#Australian senate passes controversial anti-piracy, website-blocking laws
Ben Grubb
Piracy websites will soon be blocked in Australia.
In the eyes of at least one intellectual property academic, the passing of controversial anti-piracy website-blocking legislation in the senate on Monday night represented a very dark day for the internet in Australia .
But for the film and TV industry, which has been battling online piracy at record levels, it was a watershed moment. Finally they could seek a remedy in the courts to block access to sites offering their content for free.
The Copyright Amendment (Online Infringement) Bill 2015, introduced into parliament by Communications Minister Malcolm Turnbull in March to curb online piracy of film and TV shows, passed with the Coalition and Labor's support 37-13.
The senate votes for the Copyright Amendment (Online Infringement) Bill 2015.
The Australian Greens opposed it, as d

Horrendous as it sounds, it s true: child abuse has become a business – an industry of sorts – that actually pays states to legally abduct your children and put them up for adoption!
Even more unbelievable is that, instead of pumping the money back into child protective service programs, some states actually are putting it into their general funds to help balance their budgets.
A number of groups have tried to reform this shady practice. but it was a California politician who caught media attention this past summer, when he said that, if elected, he would expose how local governments were amassing billions of dollars in annual reimbursements, in exchange for what amounted to legal abduction of children.
Most people are not aware of how much profit many of these services provide the county, John Van Doorn told a San Diego newspaper . These profits are hard to ignore and even more difficult to pass up.
Counties can bring in thou

VICTORIA -- A liquefied natural gas industry: the British Columbia government fought an election on it, launched an extraordinary summer legislative session and made financial concessions, but it still isn't enough for the companies that want even lower taxes and have expressed concerns over the availability of workers.
The Liberal government's LNG dream is expected to move towards reality this week when a bill is adopted for a 25-year agreement on what could be B.C.'s first LNG plant.
B.C.'s politicians were recalled this month to debate and pass a single piece of legislation that aims to provide certainty to LNG investors and revenues to the province.

Search On Divorce Laws in India
Either party to the marriage may present a petition for divorce under cl. (i) of sub-sec. (1) of s. 13, on the ground of adultery of the respondent. The expression 'living in adultery' used in old s. 13(I)(i) meant a continuous course of adulterous life as distinguished from one or two lapses from virtue. It would not be in consonance with the intention of the Legislature to put too narrow and too circumscribed a construction upon the words 'is living' in (old) cl. (i) of sub-sec. (1) of s. 13 of the Act. On the other hand, it was clear that too loose a construction must also not be put on these words. For attracting the operation of these words, it would not be enough if the spouse was living in adultery sometime in the past, but had seceded from such life for an appreciable duration extending to the filing of the petition. It is not possible to lay down a hard and fast rule about it since the decision of each case must depend upon its own me

#Auto Fraud – Lemon Law – Lemon Cars – Lemon Law Attorneys
Lemon Law
State lemon laws have been created to protect consumers when they have purchased a defective vehicle. Typically, a lemon law requires a manufacturer to provide a refund or replacement for a defective new vehicle that is not repaired within a reasonable number of attempts. Most such laws provide for refund or replacement when a substantial defect cannot be fixed in four tries or a safety defect within two tries, or the auto is out of service for 30 days, within the first 12-18,000 miles/12-24 months.
Beyond state lemon laws, a consumer has the right to a refund or replacement of a lemon vehicle under the Uniform Commercial Code (UCC). The main difference is that the UCC law does not define a lemon, so it i up to a court to decide if an auto company must give you a refund or a new car. The federal Magnuson-Moss Warranty Act provides for the award of attorney fees from the manufacturer if you have t

Human Rights are the basic rights and freedoms to which all human beings are entitled, like civil and political rights, the right to life and liberty, freedom of thought and speech/expression, equality before the law, social, cultural and economic rights, the right to food, the right to work, and the right to education. In short, human rights are freedoms established by custom or international agreement that protect the interests of humans and the conduct of governments in every nation.
Human rights are distinct from civil liberties, which are freedoms established by the law of a particular state and applied by that state in its own jurisdiction.
Human rights laws have been defined by international conventions, by treaties, and by organizations, particularly the United Nations. These laws prohibit practices such as torture, slavery, summary execution without trial, and arbitrary detention or exile. Many human rights are secured by agreements between the govern

Some law schools, such as the University of Pennsylvania and the University of Michigan, ask you to write a short statement (in addition to a personal statement) detailing why you wish to attend their school. You should consider this a question you need to answer in all of your applications. It is harder than ever to be accepted to law school, and tailoring each application has become the practice of the most serious candidates. Tailoring your statement helps you connect with the people reading your application. It demonstrates that you want to be part of their program specifically. If you send the same statement to eight schools, you are sending the message that they have to want you and be willing to fight for you. The committee will be more willing to risk accepting you if they think you really want them and that you will be truly thrilled to go there. The committee wants you to give them specific reasons for why you two are a good match. You

If Henry Bergh, founder of the American Society for the Prevention of Cruelty to Animals, were alive today, even he might be surprised by the sheer number and tenacity of politically savvy dog owners and animal welfare organizations.
During hearings on controversial local and state bills, legions of canine enthusiasts pack rooms to voice their support or opposition. In July 2007, animal advocates began lining up outside California s Capitol nearly two hours before a senate committee hearing on a statewide mandatory spay-neuter bill. Hundreds of people attended a hearing in Boston earlier this year when lawmakers decided to explore the idea of a statewide ban on pit bull-type dogs.
The reason for the intense interest and passionate debate is simple: Dogs have captured our hearts — so much, that 45 million U.S. households choose to share their lives with some 65 to 80 million dogs. But society s view of dogs often differs from how the legal system sees them. Under the

(redirected from statute law )
An act of a legislature that declares, proscribes, or commands something; a specific law, expressed in writing.
A statute is a written law passed by a legislature on the state or federal level. Statutes set forth general propositions of law that courts apply to specific situations. A statute may forbid a certain act, direct a certain act, make a declaration, or set forth governmental mechanisms to aid society.
A statute begins as a bill proposed or sponsored by a legislator. If the bill survives the legislative committee process and is approved by both houses of the legislature, the bill becomes law when it is signed by the executive officer (the president on the federal level or the governor on the state level). When a bill becomes law, the various provisions in the bill are called statutes. The term statute signifies the elevation of a bill from legislative proposal to law. State and federal statutes are c

The story of Megan's Law
President Clinton: Signed Megan's Law
The conviction of Roy Whiting for the murder of Sarah Payne has again the raised the issue of how society deals with sex offenders, with some campaigners looking towards the USA and its controversial "Megan's law".
American parents - unlike their UK counterparts - have access to information on paedophiles living in their local area under legislation known as Megan's Law.
The law - which was signed by President Bill Clinton four years ago and has been adopted in some form by all 50 states - arose from the rape and murder of seven-year-old Megan Kanka.
She was killed by Jesse Timmendequas, a known child molester with two previous convictions for sexual offences, who had moved across the street from her family without their knowledge.
This caused outrage in the US and Megan's mother campaigned for a chang

#Bankruptcy Law - Guide to Chapter 7, 11, 13.
What is Bankruptcy?
Bankruptcy allows individuals, couples, and businesses that cannot meet their financial obligations to be excused from repaying some or all of their debt. Bankruptcy has been in existence since ancient times. In the United States, the rules and procedures for filing bankruptcy are governed by federal law. States are prohibited from legislating in this area of the law.
Generally speaking, there are two types of bankruptcy. In a liquidation bankruptcy, debtors must surrender their property, which is sold, and the proceeds distributed to creditors. In return, all debts are permanently discharged. In a reorganization bankruptcy, debtors are allowed to keep their property. But the debtors must agree to an installment plan to repay creditors a portion of the amount they owe.
Filing for bankruptcy involves submitting a petition and fee to the bankruptcy court. The fee is close to $300 for most

This guide is based on UK law. It was last updated in October .
If your business has a website, it should be accessible to disabled users. There are ethical and commercial justifications for this, but there is also a legal reason: if your website does not meet certain design standards, then you could be sued for discrimination.
To date, few companies have faced such legal action. In two cases, actions were initiated by the Royal National Institute for the Blind (RNIB), and both settled without being heard by a court. The RNIB decided against naming the two companies. It has long been anticipated that a higher-profile test case will be launched against a non-compliant website. Clearly, this is a battle which any business will want to avoid.
There has been one case on the accessibility of electronic services that resulted in an employment tribunal finding of discrimination. That case, decided in October 2006, involved the accessibility of a computer-ba

#Best Law Firm Websites, 2014 Edition
Get our White Paper, "10 Things the Best Law-Firm Website Designs Have in Common"
For the past five years, Lawyerist has published an annual list of the best law firm websites. Now, you can find out what they have in common.
The 2015 best law firm websites are out! Check out the current top 10.
Out of over 50 nominations, we have narrowed the field down to the ten best. There were many good nominations, but the top ten are some really excellent, responsive websites.
Responsive web design turned out to play a big factor in getting to the top ten. A responsive website should look good on any screen, from a big desktop display to a smartwatch. Law firm websites still have a way to go on this, though. Many great-looking nominations — including some websites built in the last year — wound up in the discard pile because they are not responsive.
Apart from responsiveness, however, I will not explain t

Since 2003, 25 states have introduced workplace bullying legislation that would allow workers to sue for harassment without requiring a showing of discrimination.
Critics contend that these laws would encourage frivolous lawsuits. Could they protect workers from bullying while not opening up employers to scores of meritless claims or imposing a civility code on the workplace?
In fact, workplace bullying may lead to the boldest proposed change in U.S. employment law since the passage of Title VII of the Civil Rights Act, said Lori Armstrong Halber, a partner in the Philadelphia office of Fisher Phillips.
We all agree with the concept that there shouldn't be jerks in the workplace, but the issue is whether we can legislate that, said Rick Grimaldi, a partner in the Philadelphia and Washington, D.C. offices of Fisher Phillips. The whole concept is difficult to get your head around when you think about how expansive this could be. Every disgruntled employee bec

[bad kred-it] n. Financial industry term for a credit history indicating that a person is a high credit risk. A credit score of less than 560 is generally considered to be a bad credit score.
Lenders use your credit reports and your credit scores to make assumptions about your credit risk. The lower your credit score, the more risky they feel it is to lend you money, and the higher interest rates they will charge if they are willing to approve your loan request at all. Having a bad credit score means that lenders will consider you to be a high credit risk.
Even more, there are a number of other entities that will use your credit history to make assumptions about you. Landlords, insurance companies, and potential employers may all consider your credit score. Consumer protection laws are federal and state statutes governing sales and credit practices involving consumer goods. Such statutes prohibit and regulate deceptive or Unconscionable advertising and sales practices, product quality, credit financing and reporting, debt collection, leases, and other aspects of consumer transactions.
The goal of consumer protection laws is to place consumers, who are average citizens engaging in business deals such as buying goods or borrowing money, on an even par with companies or citizens who regularly engage in business. Historically, consumer transactions purchases of goods or services for personal, family, or household use were presumed fair because it was assumed that buyers and sellers bargained from equal positions. #Best Online Law Schools: JD and LLM Programs
Which are the very best online law schools?
This is hard question because there isn't a clear ranking system -- US News doesn't rank online degree programs -- and actual first-hand information is scarce for online law schools. There isn't much accountability at online law schools.
Let's take a step back.
No juris doctor program at an online law school. at the moment, is going to give you the kind of career you would have if you attended a national top-tier law school like Harvard, or even a regional powerhouse (like University of Alabama if you live in Alabama, for instance).
Indeed, there are not that many online law schools, actually, that permit you to sit any state's bar exam. Basically, if you're you can only take the bar in California. None are, at the moment, ABA-accredited (this is important because if you graduate from a law school with ABA accreditation, you can take the bar exam in any of the 5

The vast majority of the law enforcement officers in this country perform their very difficult jobs with respect for their communities and in compliance with the law. Even so, there are incidents in which this is not the case. This document outlines the laws enforced by the United States Department of Justice (DOJ) that address police misconduct and explains how you can file a complaint with DOJ if you believe that your rights have been violated.

#Best Law Firm Websites of 2014
Lawyerist released its annual Best Law Firm Websites list. Apparently 10,000 people voted, over 50 websites were nominated, and Lawyerist chose the top ten. Although Lawyerist didnt release how exactly they chose the 10 winners, they did say that the responsiveness of the website (how it looks on your mobile phone) played a big part in the judging process.
None of the websites were anything to rave about. Law firm websites are notorious for being poorly designed. There is a movement to change that and have design finally permeate the legal industry led by Margaret Hagan. She frequently speaks at the legal innovation conferences that are popular these days. The winner this year was Kith Kin. a boutique firm in Toronto. The site had more colors than an artists’ palette and each page contained more words than Les Miserables. Below are some general comments on the site:

#Basic principles of company law
This article is based on UK law as at 1st February 2010, unless otherwise stated.
Companies come in many different shapes and sizes; there are key differences in what they can and cannot do, and the purpose for which each is designed. But all are separate legal persons independent of their directors and shareholders. Only rarely will the law look behind a company and treat it as being the same person as those who control it.
This concept of a company as a separate legal personality has two consequences:
- A company’s property belongs to it and not to its directors, management or shareholders. Even if you are a sole director and a 100 per cent shareholder, you can still be found guilty of stealing from your own company. Liquidators and future owners will have an interest in pursuing claims for theft or misuse of assets where a company has been plundered by those in day-to-day control. Many a corporate swindler ha

#Barack Obama Speaks Before Catholic Leaders About Health Care Reform
But will note "outcomes that are harder to calculate"
President Obama will use emotion to appeal to Catholic healthcare professionals in a speech about the future of American health care on Tuesday, as the future of his signature health law hangs in the balance at the Supreme Court.
In a speech before the Catholic Health Association s annual assembly on Tuesday, Obama will tout numbers to support the controversial law, including Gallup s estimate that the uninsured rate has fallen from 17.1% in 2013 to 11.9% in 2015 and that one in four uninsured Americans has gained coverage under the law. Some 16 million Americans, the Obama administration says, have gained coverage since the law was passed.
But he ll also note the outcomes that are harder to calculate in his speech before the Catholic Health Association, days before the Supreme Court is expected to issue a ruling on a challenge to whe

Although every lawyer has his or her own unique way of doing things, most law offices share a surprising number of similar characteristics in terms of how they do business. Understanding some of them will help you to get more effective legal representation.
Law offices range in size from sole practitioners to firms with literally hundreds or even thousands of lawyers. While all of them charge for their time in one form or another, there are some practical distinctions to keep in mind that can roughly be broken down by the following categories:
Sole Practitioners. Once a lawyer has passed the bar exam, it does not take much more to start his or her own practice other than renting office space and hanging up a shingle. Thus, it is not surprising that law offices of sole practitioners are probably the biggest single category of practicing lawyers. Sole practitioners can be excellent lawyers and so you may want to consider retaining one if it makes sense, give

MBA RANKINGS
Many business publications such as Wall Street Journal, The Economist, Financial Times and Business Week publish different rankings from year to year, though all data in a ranking may not be accurate it is still useful and it must be looked over with a critical eye because of different reasons:
- Data published by ranking publications deals with "how good the program is", remember that the best data comes directly from the school or online mba degree program because it deals with "how well the program fits you" .
Most rankings do not examine all MBA programs available and sometimes leave some schools out of the ranking because they are new, small or because they donґt have much alumni.
Sometimes methodologies used are flawed and statistics may be misinterpreted because of the context, so always read info on how data was gathered.
Some schools give only limited information since they believe school ra

In an ideal society, all current UCC Maritime laws would be replaced with the 20 Universal Laws:
This law supersedes even the fundamental law of Karma, for harmony is the supreme potential of balance.
The purpose of Karma is to attain harmony.
If you throw a rock into a pond you disturb the harmony of the pond, you are the cause, the effect is the splash and the ripples that flows out and back until harmony is restored.
Similarly, your disharmonious actions flow out into the Universe and back upon you, lifetime after life time, until eventually your own harmony is restored.
Until you have resolved your Karma and fulfilled your Dharma, which are the deeds you must do, you will continue to reincarnate into sequential lifetime upon the earth. #Ben Carson: Can Obama use martial law to keep White House post 2016
SAN ANTONIO, December 14, 2014 — Dr. Ben Carson, a black neurosurgeon and likely 2016 Republican presidential candidate, has repeatedly stated that he believes there is a chance that the 2016 elections may not be held at all. Widespread anarchy gripping the country could be reason enough for the Obama administration to announce the implementation of martial law and the suspension of some, if not all, of Americans constitutionally protected rights — including the right to vote and hold national elections.
On the surface this seems unbelievable, but upon further analysis, Carson s ominous suggestion is plausible; this is an extremely unnerving scenario that all Americans should be aware of and ready for. The Obama administration has very quietly and subtly done many inexplicable things that could very well be precursors to the suspension of some, if not all, of Americans constitutionally pr

In 1981, German lawmakers passed the Narcotics Act in an attempt to crack down on a growing drug problem in the country. Primarily, the law--which has been amended several times--had the main intention of protecting the health of the public. The law includes clauses on rehabilitating drug users outside of prison, permission to use methadone in clinic settings, and allowing for sterile needle exchange programs for intravenous drug users.
Where marijuana is concerned, the law's main effect was in allowing prosecutors the discretion to choose to not prosecute cases that the prosecutor deems minor enough.
Acquiring drugs is a crime in Germany, and those found guilty are sentenced to 1 month to 4 years in prison and must pay an appropriate fine. The amount of the fine is not set and is decided by individual judges for each case, who weigh in factors such as how much a person was caught with. Sentences are typically more lax in the less conservative states of northern Germ

MASSACHUSETTS GENERAL LAWS AND HUMAN BURIALS
Valerie A. Talmage
The discoveries of several human burials in Massachusetts have raised questions about the appropriateness of archaeological excavation and anthropological analysis of human skeletons. Archaeologists, Indians, project planners and the public have voiced concerns which echo similar issues raised in several other states.
Is it legal to excavate human skeletons? Is it appropriate to excavate burials? Does a construction project, such as a highway, or even an individual septic system, take precedence or is the sanctity of a burial place protected? Is it appropriate to rebury excavated skeletons and their associated artifacts? Are burials of Indians provided the same protection which the law affords burials of white people? When is excavation of human burials in the public interest? How should excavations be authorized and administered?

In this article James Normington of New Park Court Chambers explains some of the key points of English contract law. Every businessman and women should be familiar with these concepts.
Contracts occur in every business. It might be as simple as the agreement with the milkman to deliver the milk and your obligation to pay for it, or it might be an order you made with a major supplier. There is one thing which you can be certain of, which is that you don’t want to find out there is a problem with your contract when you are walking through the door of a courthouse with a disgruntled person on the other side.
This contract focuses on English contract law, which shares many common features with other common law jurisdictions such as Australia, New Zealand, Canada and the United States, although individuals from those countries should always seek appropriate legal advice.

America has a long history of gun use, going back to colonial times, when the war of independence was fought by the people of the country. As the expansion towards the west began in the early 19th century, pioneers faced multiple threats in the form of marauding Native American tribes, grizzly bears and other carnivorous animals. This led to the emergence of a deeply entrenched gun culture in the western and southern parts of the country, where everyone, children and women included, were required to operate a firearm and protect one another.
Also, as farming and hunting were initially the only means of subsistence, using a gun was like using an ax, a necessity rather than recreation. Famous frontiersmen like Daniel Boone, Davy Crockett and Wild Bill Hickok were famous for their prowess with guns, and their legends. Even several fabricated accounts for dime novels and penny dreadfuls, grew to extraordinary heights.
Over the past 200 years, the need for weapons, especi

There s a little-known way to maximize the value of a federal trademark registration recording it with U.S. Customs and Border Protection.
Taking this extra step (and paying the $190 fee required to do so) puts your trademark on Customs radar screen. It helps put the government to work for you stopping counterfeit goods bearing your trademark at the border.
Besides alerting Customs about its mark, the owner of a federal trademark registration can provide additional information to help stop counterfeit goods from entering the States, such as the place authentic goods are manufactured; the authorized port of entry into the States; and what authentic goods look like. When Customs inspects goods bearing the registrant s trademark that do not match this criteria, it will seize the goods and contact the trademark owner to determine whether the goods are real or fake.
Customs only inspects small percentage of goods that are imported into the States. To be sure, plen

Capital Punishment: Deterrent Effects Capital Costs
by Jeffrey A. Fagan, Professor of Law Public Health; Co-Director, Center for Crime, Community, and Law
Capital punishment stirs up fierce debate in the United States. In this essay, Professor Jeff Fagan questions research that supports the long-accepted view of the deterrent effect of capital punishment. States must also come to terms with the fact that each execution can cost between $2.5 million and $5 million, he writes, and ask themselves whether that money can be put to better law-enforcement uses.
Long before the U.S. Supreme Court restored capital punishment in 1976 in Gregg v. Georgia. proponents of the death penalty claimed that executions save lives by deterring murders. This was a popular but unscientific view that was largely untested until 1975, when University of Buffalo Professor Isaac Ehrlich published an influential article asserting that during th

Enrolling in an MBA program is one of the biggest investments you can make. Top business schools charge upward of $100,000 for a two-year, full-time program. This means that you quit working and focus all your time, energy, and savings on your education. The return on investment is worth it for many. You gain knowledge and skills that can propel you forward in your career, which often means earning a sweet salary after graduation.
Tuition costs can vary dramatically from program to program. The average MBA tuition can be between $50,000 per year, or $80,000 for the full two years. Some MBA programs can be more than $60,000 a year or more in tuition alone. We've provided the tuition to the top 30 MBA programs on our MBA Rankings page. However, when you think about the price of an MBA you must also weigh the benefits of earning the degree -- because these amounts are inseparable from each other, and cutting down on the cost could produce a disproportionately high drop in ROI.<

International criminal law
Written by Dana Neacsu Last Updated December 5,
Primary responsibility to investigate and punish crimes has always belonged to individual states. Thus, international criminal law is an exception from this rule. Finding books on this topic or similar topics (international jurisdiction) may be daunting so here are a few good points about how to find them:
- Use the Diamond Law Library’s catalog, PEGASUS. to find sources in the law library and use the University Libraries’ catalog, CLIO (go to PEGASUS and choose it from the drop down menu CATALOGS mentioned there), to find resources at other Columbia libraries. You may also use WorldCat (go to PEGASUS and choose it from the drop down menu under CATALOGS) to find books beyond the Columbia system.
- To find law journal articles that may contain articles on domestic views on international criminal law, use Wilson’s Index to Legal Periodicals. To find foreign int

Question: What traffic laws apply to bicyclists?
Answer: When ridden on any roadway a bicycle rider has all of the rights and responsibilities of any vehicle (RCW 46.61.755). Unless bicycles are specifically excepted, all traffic laws and rules apply to bicycles. Bicyclists who violate traffic laws are subject to a citation.
Question: Should bicyclists ride with the flow of traffic or facing traffic?
Answer: Bicyclists should always ride with the flow of traffic (RCW 46.61.100). The law requires this. Riding with the flow of traffic greatly increases safety by making bicycles visible and predictable to other drivers. Riding against traffic is a leading cause of bicycle accidents.
Question: What position in the lane should a bicyclist use?
Answer:
1) Bicyclists traveling at the speed of traffic may use the middle of the lane.
2) A bicyclist traveling at a speed less than the normal flow
