Grand Valley State University's pre-law program, in keeping with the recommendations of U.S. law schools and LSAC (Law School Admissions Council), is not one major that is defined as pre-law. As law school officials point out, students will learn the law in great detail once they attend law school. As undergraduates, pre-law students should focus on gaining a broad liberal arts education.

GVSU's approach to pre-law encourages students to pursue majors that will complement their law degree while providing the diverse intellectual foundation necessary for success in the field of law. GVSU also recommends that students experience several pre-law courses, courses related directly to law, to help students understand if they are suited for a career in law.

#Top 54 Complaints and Reviews about South University

Consumer Complaints Reviews

Very misleading. I was a young single mother, made very little money and when I looked into this school, they really sugar coated a lot. I did not realize the amount of debt I would inherit after graduation and only receiving an AA degree. I took one class at a time as I worked full time and raised my daughter. I attended school from January 2009 and finally finished my AA December 2014. I borrowed $38K and now I owe over $64K. That is almost double.

How can this be? I cry thinking that now I could NEVER help my daughter when she goes to college, that I still can not even get a decent paying job with an AA and can't afford to go back for my BA. The school wasn't what I imagined a college experience should be. They kept changing counselors, I was withdrawn by mistake and at times it was a nightmare. They gave me classes I didn't need or told me I didn't need classes I actually needed. ... Read more »

#Top online Law Schools - Are they ABA accredited - approved?

It’s difficult to say what school is the best when it comes to learning law online. There isn’t a ranking that’s available anywhere and it’s difficult to find someone who has had experience in learning law online. Also, there are some online degrees out there that might be scams. So, you need to be careful when it comes to choosing what you can take up while you’re at home.

Let’s evaluate you possible options.

Truth be told, any programs taken from online law schools won’t give you as much as opportunities as completing your studies from physical schools—whether it’s the best in the country, or just a small-time state school like in California. There’s also not a lot of them that can be sufficient enough as requirement for the bar exam. As far as I know, there aren’t any ABA-accredited online law schools as of January 2015. Also, it’s good to keep in mind that it’s easier to find ... Read more »

In cleaning out my computer this weekend, I came across this memo from one of our China lawyers (who does a substantial amount of China employment law work) to a client from nearly two years ago. I gave it a quick read and near as I can tell most of it is current. The only things I would note are that the rules can and do vary from province to province and from city to city and that in some cities it is relatively easy to secure permission to have your employee work without having to pay overtime.

I am writing in response to your recent email regarding ______ s China employment matters. The basic response to your questions on PRC employment law are as follows. As you can see, the regulations are quite complex. Please contact me if you would like more detail on these matters, or if you have other related questions.

In Roe v. Wade, 410 U. S. 113 (1973), the U. S. Supreme Court determined that the Constitution protects a woman's decision whether or not to terminate her pregnancy. In a companion case, Doe v. Bolton, 410 U. S. 179 (1973), the Court held further that a state may not unduly burden a woman's fundamental right to abortion by prohibiting or substantially limiting access to the means of effectuating her decision. Rather than settle the issue, the Court's decisions kindled heated debate and precipitated a variety of governmental actions at the national, state and local levels designed either to nullify the rulings or hinder their effectuation. These governmental regulations have, in turn, spawned further litigation in which resulting judicial refinements in the law have been no more successful in dampening the controversy.

The law with respect to abortion in mid-19th century America followed the common law of England in all but a few states. By the time of the Civil ... Read more »

1. What is Privacy?

Privacy is the expectation that confidential personal information disclosed in a private place will not be disclosed to third parties, when that disclosure would cause either embarrassment or emotional distress to a person of reasonable sensitivities. Information is interpreted broadly to include facts, images (e.g. photographs, videotapes), and disparaging opinions.

The right of privacy is restricted to individuals who are in a place that a person would reasonably expect to be private (e.g. home, hotel room, telephone booth). There is no protection for information that either is a matter of public record or the victim voluntarily disclosed in a public place. #Trademark Legal Basics

    What is a trademark?

A trademark is a word, slogan, symbol, design, or combination of these elements, which identifies and distinguishes the goods or services of one party from others. The word trademark or trademark law is frequently used generically to encompass similar identifiers of origin such as service marks, collective marks, certification marks, trade dress, and trade name.

What is the purpose of trademark law?

The primary purpose of the trademark laws is to prevent unfair competition by applying a test of consumer confusion and providing rights and remedies to the owner of the trademark.

The test for consumer confusion is to assure that the consumer can be confident that when buying a product or service bearing a particular trademark the product or service expected is actually delivered. In other words, the consumer relies on a standard of quality established by the association of the trademark in the marketplace ... Read more »

    #Trademark Law (BitLaw)

Trademark Law in the United States

Trademark law governs the use of a device (including a word, phrase, symbol, product shape, or logo) by a manufacturer or merchant to identify its goods and to distinguish those goods from those made or sold by another. Service marks, which are used on services rather than goods, are also governed by 'Trademark law.' In the United States, certain common law trademark rights stem merely from the use of a mark. However, to obtain the greatest protection for a mark, it is almost always advisable to register the mark, either with the federal government, if possible, or with a state government. A mark which is registered with federal government should be marked with the symbol. Unregistered trademarks should be marked with a tm , while unregistered service marks should be marked with a sm .

A mark is infringed under U.S. trademark law when another person uses a device (a mark) so as to cause confusion as to the ... Read more »

    Working on My New Position

Listening with both ears: the why and the how

    The Why

When the average person reflects upon their communication skills, they often contemplate their ability to present ideas in a clear and cohesive fashion. Indeed, the capacity to be understood is necessary for successful interactions. Unfortunately, however, many fail to consider the critical importance of listening within the art of communication. It is important to understand how to effectively listen because it creates efficient interactions, provides the speaker with a sense of value, and enhances your understanding of concepts.

    #Trademark law

A trademark is any word, name, symbol, or design, or any combination thereof, used in commerce to identify and distinguish the goods of one manufacturer or seller from those of another and to indicate the source of the goods. See 15 U.S.C. § 1127.

    Overview

Trademarks are generally words, phrases, logos and symbols used by producers to identify their goods. However, shapes, sounds, fragrances and colors may also be registered as trademarks. See Qualitex v. Jacobsen Products Co. Inc.. 514 U.S. 159 (1995). In recent years, trademark law has expanded to include trade dress and antidilution protection. Almost any word, name, symbol, or device capable of distinguishing the source of goods may be used as a trademark subject to few limitations. However, a mark 's eligibility for trademark protection may be limited by application of the functionality doctrine. and a mark may be denied registration if it falls within any of the categories listed unde ... Click It or Ticket-Enforcement

Oregon’s safety belt overtime enforcement program is a statewide selective traffic enforcement program (STEP) that seeks to reduce the number of motor vehicle-related deaths and injuries by increasing public awareness of laws regarding the three most prevalent factors contributing to traffic crash injuries: safety restraint use, speed, and impaired drivers. Over one hundred city, county and state police agencies utilize safety belt overtime during three two-week “blitz” periods annually. ODOT's Transportation Safety Division provides scheduling and instructional materials to participating agencies prior to each blitz. Participating agencies are asked to conduct public awareness/media activities during the weeks prior to and following each blitz. Observed belt use rates, number of enforcement contacts, and public information activities measure Campaign success. Officers are encouraged to acquire adva ... Read more »

Definition of Law. Part 4 to blupete's Essay

Is it not my design, at this place, to show what stands as law; but, rather my aim is to develop ideas on what law is.6 Law is a "rule of conduct imposed by authority. The body of rules, whether proceeding from formal enactment or from custom, which a particular state or community recognizes as binding on its members or subjects." Upon considering this definition (OED), the first question that arises, is: "On whose authority?" Prior to the 18th century it was on the authority of a divinely appointed king; during the 18th and 19th centuries in England it was on the authority of the landed aristocracy;7 in the 20th century it has been the people, in fact, I submit, the politicians who "manage" to get themselves elected8 ; now, as we enter the 21st century, it's hard to say whose in charge, maybe no one, and maybe, that's the way it ought to be.

For a further development of these ideas, it will be necessary for a person to un ... Read more »

#Trouble for personal injury law firms means trouble for claimants

N early a fifth of the law firms in the north-west of England that specialise in personal injury work are considering closing down, according to a survey conducted last week .

The poll was carried out by O'Connors, a Liverpool law firm that provides business advice to other law firms. Whether its findings are an accurate prediction of what is likely to happen across England and Wales is less important than the broader point it makes: personal injury work is under threat and weaker firms are going to the wall. A new campaign group claims that as many as 100,000 jobs will be lost over the next year. Although predictions such as this have been reported in the specialist legal press for some months now, they tend not to make much of an impact in the mainstream media – at least until a large firm is closed down by the regulator, as happened earlier this month.

#Tree house tests limits of Sullivan - s Island zoning laws - Post and Courier

Hal Coste measures the height of the tree house he built in his Sullivan s Island backyard. Wade Spees/Staff

SULLIVAN S ISLAND Hal Coste hopes to finish a tree house for his grandkids, but so far the town won t let him. In fact, the project may have to come down, he said.

He faces a possible $1,040 fine at an Aug. 3 municipal court hearing after being charged with violating a town order to stop work on the play house that he has been building in a backyard pecan tree.

The tree house is an accessory structure, zoning officials said, which by law can be up to 15-feet high. The 96-square-foot structure is 14 feet from floor to roof but the town measures height from the ground, which means the tree house is officially 30 feet tall because it is 16 feet from the ground to the floor of the tree house.

In addition to the height issue, Coste didn ... Read more »

#Trespassing and the law - Property Law

The law of trespass in relation to land is designed to protect an individual from unlawful interference by somebody else with his land.

Trespassing on to somebody else’s land without a lawful excuse is an offence itself and is one of the rare forms of tort claims in which a claimant can bring a claim without having to prove any damage has occurred. However, it is not a criminal offence and so property owners must bring their claim in the civil courts.

How to bring a trespass claim

In order to bring a claim for trespass there must be direct and unjustifiable interference with somebody’s land. This can occur in a number of ways, with the most common example being jumping over a fence to retrieve a football, but can be as remote as interference from a low-flying aircraft so long as it is flying below a reasonable height.

Yesterday was daylight savings day, which means that you are probably running about your job this morning a little more groggy because you lost an hour of sleep. As I was waffling through emails today in my own groggy state, I received an alert about a new area code being added to the Nashville, Tennessee area.  Naturally, I thought about bid day .

What about bid day? Think about how technology has improved all aspects of the construction industry.  Think about how we deal with electronic drawings. Think about how we communicate between the project site and the home office.  And think about how we transmit proposals on bid day by fax and email.

But technology does not solve all problems. Sometimes, problems with technology create their own problems.  For example, in Federal Acquisition Services Team, LLC (pdf), B-410466, December 31, , the government contractor challenged an agency s decision not to consider its proposal tha ... Two trial lawyers take from the little guy to give to the Left, deep in the heart of Texas

By Jonathan M. Hanen, Foundation Watch. November (PDF to come)

Summary. A Texas power couple composed of two trial lawyers is pouring millions into politics to stop tort reform and turn Texas—and the rest of America—blue. The two give far less to their charitable foundation. In their most notorious case, they took almost half of the winnings in a huge lawsuit they filed on behalf of the “little guy.” As the losing insurance company began paying the fat legal fees, little guys all over Texas saw their premiums rise. Charity, in this case, begins and ends at home.

    A. By law in the widest sense is understood that exact guide, rule, or authoritative standard by which a being is moved to action or held back from it. In this sense we speak of law even in reference to creatures that are incapable of thinking or willing and to inanimate matter. The Book of Proverbs (ch. viii) says of Eternal Wisdom that it was present when God prepared the heavens and when with a certain law and compass He enclosed the depths, when He encompassed the sea with its bounds and set a law to the waters that they should not pass their limits. Job (xxviii, 25 sqq.) lauds the wisdom of God Who made a weight for the winds and weighed the water by measure, Who gave a law for the rain and a way for the sounding storms.

Daily experience teaches that all things are driven by their own nature to assume a determinate, constant attitude. Investigators of the natural sciences hold it to be an established truth that all nature is ruled by universal and constant laws ... Read more »

    #Types of Law Degrees Australia

What are the different types of law degrees?

There are many types of law degrees that you can study for in Australia. Some exist because of the need for professional as well as non-practising qualifications. Law schools also offer Juris Doctor degrees as an alternative to Bachelor of Laws.

    Academic Qualifying Degrees

An academic qualifying degree fulfills the academic side of qualifying for admission into legal practice. If you want to practise law, you need to also complete Practical Legal Training. However, many graduates with a law degree actually choose not to do the extra training required to enter the law profession.

    Bachelor of Laws (LLB)

A straight Bachelor of Laws is typically a 4-year degree. It is open to school leavers with a high enough ATAR (or equivalent) score. University graduates or people with some university experience can also enrol in a LLB. Generally, this reduces the length of the ... Read more »

#U. S. appeals court upholds restrictive Texas abortion law

AUSTIN, Texas A U.S. appeals court on Tuesday upheld the main provisions of a restrictive Texas abortion law including one requiring clinics to have certain hospital-grade facilities, a regulatory hurdle critics said was designed to shut down abortion providers.

The 5th U.S. Circuit Court of Appeals, based in New Orleans, permitted the 2013 law to be applied across the state, although it exempted the application of some provisions to a clinic in the southern city of McAllen. The exemptions had been granted by a lower court on the grounds that its distance from other clinics could cause an undue burden on women in that area.

In its decision, the court said the state's measures were intended to protect women's health.

Under the "ambulatory surgical center" requirement, clinics must meet a set of building standards ranging from widening halls to having facilities for certain surgeries.

    #Window Tinting Exemption

    Medical Review

    Window Tinting Exemption

Arizona law states the amount and manner of window tinting a motor vehicle may have to be lawfully operated in this state. It is a violation of law to operate a motor vehicle that does not meet these window tinting requirements. Specific questions should be directed to your local law enforcement agency.

If you are required for medical reasons to be shielded from the direct rays of the Sun, you may receive an exemption from the window tinting requirements. The exemption is granted for any vehicles that you own as well as other vehicles in which you are a regular passenger.

To apply for the exemption, present a letter, signed by a physician, stating the medical necessity for window tinting and a copy of the registration to all vehicles to be tinted.

The letter and registrations must be submitted to the Medical Review Program for evaluation.

    #U. S. Divorce Law

    Individual State Divorce Laws

    U.S. Divorce/Dissolution

Divorce in America is governed by the laws of the individual state in which it occurs. Divorce, also known as "dissolution of marriage," is a legal process in which a judge or other authority legally terminates a marriage, restoring them to the status of being single and permitting them to marry other individuals. Divorce proceedings also include matters of spousal support, child custody, child support, distribution of property and division of debt. Divorce laws vary from state to state. While divorcing spouses once were required to show a reason for the dissolution of the marriage by assigning fault to one of the parties (like adultery, sterility, abandonment, insanity, or imprisonment), every state now allows for "no fault" divorces (usually on the basis of "irreconcilable differences"). Nevertheless, many states still allow their courts to take into account the behavior of the parties w ... Read more »

#U. S. Department of Labor - Find It By Topic - Youth - Labor - Table of Contents

    Subtopics

The Department of Labor is the sole federal agency that monitors child labor and enforces child labor laws. The most sweeping federal law that restricts the employment and abuse of child workers is the Fair Labor Standards Act (FLSA). Child labor provisions under FLSA are designed to protect the educational opportunities of youth and prohibit their employment in jobs that are detrimental to their health and safety. FLSA restricts the hours that youth under 16 years of age can work and lists hazardous occupations too dangerous for young workers to perform. Enforcement of the FLSA's child labor provisions is handled by the Department's Wage and Hour Division.

A distinction between single-firm and multi-firm conduct is fundamental to the structure of U.S. antitrust law, which, as noted antitrust scholar Phillip Areeda has pointed out, "contains a 'basic distinction between concerted and independent action.'" [ 2 ] Multi-firm conduct tends to be seen as more likely than single-firm conduct to have an unambiguously negative effect and "is judged more sternly." [ 3 ] European competition law also includes a fundamental distinction between single-firm and multi-firm conduct, but a different analytical structure is applied. In U.S. antitrust law, the Sherman Act addresses single-firm conduct by providing a remedy against "[e]very person who shall monopolize, or attempt to monopolize. any part of the trade or commerce among the several States." [ 4 ] This prohibition does not condemn monopoly per se but only monopoly that has been acquired or maintained through prohibited conduct: Most businessmen don't like their competitors, or for t ... A blue law is a type of law, typically found in the United States . designed to enforce religious standards, particularly the observance of Sunday as a day of worship or rest, and a restriction on Sunday shopping. Most have been repealed, have been declared unconstitutional, or are simply unenforced, although prohibitions on the sale of alcoholic beverages. and occasionally almost all commerce, on Sundays are still enforced in many areas. Blue laws often prohibit an activity only during certain hours and there are usually exceptions to the prohibition of commerce, like grocery and drug stores. In some places blue laws may be enforced due to religious principles, but others are retained as a matter of tradition or out of convenience.

Laws of this type are also found in non-Christian cultures such as Israel, where the day concerned is Saturday rather than Sunday, and Saudi Arabia, where the month of Ramadan is involved.

    #Women s Aid - The Survivor s Handbook - Your legal rights

Domestic violence is dealt with both under the criminal law and the civil law. The two systems are separate and are administered by separate courts:

    • The civil law is primarily aimed at protection (or in some cases compensation). A survivor of domestic violence can make an application for an injunction (a court order) either to the Family Proceedings Court or the County Court (usually through her solicitor). Other family proceedings (such as child contact or divorce) also take place in the County Court.
    • The criminal law is primarily aimed at punishing the offender. The police together with the Crown Prosecution Service (CPS) initiate the process. Criminal cases are heard in either the Magistrates' Court or the Crown Court depending on the severity of the charge.

    esr/jargon/html/G/Godwins-Law.html

Godwin's Law /prov./ [Usenet] As a Usenet discussion grows longer, the probability of a comparison involving Nazis or Hitler approaches one. There is a tradition in many groups that, once this occurs, that thread is over, and whoever mentioned the Nazis has automatically lost whatever argument was in progress. Godwin's Law thus practically guarantees the existence of an upper bound on thread length in those groups.

Ah, so if I call you a Nazi, I lose, while if you are a Nazi, you win.

    You just lost.

More precisely, the subsequent value of the thread is zero. It may be continued anyway - some people will put great effort into explaining why the analogy between Nazis and whatever is annoying them is, on this occasion, fully justified and illuminating. And other people will patiently explain why it isn't and why such comparisons are demeaning to those involved in either event.

There are two types of property: real property and Personal Property. Most of the legal concepts and rules associated with both types of property are derived from English Common Law. Modern law has incorporated many of these concepts and rules into statutes, which define the types and rights of ownership in real and personal property.

Personal property, also referred to as movable property, is anything other than land that can be the subject of ownership, including stocks, money, notes, Patents. and copyrights, as well as intangible property.

Real property is land and ordinarily anything erected on, growing on, or affixed to it, including buildings and crops. The term is also used to declare any rights that issue from the ownership of land. The terms real estate and real property generally refer to land. The term land. in its general usage, includes not only the face of the earth but everything of a permanent nature over or under it, including mi ... Read more »

    I. Introduction

This research guide is an introduction to the basic legal materials of modern English law (see English Legal History for historical research). This research guide applies only to the law of England and Wales. Scotland and Northern Ireland have separate court systems, which, while similar, are not identical. This guide does not include information on European Community law, which may be binding on English courts. For guidance with researching EU law, see the European Union research guide. If you are beginning a comprehensive legal research project, refer to the sections of this guide that describe secondary sources first (e.g. sections IX through XI).

    Some comparative notes to remember:

    1. There is no written English constitution (i.e. there is no one single document called the constitution); constitutional law concerns issues such as the role of the state, the protection of individual rights, etc. (see e.g. Anthony King, ... Read more »

    #Workers Compensation Law.

    What is Workers Compensation Law?

Workers compensation law is a system of rules in every state designed to pay the expenses of employees who are harmed while performing job-related duties. Employees can recover lost wages, medical expenses, disability payments, and costs associated with rehabilitation and retraining. The system is administered by the state, and financed by mandatory employer contributions. Federal government employees have access to a similar program.

States have enacted workers compensation laws to replace traditional personal injury litigation, in an attempt to remove risk for both the employee and the employer. Outside of a workers compensation system, employees who become injured or sick as a result of their employment must file a lawsuit and prove their employer is responsible. This can result in delays, and there is a possibility the employee will lose the court case and recover nothing.
