The Philippine Online Law Library contains definition of terms and phrases used in the Philippine legal system, based on laws, administrative issuances and jurisprudence.

The source (in parenthesis) of the definition is included for easy reference. A definition based on jurisprudence may not completely follow the arrangement of words or sentences as appearing in the actual decision of the Supreme Court of the Philippines, but great effort is made to be faithful to the language and meaning of the decision.

It is an ambitious collaborative project that will take years to be established. Still, we have to start somewhere. If online research tools, like repositories of jurisprudence, are partly taking the place of traditional sources, a Law Dictionary for the Philippines should also go online.

This project has just started, so please do not expect this to be exhaustive. Not yet. (Note: This project has been suspended.)

The requirements for earning an online MLS degree are the same as for the on-campus degree. Abandonment of a child is defined in Arizona Revised Statute Section 8-201(1) as failing to supervise or support a child with the intent to allow that neglect to go on for an indefinite time. If this form of neglect continues for a period of six months the statute presumes the parent has abandoned the child. (See Reference 1.) Arizona Revised Statute Sections 13-3619 and 13-3623 to provide that abandonment can be construed as a criminal offense, ranging from a class 1 misdemeanor to a class 2 felony, depending upon such factors as the risk to the child and whether or not the abandonment was intentional. Penalties range from a fine of $2,500 and 6 months in prison for a class 1 misdemeanor conviction, all the way up to 12.5 years in prison for a "non-dangerous" class 2 felony. (See Reference 2.)

The first trial to arise from the thousands of lawsuits filed after a hailstorm struck McAllen three years ago ended in a loss for the Houston-based Mostyn Law Firm on Monday evening.

The firm’s founder, Steve Mostyn, made a name for himself after Hurricane Ike pummeled the Texas coast, reaping hundreds of millions in attorney’s fees by representing storm victims in suits against insurers.

His firm represents plaintiffs Andrea and Martin Amaro in their suit against National Lloyds Insurance.

The hailstorm stuck McAllen on March 29, 2012, causing $250 million in damages. The subsequent lawsuits that followed in the storm’s wake drove the cost up to $600 million, according to the Insurance Council of Texas.

Helmets: Although helmets are proven to save lives, riders age 18 and over are not required to wear helmets in Colorado. However, if the motorcycle operator or passengers are under age 18, they must wear DOT-approved helmets.

As with most states, Indiana has specific guidelines in place for the parent who does not receive custody of his children as the result of a divorce. According to Indiana Parenting Time Guidelines, which is used to set a noncustodial parent's visitation times, Indiana visitation laws are based on the premise that it is usually in a child's best interest to have frequent, meaningful and continuing contact with each parent.

According to Indiana State Code Title 31, the only way that a noncustodial parent will not be granted visitation rights is if the court finds after a hearing that the child's physical health and emotional development will be endangered by a parent's visits. The court is allowed to conduct an in-chambers interview with the child before making its ruling. If the court permits, then counsel is allowed to be present at the in-chambers interview.

Family law issues vary and involve everything from adoption to divorce. Most common family law questions relate to issues leading up to and following divorce, including child support, legal separation and dissolution proceedings. Even adoption and paternity issues need to be resolved in court.

Filing for divorce requires that the petitioner, the person seeking the divorce, file a Petition for Dissolution with the local county clerk's office and serve a copy of the petition to the respondent, the other party. Once the respondent answers and provides all information requested, he may also file discovery documentation requesting information from the petitioner.

Typically, the court will order a mediation in which such issues as property settlement, child custody and financial support can be resolved. If this action is unsuccessful, the matter may proceed to trial. The judge will then determine the outcome and will enter a Final Decree for Dissolution.

#NCAA - s $60 Million Video Game Lawsuit Settlement Approved by Judge

NCAA student-athletes who had their names or likenesses used in video games created by Electronics Arts are now entitled to a portion of a $60 million settlement approved by a federal judge this week.

The Associated Press reported U.S. District Judge Claudia Wilken approved the settlement Thursday. Attorney Steve Berman released a statement about the continued progress in the fight for student-athletes' rights.

"This landmark decision marks the first time student-athletes will be paid for the likeness or image, and stands as a huge victory in the ongoing fight for student-athletes' rights," the statement read.

Judge Wilken also ruled against the NCAA in the high-profile Ed O'Bannon case, which covers the more general usage of athletes' names, images and likenesses. That decision is currently in the appeal process and could reach the Supreme ... Read more »

In the United States, a divorce can impact a family-based immigration petition in different ways, depending on the type of the immigration petition you're filing and when your divorce is final -- before you file the petition, during the decision process or after immigration relief has been granted.

    Employment contracts should have the basic provisions that other contracts have. There should be some section evidencing that the parties both agree to the contract; a term called "mutual assent." This can be a simple statement saying to effect: "Now therefore, the parties hereby agree." This statement binds the parties to the contract and, absent other evidence to the contrary, indicates the parties read and understood the terms and agree to follow them.

    Many employment contracts contain covenants not to compete with the employer should the employee leave the business. These will generally be upheld if the provision is reasonable. What is reasonable depends on the type of business and the type of employment. The non-compete agreement must be specific as to the duration and the types of activities that are prohibited. A non-compete agreement that is too overbearing, such as requiring the employee to not compete for a duration of over five years, will likely not be upheld.

    Can you earn a law degree online? Skip the lecture hall, the Socratic style questioning – indeed, the entire law school experience? If so, perhaps you can’t for much longer at Novus University Law School. Touro College is taking them to court for producing sham degrees.

The administration is selling the rule as protecting drinking water, but make no mistake — this is about power and control.

    Just how bad is the new rule? It is so broad and so expansive that the EPA was forced to specifically exclude puddles from the regulation's reach.
