#Adoption Law.

Establishing Legal Parent/Child Relationship

What is Adoption Law?

Adoption law provides a means for parents to voluntarily assume the legal rights and responsibilities of a child not born to them. Following an adoption, all legal ties between the child and the birth parents are permanently severed. The new adoptive parents and the child are treated just like a natural family in the eyes of the law. The adoptive parents decide important matters involving medical treatment, education, and religion, as well as ordinary day-to-day issues that arise in the childs life. Adopted children can inherit from their new parents the same as natural offspring. Some jurisdictions even provide for the issuance of an amended birth certificate displaying the new parents names.

State statutes govern adoption proceedings, and the substantive and procedural rules vary across the country. Most statutes require the local department of family services to p ... Read more »

#Admiralty law

Admiralty law or maritime law is a body of common law and statutory law primarily concerned with private commercial maritime activities. Maritime law covers controversies arising on the sea as well as controversies arising on land that are directly related to maritime activities, such as torts, contracts, passenger travel, and shipping. Admiralty law may apply to such controversies arising between domestic as well as international parties.

Under Article III, Section 2 of the United States Constitution. as implemented by 28 USC § 1333. federal courts have exclusive jurisdiction over cases and controversies arising under admiralty law. That is, no state court may exercise subject matter jurisdiction over any admiralty case. It is, however, very common that parties will submit maritime controversies to private arbitration, usually in England. England is also the forum for the greatest majority of international maritime litigation in court.

#ACS: Law Anti-Piracy Law Firm Torn Apart By Leaked Emails

Earlier this week, anti-piracy lawyers ACS:Law had their website taken down by a 4chan DDoS attack. To those hoping that this is a MediaDefender-type fiasco all over again, trust us - it is.

After coordinating DDoS attacks against the MPAA, RIAA and anti-piracy company AiPlex Software this week, 4chan turned to a new target.

Anti-piracy lawyers ACS:Law, who send out tens of thousands of letters demanding cash-settlements from often innocent Internet subscribers, became the new target. Earning an online degree is now generally accepted as a credible academic qualification. The trend has also resulted in a wide selection of online schools popping up to offer more varied online degree programs.

More established traditional schools and universities such as Yale, Stanford and Harvard may still receive universal praise for their standing in education circles, but a lot of online schools are quickly establishing themselves as key players in the education spectrum.

Online Degrees vs Traditional Degrees

There are undoubted differences between a traditional and online degree, with the latter not restricted to a single location. However a closer look at both shows that despite the many advantages gained from pursuing a degree online, both mediums aren’t that different from each other.

#Administrative law

administrative law , the legal framework within which public administration is carried out. It derives from the need to create and develop a system of public administration under law. a concept that may be compared with the much older notion of justice under law. Since administration involves the exercise of power by the executive arm of government. administrative law is of constitutional and political, as well as juridical, importance.

There is no universally accepted definition of administrative law, but rationally it may be held to cover the organization, powers, duties, and functions of public authorities of all kinds engaged in administration; their relations with one another and with citizens and nongovernmental bodies; legal methods of controlling public administration; and the rights and liabilities of officials. Administrative law is to a large extent complemented by constitutional law. and the line between them is hard to draw. Th ... Read more »

#Adopting children

Adoption is the assumption of full legal and parental responsibility for a child; it is supported by an adoption order. granted through the Court.

An adoption order severs all legal ties with the birth family and transfers parental rights to the new adoptive family.

The child becomes a full member of the adoptive family, takes their surname and assumes the same rights and privileges as if they had been born to that family, including the right of inheritance.

Many children maintain contact with some members of their birth family. This may be letterbox contact with a birth parent, visits to a brother or sister who live elsewhere or some direct contact with other members of the birth family.

In every decision made about whether contact should continue, the child s safety and wellbeing are of paramount importance. Contact, and your views about it, will be a part of the discussion during the < ... Read more »

#Administrative Law.

What is Administrative Law? It covers a wide and varied area of practice, encompassing many different types of governmental legal procedures and regulations, and is not easily defined. Much of government and its public programs operate largely through various agencies on different levels: federal, state, county, and city. These agencies are also known as boards, commissions, departments, and divisions.

They generally have their own specific rules and regulations, which are not usually found in the statutes, with stringent procedures individuals must follow to obtain assistance from the agency and to file claims, grievances and appeals. Legal rulings by Administrative Law Judges (ALJs) have governing authority the same as most precedent law. Administrative law attorneys can offer assistance when maneuvering through these complicated proceedings.

The Administrative Procedure Act is the governing law for federal administrative agencies. Mos ... Read more »

#Adultery laws: where is cheating still illegal?

Several Muslim countries and almost half of all US states still consider adultery a criminal offence

South Korea has decriminalised adultery, revoking a law that punished cheating spouses with up to two years' imprisonment.

With the 60-year old law now deemed unconstitutional, the landmark ruling means that the 5,500 people convicted since 2008 could have their cases reconsidered, according to the BBC. However, there still remains some opposition within the conservative country, with supporters of the law saying that it is vital to help keep families together.

However, campaigners argue that adultery laws are outdated, sexist and an infringement of human rights as the courts should not be regulating consensual adult behaviour that occurs in private.

South Korea was one of only three Asian countries to still criminalise adultery, alongside Taiwan and the Philippines. Al ... Read more »

#Alcohol and young people.

You can be stopped, fined or arrested by police if you’re under 18 and drinking alcohol in public.

If you’re under 18, it is against the law:

  • for someone to sell you alcohol
  • to buy or try to buy alcohol
  • for an adult to buy or try to buy alcohol for you
  • to drink alcohol in licensed premises (eg a pub or restaurant)

If you’re 16 or 17 and accompanied by an adult, you can drink (but not buy) beer, wine or cider with a meal.

If you’re 16 or under, you may be able to go to a pub (or premises primarily used to sell alcohol) if you’re accompanied by an adult. However, this isn’t always the case. It can also depend on the specific conditions for that premises.

#The reflection of light

The law of reflection

Objects can be seen by the light they emit, or, more often, by the light they reflect. Reflected light obeys the law of reflection, that the angle of reflection equals the angle of incidence.

%img src="http://buphy.bu.edu/

duffy/PY106/21c.GIF" /%

For objects such as mirrors, with surfaces so smooth that any hills or valleys on the surface are smaller than the wavelength of light, the law of reflection applies on a large scale. All the light travelling in one direction and reflecting from the mirror is reflected in one direction; reflection from such objects is known as specular reflection.

Most objects exhibit diffuse reflection, with light being reflected in all directions. All objects obey the law of reflection on a microscopic level, but if the irregularities on the surface of an object are larger than the wavelength of light, which is usually the case, the light reflects off in all directio ... #After Arizona Immigration Law, Super Bowl Helps Phoenix Adopt More Friendly Image, But Immigrants Say They Are Still Targeted

With the Super Bowl in town, Arizona Gov. Doug Ducey met with more than 70 CEOs this week hoping to lure new investors to a state that has struggled financially for years because of a global boycott triggered by tough immigration policies that chased away tourists and convention business. Ducey, who took office in January succeeding Jan Brewer, who was for many the face of Arizona's anti-immigrant movement, is part of a statewide effort to use the big game to make over the too-extreme image some have of the state.

Mike Kennedy, former chairman of the Arizona Super Bowl Host Committee, said immigration never came up when NFL owners voted to bring the 2015 Super Bowl to the Phoenix metropolitan area, choosing it over Tampa, Florida. "I don’t feel like its even in the room anymore," he said of the state's contentious immigration battle. "We have a new ... Read more »

#Adoption laws

Adoption: An Overview

Adoption refers to the act by which an adult formally becomes the guardian of a child and incurs the rights and responsibilities of a parent. At the conclusion of the formal process, a legal relationship between child and guardian will have formed. The legal relationship results in the adoptee becoming the legal heir of the adopter and terminates any legal rights then in existence with the natural parents.

While certain jurisdictions only permit one of the two types of adoptions, other jurisdictions recognize two types of adoptions – open and closed adoptions. An open adoption permits the birth mother to select her child’s adoptive parents. A closed adoption, meanwhile, results in the birth mother relinquishing all rights over the child and allows a state administrative agency to conduct the selection process. Some jurisdictions also permit the parents in an open adoption to maintain their visitation and contact rights.

#Algebra Basics - Exponents - In Depth

Exponents are used in many algebra problems, so it's important that you understand the rules for working with exponents. Let's go over each rule in detail, and see some examples.

Rules of 1

There are two simple rules of 1 to remember.

First, any number raised to the power of one equals itself. This makes sense, because the power shows how many times the base is multiplied by itself. If it's only multiplied one time, then it's logical that it equals itself.

Secondly, one raised to any power is one. This, too, is logical, because one times one times one, as many times as you multiply it, is always equal to one.

Product Rule

There s few doors that a Harvard law degree won t open for you, up to and including the oval office.

Though the opportunities for Ivy League law grads mights seem infinite to those of us with less elite pedigrees, there is one law firm that won t even consider hiring these folks.

    #The Prelaw Curriculum

    The Prelaw Curriculum

Many students ask for suggestions in planning a prelaw educational program. At New York University, there is no formal prelaw major or curriculum, and a prelaw student, quite simply, is one who defines himself or herself as such. In other words, being "prelaw" is a state of mind — knowing that eventually you may apply to law school.

No Standard Prelaw Curriculum: As stated in the NYU College of Arts and Science Bulletin, the College endorses the viewpoint of the Association of American Law Schools (AALS) that a single, "best" prelaw curriculum cannot be identified. You should concentrate in those academic areas which most hold your interest. The choice of a major should not depend upon what you think a law school might want, but upon the field most likely to motivate you, whether art history or English literature.

Law schools do not prefer any specific major. Beyond a disciplined study of western civiliza ... Read more »

#Amended Lawsuit Against Phoenix School of Law by Former Profs - Arizona Common Law

Round two is already underway.  Federal Judge Susan Bolton allowed former Phoenix Law School Professors Michael O Connor and Celia Rumann to amend their complaint.  Judge Bolton dismissed the original complaint because she viewed the complaint did not sufficiently state a legal claim.

The facts of the matter are Michael O Connor and Ceclia Rumann were professor at Phoenix School of Law (PSL) and tenured respectively in 2010 and 2011.  Both were tenured until their termination in May 2013.  Both Professors were presented with a letter of appointment on May 3, 2013 which left several material terms undefined, and was a change from their previous tenure contracts. On May 20, 2013 PSL revoked the letters of appointment because it viewed the unresponsive Professors as rejecting their offer of employment for the following academic year.

Most of the top online MBA programs are taught by the same faculty using the same curriculum as their face-to-face counterparts.

America s Top Online MBA Programs

It wasn t all that long ago when the thought of getting an online MBA degree seemed preposterous. Why settle for a third-rate education at a for-profit school whose courses were largely taught by poorly paid adjunct teachers?

But in the past few years, a large number of prestige universities have launched online MBA degrees, making the cyber option a viable alternative, particularly for the vast numbers of people who study in part-time evening programs or weekend executive programs.

The big question then is which schools have the best online MBA programs? U.S. News World Report tried to answer that question earlier this year with a debut attempt to numerically rank the best Internet offerings. But it was a highly flawed and easily manipulated ranking that raised as many questions as it answered (see our critique of the U.S. News ranking ). Surprisingl ... Read more »

#The New Bankruptcy Reforms of 2005: Changes to Chapter 7 and 13

In 2005 Congress overhauled bankruptcy law, making it harder for some people to file for Chapter 7 bankruptcy.

In 2005, Congress overhauled the bankruptcy  laws. Those changes made it harder for some people to file for Chapter 7 bankruptcy ; high income filers that can't pass the means test, will have to repay at least some of their debt in a Chapter 13 bankruptcy. In addition, the 2005 law requires all  bankruptcy filers to get credit counseling before they can file a bankruptcy case -- and additional counseling on budgeting and debt management before their debts can be wiped out.

Here are some of the most important changes in the 2005 bankruptcy law.

New "Means Test" for Chapter 7 Bankruptcy

Under pre-2005 bankruptcy rules, most filers could choose the type of bankruptcy best for them -- and most chose Chapter 7 bankruptcy (liquidation) over Chapter 13 bankruptcy (repayment). The ... Read more »

    #The School

    The School

The University of Chicago Law School occupies a unique niche among this country's premier law schools. Located on a residential campus in one of America's great cities, Chicago offers a rigorous and interdisciplinary professional education that blends the study of law with the humanities, the social sciences, and the natural sciences. Students, faculty, and staff form a small, tightly knit community devoted to the life of the mind. Learning is participatory. Chicago does not seek to impose a single viewpoint or style of thought on its students. Instead, our faculty exposes students to contrasting views, confident in students' abilities to choose their own paths.

    History of the Law School

The Law School opened its doors in 1902, twelve years after the founding of the University of Chicago. It has been an innovator in legal education ever since.

#The Value of the LL. M. Degree? Still Low

Every so often, people ask us about the value of getting an LL.M. degree. Our answer has remained pretty consistent. Is it a tax LL.M. from Georgetown or NYU? No? Then save your money and buy something valuable like gold or drugs. See this graphic (click to enlarge):

Photo credit: some dude on TLS.

But still, people ask: Is it worth it to get an LL.M. degree? And obviously, there are a bunch of people who put down good money chasing an extra credential that has little to no impact on their job prospects.

Why? Well, the simplest answer is that LL.M.s are extremely valuable to law school budgets. LL.M.s are so lucrative for law schools that law school deans are willing to lie or become willfully ignorant as to the employment opportunities generated by an expensive post-law school degree.

    The Universal Law of Gravitation

Gravity is described from the point of view of a universal law. This implies that gravity is a force that should behave in similar ways regardless of where you are in the universe. Gravity It's a force of attraction that exists between any two objects that have mass. The more mass they have, the greater the force of attraction. The closer they are, the greater the force of attraction.

For most objects you get near every day, the force of attraction is so incredibly small that you would never notice the force. Gravity is a very weak force, so between common objects like you and your pencil, the force of attraction is very small because your mass and the mass of your pencil are small. We only get noticeable amounts of gravity when at least one object is very massive. like a planet. The force of attraction between you and the planet Earth is a noticeable force! When you play a game with your friends, like soccer or kickball or checkers, you probably have some rules you follow so the game is fair and everyone knows what they are allowed to do and what they aren’t allowed to do! -- Needing to keep things fair and let people know what is okay to do and not okay to do is the same reason we have laws !

In many ways, laws are like rules that are created by a country’s government. One purpose of laws is to provide guidelines that help keep peace and order. For example, laws about how fast grown-ups can drive help prevent accidents, while laws about pollution help keep our air, water, and soil healthy.

Laws also help to provide citizens with services. Let’s say a country has a law saying all kids must go to school. In order to be able to enforce this law, that country’s government will probably have to build and pay for enough public schools to make it possible. – Making sure a law is and can b ... Read more »

John Yoder and Brad Cates, who headed the Asset Forfeiture Office at the U.S. Department of Justice from 1983 to 1989, slammed civil forfeiture as a “complete corruption” and “fundamentally at odds with our judicial system and notions of fairness,” in an op-ed for The Washington Post . Thanks to civil forfeiture laws. police and prosecutors don’t need to charge someone with a crime to seize and keep their property. Federal bullying prevention legislation has been introduced every year since 2003, when Congresswoman Linda Sanchez (D-CA) first introduced the "Bullying Prevention for School Safety Act." By now, anyone not preoccupied with stories about shark attacks, the Confederate flag or singer Ariana Grande maliciously licking donuts she did not buy, has heard about 32-year-old Kathryn Steinle gunned down by an illegal alien while walking on a San Francisco pier with her father. Her accused killer is Juan Francisco Lopez-Sanchez, a felon from Mexico, who had been deported five times but always managed to sneak back in, choosing San Francisco, he reportedly said, because he knew it was a sanctuary city that would not deport him.

The concept of a sanctuary city comes from the Old Testament.

#This Is What Today s Online Learning Content Tells Us About The Future Of School

Today’s children are extremely savvy. They’ve grown up in a world where information was always just a button away. Buttons? Soon, they won’t even need buttons. With Windows 10, they’ll simply say, “hey Cortana.” She’s more like the world’s greatest librarian than a personal assistant. She delivers content on command. In the future, after children have mastered reading, writing, and arithmetic, will more formal schooling still be necessary?

    Photographer: David Paul Morris/Bloomberg

I watch the way my own children (boys 7 and 10 years old) learn to play video games. They use Google to search for tips and tricks. They watch seemingly endless YouTube tutorials. Even when they’re trying to do something more complex, such as building their own Minecraft Server on a Raspberry Pi, I barely help. I tell them to search the web by themselves. If one blog’s instructions fail and they whin ... Read more »

    #The World’s Worst Immigration Laws

Think Arizona's new immigration law is harsh? The Grand Canyon state has nothing on these guys.

    6-MONTH DETENTION

    Country:  Italy

    Immigrant population: 3.9 million

What the law does: Like much of southern Europe, Italy faces the daunting challenge of trying to regulate and manage massive migration inflows from North Africa and the Mediterranean. In response, the Italian government has instituted various measures aimed at curbing immigration. One of the harshest, passed by parliament in 2009, penalizes illegal immigrants with a fine of €5,000-10,000 and allows immigration officials to detain them for up to 6 months.

Reactions: Suffice it to say that Prime Minister Silvio Berlusconi s tough new legislation has done little to allay the rising tension in Italy over immigration and its role in Italian society. This tension came to a head this Jan ... Read more »

    #Three Strikes Basics

    Three Strikes Basics

In 1994, California voters enacted the Three Strikes and You re Out law in response to the tragic murders of Kimber Reynolds and Polly Klass. The law imposed a life sentence for almost any crime, no matter how minor, if the defendant had two prior convictions for crimes defined as serious or violent by the California Penal Code.

According to official ballot materials promoting the original Three Strikes law, the sentencing scheme was intended to keep murders, rapists, and child molesters behind bars, where they belong. However, today, more than half of inmates sentenced under the law are serving sentences for nonviolent crimes.

The Three Strikes Project exclusively represents these individuals. Project clients have been given life sentences for offenses including stealing one dollar in loose change from a parked car, possessing less than a gram of narcotics, and attempting to break into a soup kitchen.

#What Is the Elder Justice Act?

The National Center of Elder Abuse defines elder abuse as “any knowing, intended or careless act that causes harm or serious risk of harm to an older person – physically, mentally, emotionally or financially.”  A National Institute of Justice study showed that nearly 11% of Americans 60 years of age and older faced some type of elder abuse in the past 12 months. [1] Often, the victims are abused by family or others close to them either in home settings or in care facilities. The Elder Justice Act was signed into law by President Obama on March 23, 2010, as part of the Patient Protection and Affordable Care Act. [2] It provides federal resources to “prevent, detect, treat, understand, intervene in and, where appropriate, prosecute elder abuse, neglect and exploitation.”

At China Law Blog,  Dan Harris has advice for negotiating with Chinese business during periods of economic slowdown. There's a lot of useful insight here regarding cultural and political differences that can affect negotiation relationships, to wit:

There’s a filter bubble.  Chinese bureaucrats and SOE bosses don’t see reality the same way American and European MNC managers do.  Within China the official party line is that everything is going according to plan. It’s rebalancing and the expected results of a successful anti-corruption campaign. Everything is fine. Don’t assume that your Chinese counterparty is as nervous or anxious as you would be at the start of a sustained recession. He may still feel that time is on his side.

Harris, who has previously posted on issues with enforcing contracts in Chinese courts, posted earlier this week on a novel but untested idea for facilitating such enforcement: an "agreement to enforce" clause in which the parties con ... Read more »

    #Tobacco laws

The Texas legislature passed the Texas Tobacco Law in 1997 to limit minors’ access to tobacco and thereby prevent young people from a lifetime of tobacco addiction and possible disease and premature death.

The law holds retailers accountable for tobacco sales to minors and provides strict consequences for youth who are cited for using, purchasing or even possessing tobacco products. If they’re under 18, it’s illegal for them to have cigarettes, dip or other forms of tobacco and for anyone to provide it for them.

The Texas Tobacco Law needs a little help from you. It's up to all of us to keep tobacco out of the hands of minors.

The power was used in around 16,000 such cases last year to prevent death or injury in an emergency situation , the Home Office said.
