Overview of Intellectual Property Laws
A wide body of federal and state laws protects creative property such as writing, music, drawings, paintings, photography, and films. Collectively, this body of law is called “intellectual property” law, which includes copyright, trademark, and patent laws, each applicable in various situations and each with its own set of technical rules.
When obtaining permission to use creative works, you’re concerned primarily with copyright law. However, trademarks, trade secrets, and publicity and privacy rights sometimes come into play when permission to use certain types of works is sought. Below is a summary of the various types of intellectual property laws that are relevant to the permissions process. Later chapters provide more details as needed.

Disability discrimination occurs when an employer or other entity covered by the Americans with Disabilities Act, as amended, or the Rehabilitation Act, as amended, treats a qualified individual with a disability who is an employee or applicant unfavorably because she has a disability.
Disability discrimination also occurs when a covered employer or other entity treats an applicant or employee less favorably because she has a history of a disability (such as cancer that is controlled or in remission) or because she is believed to have a physical or mental impairment that is not transitory (lasting or expected to last six months or less) and minor (even if she does not have such an impairment).
The law requires an employer to provide reasonable accommodation to an employee or job applicant with a disability, unless doing so would cause significant difficulty or expense for the employer ("undue hardship").
The law also protects people from discrimination based

#Common Law Trademark Rights (BitLaw)
Common Law Trademark Rights
Trademark rights arise in the United States from the actual use of the mark. Thus, if a product is sold under a brand name, common law trademark rights have been created. This is especially true once consumers view the brand name as an indicator the product's source.
The BitLaw discussion of common law trademarks is divided as follows:
Common law trademarks versus federal registration
The term common law indicates that the trademark rights that are developed through use are not governed by statute. Instead, common law trademark rights have been developed under a judicially created scheme of rights governed by state law. Federal registration, a system created by federal statute, is not required to establish common law rights in a mark, nor is it required to begin use of a mark. However, federal registration, if available, is almost always recommended and gives a trademark owner subs

Millions of Americans experienced bullying at some point as a child. I personally experienced bullying between 5th and 8th grade when I went through a phase where I stopped growing up as much as out for a few years. Psychologically, I saw myself as a short, fat kid for years after, well into college when I was actually 6'3? tall and well built. The effects of bullying can be damaging and long lasting.
As a result, forty-nine states in the US have passed anti-bullying legislation focused on bullying that occurs at school. Georgia led the charge in 1999 when it was the first state to pass such legislation, while Montana lags behind the rest of the country and remains, at the time of writing, the only state in the union without anti-bullying laws.
There are no federal laws dealing specifically with bullying and harassment in schools, but the ?Safe and Drug-Free Schools and Communities Act? is part of the federal ?No Child Left Behind Act? of 2001. It provides fed

Common Law Marriages
Common law marriages can have a bearing on student aid eligibility, since a married student is automatically independent.
The requirements for a common law marriage are as follows:
- The couple must live together for a significant amount of time. The word significant is not defined in any state, but is generally interpreted as sufficient time to reasonably establish the intent of the couple to be married.
- The couple must hold themselves out as married. This can include use of the same last name, referring to each other as husband and wife, maintaining a joint checking account, signing the lease as "Mr. and Mrs.", and filing a joint income tax return.
- The couple must have the capacity to be married. This means they must have the legal and mental capacity to be married and not be already married to someone else.
- The couple must intend (consent) to be married. Intent is usually

#Competition and Patents
Introduction
The objective of competition policy is to ensure a fair functioning of the market and, in particular, that market entry is not unduly prevented or made difficult. Anti-competitive practices include a range of activities, such as abusive exclusionary conduct by a dominant company, refusal to provide certain goods or to grant licenses on market conditions, charging excessive prices, vertical arrangements between suppliers and distributors and other agreements among firms which lead to the distortion of competition on the market.
There is a close link between patent rights and competition, which, in simple terms, can be characterized by two factors: on the one hand, patent laws aim to prevent the copying or imitation of patented goods, and thus complement competition policies in that they contribute to a fair market behavior. On the other hand, competition laws may limit patent rights in that patent holders may be barred from abu

#Competition driving some law firms out of Abu Dhabi
As Abu Dhabi Global Market opens its doors to international financial and professional services firms, a number of western law companies appear to be packing up and heading back down the road to Dubai.
Experts say the exodus comes as tough competition for a limited supply of work has been exacerbated by high rental costs.
Last month Herbert Smith Freehills became the latest western law firm to shut up shop in the capital, six years after its office opened.
We are confident that we can continue to provide the quality and breadth of service to our clients in Abu Dhabi from our offices in Dubai and Doha and our global network across the UK/US, Europe and Asia Pacific, the head of the firm s Middle Eastern practice Zubair Mir told American Lawyer last month.
The departure of Herbert Smith Freehills follows Baker Botts, which closed its office in the capital in May after six years of operations. In Mar

If you’re considering a postgraduate-level degree in business, there are three main options available to you: MA, MSc or MBA. The core courses of any postgraduate business degree aim to introduce advanced-level topics in areas of business such as accounting, finance, marketing, human resources and operations management. Many programs then offer a wide range of elective courses, although some are specialized in one particular area of interest right from the start.
Some of the key differences between an MBA and other Masters in Business programs are explained below:
MBAs and other postgraduate business degrees have many similar entry requirements, including GMAT/GRE scores, academic achievements and evidence of language requirements. The most significant difference is that MBA entry requirements also state that applicants must have a minimum amount of professional experience, usually at least two or three years and often more (especially for an Executive MBA).

The practice of law involves representing a client in a court of law or during legal negotiations, and providing legal counsel to clients. While lawyers may also draft documents and conduct research into case and statutory law, these tasks are often relegated to paralegals, or legal support staff. To practice as a lawyer, an individual must have earned a juris doctor (J.D.) degree, in most cases from a law school accredited by the American Bar Association, and pass a bar examination to become licensed in their state. While there is much interest in online degree programs in law, it is important to note that at present there are no fully online programs leading to the J.D. that are accredited by the ABA, according to the ABA website. Since most states require students to have graduated from an ABA-accredited program to sit for the bar exam, online law school programs are not currently a feasible path to becoming a lawyer for individuals in all states.
Even so, it is possible

National Sunday law is a conspiracy theory which alleges that the United States government is on the verge of enacting a national blue law that would make Sunday a day of rest and worship. The theory is based on the idea that the Pope is the Antichrist and the Mark of the Beast is worshipped on Sunday. Sinister forces (read: the Vatican ) are conspiring to enact a national Sunday law in the United States, which would be the trigger that unleashes the fulfilment of the prophecies found in the Biblical books of Daniel and Revelation .
Fears about a national Sunday law date almost to the founding of the SDA church. In The Great Controversy. Ellen G. White wrote: "and even in free America, rulers and legislators, in order to secure public favor, will yield to the popular demand for a law enforcing Sunday observance." [1] She claimed to have foreseen such a thing in 1844. [2] The most notable attempt at passing a national blue law was in 1888, coincidentally the sam

What is Intellectual Property Law?
Intellectual property law deals with the rules for securing and enforcing legal rights to inventions, designs, and artistic works. Just as the law protects ownership of personal property and real estate, so too does it protect the exclusive control of intangible assets. The purpose of these laws is to give an incentive for people to develop creative works that benefit society, by ensuring they can profit from their works without fear of misappropriation by others.
Article I, Section 8 of the U.S. Constitution gives Congress express authority to grant authors and inventors exclusive rights to their creations. Section 8 also gives Congress the power to regulate interstate and foreign commerce, providing further support for its right to legislate in this area. Intellectual property laws passed by Congress are administered by two government agencies, the U.S. Patent and Trademark Office, and the U.S. Copyright Office.

To find the top online law school students should consider

Under the Socratic Method system of legal instruction. before each class, students are assigned cases to read and brief. This is followed by in-class presentations by the students. This is a crucial part of the learning process, students are questioned by the professor regarding the facts, rule of law, or the court’s reasoning in the case assigned for class.
The Socratic Method prepares students for the practice of law, it teaches law students how to analyze and make legal arguments, how to properly read and brief cases, and, lastly, how to prepare for the pressures of a legal practice. Although much of the practice of the law involves research and writing, all attorneys must discuss the law with other attorneys, judges, and their clients. Key points
- A contract of employment is an agreement between an employer and employee and is the basis of the employment relationship.
- Most employment contracts do not need to be in writing to be legally valid, but it is better if they are.
- A contract 'starts' as soon as an offer of employment is accepted. Starting work proves that you accept the terms and conditions offered by the employer.
- Most employees are legally entitled to a Written Statement of the main terms and conditions of employment within two calendar months of starting work. This should include details of things like pay. holidays and working hours. Download our Written Statement of Employment [55kb] template.
- An existing contract of employment can be varied only with the agreement of both parties.

But it is an area of the law where, beyond that simple fact, the waters are very murky.
In a nutshell, the Supreme Court of Canada said that the section of the Criminal Code which made abortion a crime was of no force or effect so it is as if that section did not exist. The Supreme Court can overrule Parliament when the latter's laws are incompatible with the Charter of Rights and Freedoms. That was the case here.
Behaviour in Canada can only be criminal if a federal law specifically prohibits it.
There is a long history of abortion in common law. known as "destroying infants in the mother's womb" and punishable by "transported beyond this season for the term of his or her natural life or for any term not less than 15 years" (William Russell, A Treastise On Crimes and Misdemeanors (Philadelphia: T JW Johnson Co.,1857), p. 671).
Historically, some phases of the common law punished the perpetrator of an abortion only if it occurred subsequent t

#Cooley Law School weathering decline in enrollment
(LANSING STATE JOURNAL) - From the outside, what was happening at Thomas M. Cooley Law School in the fall of 2010 looked like another chapter in the school's explosive growth.
Enrollment topped 4,000 students, spread across four campuses in Michigan. The newest, in Ann Arbor, had opened the year before. And, though it's a nonprofit, Cooley was pulling in money. It began that fiscal year with $90 million in net assets and closed it with $111 million.
In retrospect, it was a high-water mark. Students had flocked to law schools after the economic meltdown of 2008. Cooley's leaders didn't pass on the opportunity.
Enrollment has fallen sharply since. Cooley had 3,219 students last fall, even after the opening of a fifth campus near Tampa, Fla. Don LeDuc, Cooley's president and dean, said the entering class this fall will be "significantly smaller" than the previous year. As for the money, he calls it a nest egg.

#Consumer Protection Laws You Need To Know
You buy a new bike for your daughter as a birthday gift. When she tries it in the park three weeks later, you both notice the front tire is bent. What do you do? Should you fix it yourself and avoid the trouble of going back to the store? Has the return time lapsed? Is the bike it still covered under warranty? What do you if you didn't purchase extra insurance coverage ?
The blue sweater, you bought has given you a rash. When you look at the label, you notice that it's not 100% cotton as advertised. Instead, it is made from a mix of unpronounceable materials. Can you dispute the seller's claims?
These are some of the scenarios that customers go through daily. Consumer protection laws are meant to protect us against these types of issues. That is why it's important to familiarize ourselves with the more common consumer protection laws.

#Contract law
Definition
Overview
Contracts are promises that the law will enforce. The law provides remedies if a promise is breached or recognizes the performance of a promise as a duty. Contracts arise when a duty does or may come into existence, because of a promise made by one of the parties. To be legally binding as a contract, a promise must be exchanged for adequate consideration. Adequate consideration is a benefit or detriment which a party receives which reasonably and fairly induces them to make the promise/contract. For example, promises that are purely gifts are not considered enforceable because the personal satisfaction the grantor of the promise may receive from the act of giving is normally not considered adequate consideration. Certain promises that are not considered contracts may, in limited circumstances, be enforced if one party has relied to his detriment on the assurances of the other party.
Contracts are mainly governed by state

UPDATED FOR 2015! The law school odyssey is coming to a close for many students this year, and before the focus shifts to studying for the bar exam and staring blankly into the middle distance contemplating disappearing job prospects, these graduates deserve some gifts.
Obviously, the best gifts for a newly minted J.D. would be comprehensive debt relief, job offers, or straight cash, homey. Unfortunately, you may not be able to deliver these gifts at least not in amounts that anyone wants or you may just not care that much about the graduate.
So we ve compiled some gift ideas, ranging from serious to specious, for you to consider.

What is Business Law?
Business law deals with the creation of new businesses and the issues that arise as existing businesses interact with the public, other companies, and the government. This area of the law draws on a variety of legal disciplines, including tax law, intellectual property, real estate, sales, employment law, bankruptcy, and others. Business law attorneys specialize in transactional work, meaning they do not represent clients in court. In fact, business lawyers are often hired for the purpose of avoiding future litigation.
To understand the role of business law within the legal system, it helps to view businesses as entities separate from their owners and employees. Just like individuals living together in society, business entities are subject to legal rules designed to give every participant in the marketplace a fair opportunity to succeed.
An enforceable system of business laws also benefits the economy as a whole and provides for

I'm going to tell you a little story, but before I do, a warning: It ain't pretty.
It's a perfectly fine Thursday afternoon. I'm going about my business, happily editing a blog post, when I get an email from the head of HubSpot's legal department. Oh boy.
Apparently, he'd received a letter from a popular stock photography website claiming we had wrongfully used two of their images on our blog.
My first thought was, "What? This must be a mistake." We're very good about only using photos and images we have permission to use on the blog. As a result, we usually either purchase stock photos or use images sourced from sites like Flickr licensed under Creative Commons, which is a nonprofit offering easy-to-use copyright licenses that make it easy for people t

#Contract Law Training
Contract Law Essentials
Business people deal with contracts in many different contexts — purchasing, sales, marketing, distribution, employment and others — almost every day. A contract serves, in effect, as the private law of the parties on whatever subjects it covers. This is a powerful tool, since the law gives parties tremendous flexibility in defining their contractual relationships. Whatever terms the parties agree to include (within broad legal limits) define their respective rights and obligations for the duration of the contract.
Because every valid contract gives rise to legal rights and obligations, it is important to understand how contracts are (and are not) formed and enforced. Dire consequences may await those who fail to form a valid contract when intended, or who bind themselves or their organization to a contract inadvertently.

#Consumers International - UN Guidelines on Consumer Protection
United Nations Guidelines for Consumer Protection
Our hard fought advocacy has delivered consumer protection guidelines at the international level.
The United Nations Guidelines for Consumer Protection (UNGCP) act as an international reference point of the consumer movement, but with new developments in technology and business practices, there is a strong argument for revising them to ensure they are still relevant to the challenges facing consumers.
The guidelines were adopted by the UN in 1985 after 10 years of campaigning by CI. They gave important legitimacy to the principles of consumer rights and practical support and guidance for developing national consumer protection legislation.
In 1999, they were updated with a new section on sustainable consumption and production (section G) to reflect environmental concerns emerging during the 1990s.
The guidelines have been interp

#Contract Law.
What is Contracts Law?
The concept of a contract dates back to ancient times. However, the modern rules regarding the formation and interpretation of contract is largely derived from the common law legal system. A contract is an agreement between two or more people having a lawful objective to do some thing or purchase some product in exchange for a corresponding exchange of value.
The elements of a contract are:
Offer and Acceptance (often called a meeting of the minds)
Consideration (the value exchanged between the parties)
and Mutuality of Obligation (one cannot be required to give substantially more than the other)
Some also consider capacity, or the legal competence to enter into a contract, an element of its formation.
Remedies
Contracts usually have two primary forms of recovery: damages, or the money equivalent to the value the party would have received from the contra

Troubled by minority students' dismal failure rate on the California Bar examination, the UCLA Law School faculty has voted to toughen its graduation standards and improve the school's academic support systems.
The changes, which were approved at a meeting of the faculty Friday evening, were adamantly opposed by various student organizations on the grounds that such changes would reduce minority groups' chances of entering and graduating from the Law School.
According to an umbrella protest group that calls itself "the Diversity Coalition," the changes were made abruptly, "without student input. and shortly before Law School finals," thus making it difficult for most students to participate in what the students said are "drastic changes" in some of the school's fundamental policies and programs.

The Buzz
About Cooley LLP
The firm that is now known as Cooley LLP was founded in 1920 in San Francisco by Arthur Cooley and Louis Crowley. The practice they started went on to become a major player in California, as it prospered in the Silicon Valley boom years (and survived the bust). Since then, the firm has expanded its reach to Southern California, the Rockies, the East Coast, the Pacific Northwest, the Far East and the UK, while maintaining a relatively comfortable size.
In 1980, Cooley opened an office in Palo Alto, the epicenter of American technology. The firm began working with venture capitalists, life sciences companies and emerging technology start-ups, representing the likes of Adobe Systems and Gilead Sciences; it also took Genentech and Amgen public in 1980 and 1983, respectively. The human psyche is an amazing thing. Those earning a psychology degree get to unravel it s mysteries.
All human psyches consist of six things: love, fear, joy, hatred, boredom and sexuality. The degree to which a person focuses on one or more of those aspects is what makes them unique. It’s also what keeps psychologists in business.
What is Psychology?
Psychology can be defined in one of two ways. First and foremost, it is the mental characteristics or attitude – as defined above – which defines a person or group of people. It also can be defined as the scientific study of the human mind and its function, particularly those which affect human behavior in certain situations. People who study psychology are called psychologists.
It is the goal of psychologists to both understand and treat the human psyche, which includes treatment for mental health, enhancing the performance of the human brain, self-help therapy and other mental health issues that affe

Copper Pipes
Description:
This is an excellent demonstration of Lenz's law and eddy currents. When a magnet is dropped through a vertical copper pipe, it falls much slower than a steel ball would. Its rate of fall quickly reaches a terminal velocity and it takes much longer for it to fall out of the other end than a steel ball would take.
Construction:
There is nothing that has to be built or put together for this demonstration. All that is needed is a strong magnet (for example, a NIB measuring 1/2 diameter, about 1/8 thick) and three or four copper pipes of different sizes. The following table details the copper pipes I used:

The school offers solid employment prospects, particularly in New York City biglaw, at an extremely high price tag. The concerns of elders and the concerns of their caregivers typically coincide—quality of life, quality of care, wellbeing of the primary caregiver (ordinarily a spouse or family member), and wellbeing of loved ones, including pets.
Elders often find it unavoidable to address these problems: (a) to maximize financing for expensive long-term care versus leaving an inheritance for loved ones; and (b) to wisely select fiduciaries to act on their behalf in case of physical or mental incapacity. Such problems present significant emotional, financial, and legal challenges.

These days, it’s really not easy to get into a law school.
A recent survey reveals that the quality of law school applicants has increased a lot in the past few years, making the competition more fierce than ever before. Earning a law degree through attending an online law school is especially difficult, but it’s still possible.
All states in America, except California, require students to get a law school degree accredited by the American Bar Association before they take the Bar exam. However, there is no online law school accredited by ABA. Therefore, only those living in California or willing to relocate have a chance of taking the Bar exam, which is essential for a practicing lawyer, with an online law degree.
How to Choose an Online Law School
Choosing the right online law school really makes sense for people whose career goal is to practice law as an attorney. It is risky to attend an unaccredited online school. Also, it might be a suffer

Ampere's Law was discovered in 1819 by Ampere. Ampere's Law states that currents generate magnetic fields or in other words, whenever you have a current, there is a magnetic field circulate around it. Ampere's Law is expressed in the equation magnetic field x 2(pi) x radius = constant x current(passing through that path) .
So let s talk about ampere s law. Ampere s law was discovered well the effect behind ampere s law was discovered around 1819 actually by a Physics lecturer who was in the middle of a lecture and he noticed that a magnetic field was generated that moved around a compass needle when he ran a big current through a wire, so the law basically says that currents, if I run a current it will generate a magnetic field. There is multiple ways of stating this law; there s the [IB] law, there s oersted s law. The standard way to present it is in terms of ampere s law which basically says that whenever you ve go

An early faculty member, Charles Evans Hughes, became a judge on the Permanent Court of International Justice, and later Governor of New York, U.S. Secretary of State, Associate Justice, and Chief Justice of the U.S. Supreme Court.

Some stories just won t go away. Consider the tale of Reema Bajaj. the attractive Illinois attorney who pleaded guilty to prostitution last June. Reema keeps coming, and coming, and coming.
After the story climaxed with her guilty plea, we expected it was all over. But then Bajaj thrust herself back into the headlines by suing one of her former lawyers. along with other attorneys, alleging that they shared nude photos of her around the courthouse.
And now Reema Bajaj has been hit with ethics charges from the Illinois Attorney Registration and Disciplinary Commission (IARDC). The IARDC s most salacious allegation: that Bajaj traded sex acts for office supplies.
What would Reema do for a ream of printer paper? How much toner to access that taut, toned body?
After Bajaj s guilty plea to prostitution, we asked Michael S. Frisch. ethics counsel to the Georgetown University Law Center and an editor of the Legal Profession Blog. whether her plea to a a singl

A relatively young law school, Vermont Law School has been fully accredited by the ABA since 1978. Located in the tiny town of South Royalton, Vermont educates a total of 567 students, all full-time.
With 25 th -75 th percentile LSATs of 152-158, and GPAs of 3.05-3.57, Vermont's admissions statistics are very typical of the third tier. One aspect of admissions that does distinguish Vermont is the school's acceptance rate - at 66.7% (590 of 884), the highest of any law school in the nation. Of those accepted, 233 decided to enroll, giving Vermont a more respectable matriculation rate of 39 percent.
Do not be fooled by the name - Vermont is a private school, not public. Thus the tuition is both the same for in- and out-of-state students, and also very steep: $40,420 annually. And unfortunately, Vermont is not particularly generous with financial aid. The 25 th - 75 th percentiles of grant aid ranged only from $5,000 to $13,000 a year. And although merit- and need-based

Foreclosures consistently represent some of the most affordable and advantageous deals available on any real estate market, and offer convenient ways to purchase undervalued homes for anyone from new homeowners to experienced real estate investors. Taking advantage of these purchasing opportunities means that learning about foreclosure laws - particularly how they vary from state to state - is crucial to any successful purchase.
One of the key distinctions to understand regarding different foreclosure laws from state to state is the length of time involved from the initial Notice of Default filed against the property by the lender to the actual foreclosure auction and date of sale. In some states, foreclosures proceed through the system fairly quickly. In Texas, for example, non-judicial foreclosures (see below) can be processed in little over a month.
In other states, the opposite is true. In New York, for example, the average forec

Military justice is the body of laws and procedures governing members of the armed forces. Many states have separate and distinct bodies of law that govern the conduct of members of their armed forces.
