Wrongful Termination?" (and to determine whether someone may have been wrongfully terminated), it helps to understand what the phrase "employment at-will" means.
All states have adopted the employment "at-will" doctrine to some degree, which means that employees can generally quit their jobs at any time without advanced notice or cause. It also means that an employer can generally fire or lay off their employees at any time without a reason. Employers often, and legitimately, ask employees to sign contracts or agreements that document and enforce the terms of at will employment, usually in company policy manuals.
There are exceptions to this doctrine. Employees and employers aren't allowed to breach employment contracts or agreements, or violate laws, regulations, constitutional provisions or public policy

"Defamation" is a catch-all term for any statement that hurts someone's reputation. Written defamation is called "libel," and spoken defamation is called "slander." Defamation is not a crime, but it is a "tort" (a civil wrong, rather than a criminal wrong). A person who has been defamed can sue the person who did the defaming. (For in-depth information on defamation claims, check out Nolo's Defamation, Libel Slander section.)
Defamation law tries to balance competing interests: On the one hand, people should not ruin others' lives by telling lies about them; but on the other hand, people should be able to speak freely without fear of litigation over every insult, disagreement, or mistake. Political and social disagreement is important in a free society, and we obviously don't all share the same opinions or beliefs. For instance, political opponents often reach opposite conclusions from the same facts, and editorial cartoonists often exaggerate facts to make their point.

#Collaborative Law.
What is Collaborative Law?
Collaborative law refers to a new method of solving legal disputes that avoids traditional court proceedings. Rather than filing a lawsuit, each side voluntarily agrees to a series of sit-down negotiations between the parties, their attorneys, and any number of experts and therapists trained in the subject matter of the dispute. These meetings allow the parties to openly exchange information and discuss the matter with an understanding that nothing communicated will later be used against them in court. The collaborative law process is founded on good faith. By taking a cooperative approach, rather than an adversarial one, parties can resolve difficult issues that would otherwise lead to expensive and time-consuming litigation.
People tend to use collaborative law to settle highly emotional cases such as business partnership dissolutions, wrongful discharge claims, and family law cases. It is not surprising, then,

#Civil Rights
civil rights: an overview
A civil right is an enforceable right or privilege, which if interfered with by another gives rise to an action for injury. Examples of civil rights are freedom of speech, press, and assembly; the right to vote; freedom from involuntary servitude; and the right to equality in public places. Discrimination occurs when the civil rights of an individual are denied or interfered with because of their membership in a particular group or class. Various jurisdictions have enacted statutes to prevent discrimination based on a person's race, sex, religion, age, previous condition of servitude, physical limitation, national origin, and in some instances sexual orientation.
The most important expansions of civil rights in the United States occurred as a result of the enactment of the Thirteenth and Fourteenth Amendments of the U.S. Constitution. The Thirteenth Amendment abolished slavery throughout the United States. See U.S.

A contract intends to formalize an agreement between two or more parties, in relation to a particular subject. Contracts can cover an extremely broad range of matters, including the sale of goods or real property, the terms of employment or of an independent contractor relationship, the settlement of a dispute, and ownership of intellectual property developed as part of a work for hire.
Typically, in order to be enforceable, a contract must involve the following elements:
The parties to the contract have a mutual understanding of what the contract covers. For example, in a contract for the sale of a mustang , the buyer thinks he will obtain a car and the seller believes he is contracting to sell a horse, there is no meeting of the minds and the contract will likely be held unenforceable.
The contract involves an offer (or more than one offer) to another party, who accepts the offer. For example, in a contract for

The MBA Degree - An Introduction
The MBA (Master of Business Administration) degree is probably the worlds best known and most widely recognized post graduate degree. It is a professional degree - in that it is intended for those who work in business and management i.e. the intention of a program leading to an MBA is to prepare or further prepare individuals for responsible positions in business - usually managerial positions. MBA programs are run throughout the world, as they are seen to be relevant for the preparation of people for work in management irrespective of the industry, business sector, the nature of the economy, etc.
In fact the degree is a bit of a misnomer. For most people this is a management degree, and it is not only relevant and of value to those in 'business' - as normally defined - but also those in government, the public sector etc. The MBA degree title has alwa

PA trespassing laws
Could someone explain to me what the PA trespassing laws consist of.
I do some fox hunting at night and occasionally I'll hunt a field or wood strip that we don't have permission from the land owner. Sometimes I know who the land owner is, but he don't live locally. I want to make sure that I'm legal doing this. I really don't want to get a citation
To my understanding of the PA trespass laws the only way I can be arrested while hunting on private property with out permission is.
1. If the owner has the land posted or clearly marked with no trespassing signs.
2. If the owner has told me to stay off his land (verbal or by letter).
3. If I am damaging crops or any part of the property
4. If I am endangering any person.
5. If I am violating a hunting law (like a safety zone)
Recently I was talking to a land owner that told me that if there is a no trespassing notice in the local

But, in the last decade or two, we have seen a seismic shift in demand for an alternative business education, especially with the rising costs of education. One that teaches the basics in starting your own business and being your own boss. One that is tapped into local startup ecosystems with access to venture capitalists and startup incubators. One that marries expertise in technology development, with startup business and marketing skills. A new breed of business education under the banner: a Master’s in Entrepreneurship.

What is Criminal Law?
Criminal law involves a system of legal rules designed to keep the public safe and deter wrongful conduct. Those who violate the law face incarceration, fines, and other penalties. The American criminal justice system is both complex, and adversarial in nature. With the exception of minor traffic violations, accused individuals will require the assistance of an attorney.
Specific crimes and the consequences for violating them are found in penal codes enacted by legislators at the local, state, and federal levels. Less serious crimes are classified as misdemeanors. These typically carry a maximum of up to one year in the county jail. Examples include petty theft, possession of small amounts of controlled substances, and first-offense drunk driving.
Crimes of a more serious nature are classified as felonies. These carry punishments of a year or more in state or federal prison. Felonies include violent crimes like murder, burglary, a

Bankruptcy allows people to either get rid of most of their debt and start over or work out a plan to replay creditors.
Chapter 11 Bankruptcy provides for reorganization and payment of debts.
Chapter 12 Bankruptcy is for farmers and their families.
Chapter 13 Bankruptcy provides for debt repayment for only individuals.
Have you lost a job or had your income reduced? Do you have unanticipated medical bills? Have your living expenses increased beyond what you need to make your normal minimum payments on your credit cards and other bills? The vast majority of people who need to file bankruptcy end up in that position through no fault of their own. That isn t intended to mean that people who file aren t responsible for their debts. They are. But the bankruptcy laws exist to enable people to get a fresh start when unexpected or unforeseen events occur to render them unable to pay their debts.

I m sure you are right that there are a combination of factors. Still, I think there is probably a tipping point somewhere. I m sure some candidates simply cannot relocate to attend a T4 school, so they attend a distance learning school, but I imagine many of those students at a DL school performed poorly on the LSAT.
It s been a while since I looked, but I think even Cal Western students have an average LSAT of over 150. In my state, I don t think you have to be that smart to pass the bar, so I can t imagine someone who gets 165 on the LSAT has a much better chance of passing the bar than someone who scored 155. There must be a tipping point though.
Total assumption here. but in a state with a bar passage rate of 85%, you probably see something like this

military law , the body of law concerned with the maintenance of discipline in the armed forces.
Every state requires a code of laws and regulations for the raising, maintenance, and administration of its armed forces, all of which may be considered the field of military law. The term, however, is generally confined to disciplinary military law as defined above—i.e. that part of the code that aims at and sanctions the maintenance of discipline in the armed forces. In the past this was also known by the name of martial law. a term that now has the meaning of military enforcement of order upon a civil population either in occupied territory or in time of disorder.
Members of armed forces do not cease under modern conditions to have duties as citizens and as human beings. All systems of military law thus must aim to ensure that the soldier is in no way enabled to escape the obligations of his country’s ordinary law or of international law as recognized in

#Colloquium in Legal, Political, and Social Philosophy
Colloquium in Legal, Political, and Social Philosophy
The Colloquium in Legal, Political, and Social Philosophy was founded by Ronald Dworkin and Thomas Nagel in 1987. It is the original model for all of NYU Law's colloquia. The Colloquium is now convened by Liam Murphy, Samuel Scheffler, and Jeremy Waldron, two of whom will host in any given year.
Each week on Thursday a legal theorist or moral or political philosopher presents a paper to the group, which consists of students, faculty from the Law School and other departments of NYU, and faculty from other universities. The choice of subject is left to the paper’s author, within the general boundaries of the Colloquium’s subjects, and the discussions are therefore not connected by any structured theme for the term as a whole, though in past years certain central topics were canvassed in several weeks’ discussion. The Colloquium aims, not to pursue any particu

By Keith L. Alexander and Ann E. Marimow
Washington Post Staff Writers
About a half-hour later, Young and her partner, Sinjoyla Townsend, who met 13 years ago in a Constitutional Law class at the University of the District of Columbia, became the first same-sex couple to apply to be married in the District as the city officially joined five states in allowing gay marriage .
I'm just so happy. We're whole now. We will actually be a true family like everyone else, Young, 47, said as Townsend, 41, used her thumb to wipe away her soon-to-be wife's tears. After the couple from Southeast Washington rose from the desk, couples in line behind them broke into spontaneous applause and cheers.
For Young, Townsend and the cheering masses, being there, in the tiny and usually sleepy marriage bureau, on the very first day meant everything. There was the history of it all, but mostly it was about having the nation's capital validate their relationships and their fa

Divorce in America is governed by the laws of the individual state in which it occurs. Divorce, also known as "dissolution of marriage," is a legal process in which a judge or other authority legally terminates a marriage, restoring them to the status of being single and permitting them to marry other individuals. Divorce proceedings also include matters of spousal support, child custody, child support, distribution of property and division of debt. Divorce laws vary from state to state. While divorcing spouses once were required to show a reason for the dissolution of the marriage by assigning fault to one of the parties (like adultery, sterility, abandonment, insanity, or imprisonment), every state now allows for "no fault" divorces (usually on the basis of "irreconcilable differences"). Nevertheless, many states still allow their courts to take into account the behavior of the parties when dividing property and debts, evaluating child custody issues, and determining child and spo

I love it when a ready-to-go post is delivered to my in-box, without my even having to ask. This morning, I received from Steve in Qingdao a carbon copy of an email he had sent to a software client of ours for whom we just started working on their China labor law issues after having registered their WFOE. The email is from Steve to the client explaining the various labor documents he prepared for them, including most particularly, a China Employment Contract, but it serves as a great introduction to many of the key differences between China s employment laws and those of the United States.
Here s the email:
As you will see, the Chinese employment system is based on Asian socialist and Northern European models. China s employment law system is quite different from the U.S system. The main difference is that the U.S. is an employment at will system, which means you can terminate employees at any time for pretty much any reason. China s system is the opposite. The Chine

#Commercial Law.
What is Commercial Law?
Commercial law provides the rules that merchants and others involved in commerce must follow as they conduct business amongst themselves and with consumers. It governs the sales of goods and services, negotiable instruments, security interests, leases, principal and agent relationships, contracts of carriage, and much more. In a broad sense, commercial law also encompasses related issues like business bankruptcy and tax planning.
Because various legal issues may be included or excluded from the subject of commercial law depending upon how expansively it is defined, it may be more helpful to consider the matter in terms of timing. Commercial law covers legal issues that arise prior to the initiation of a lawsuit. By contrast, once a lawsuit is filed, the same issues are more properly characterized as litigation. Thus, commercial law attorneys help their clients negotiate and enter into business deals. Litigation attorne
